HomeMy WebLinkAbout1965-116 CCR Member Phil Cohen introduced the following resolution and moved its adoption: RESOLUTION NO. 65 -116 RESOLUTION WAIVING NOTICE REQUIREMENT SET FORTH IN SECTION 35 -220 OF VILLAGE ORDINANCES WHEREAS, notice was given for a Planning Commission public hearing on April 29, 1965, and Village Council hearing on May 3, 1965, concerning the issuance of a special use permit for a gasoline service station on part of Lots 4, 5, 6 and 7 of Olson's Island View Addition; and WHEREAS, abutting property owners did appear at the hearings and expressed approval of the special use permit; and WHEREAS, the Planning Commission and the Council approved the special use permit subject to the following conditions: (1) The parcel or property to be used for the service station shall be combined into a single parcel by registered land survey or by platting. (2) A dimensional site layout and building plans shall be submitted to the Planning Commission for approval before any construction is started. (3) Mr. Luchsinger executes an agreement to convey the street right -of -way for 66th Avenue between Lyndale Avenue and Willow Lane; and WHEREAS, Mr. Luchsinger has complied with Item (3) above; and WHEREAS, Mr. Luchsinger needs the approval of the site layout and the building plans before he can complete the negotiations for the purchase of the property; and WHEREAS, the options held by Mr. Luchsinger are expiring and there is not sufficient time to give the required notice to abutting property owners concerning the request for certain variances; and WHEREAS, the Planning Commission has determined that abutting property owners have been given notice of the change in land use and that they do not object; and RESOLUTION NO, 65 -116 WHEREAS, the variances requested in Application #65053 do not materially affect abutting property. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the requirement of notice of hearing for the granting of variances requested in Application #65053 be waived.
