moved its adoption:
RESOLUTION NO. 66 -180
RESOLUTION ORDERING A CERTAIN BUILDING LOCATED AT
5444 HUMBOLDT AVENUE NORTH, BROOKLYN CENTER, MINNESOTA
TO BE RAZED AND REMOVED
WHEREAS, Twin City Federal Savings and Loan Association is the owner of
a certain building located at 5444 Humboldt Avenue North, Brooklyn Center,
Hennepin County, Minnesota; and
WHEREAS, this building is best described as an abandoned, burned -out
structure consisting of wooden siding and roof; and
WHEREAS, after receipt of numerous complaints, Jean Murphey, the
Building Inspector of the Village of Brooklyn Center, on the 13th day of
June, 1966, inspected the property and submitted his report to the Council,
which described the premises as generally abandoned in a dilapidated and
extreme state of disrepair; stating that it is of generally unsightly appearance,
that it violates the Building Code of the Village of Brooklyn Center in that
the structure has been substantially consumed by fire, that unsafe conditions
exist which could result in personal injury to any person on or near the property,
that it is an attractive nuisance for children, that several types of combustibles
are located on the property which could cause an explosion, fire or other
contamination, and that in the opinion of the Building Inspector, the building is
beyond repair; and
WHEREAS, the Council of the Village of Brooklyn Center finds that the
above described building is inadequately maintained, dilapidated and in a state
of extreme disrepair; is in an unsanitary condition; constitutes a hazard to
public safety, a menace to public health and a fire hazard, violates the
Building Code;
NOW, THEREFORE, BE IT RESOLVED that Twin City Federal Savings Loan
Association shall be ordered to raze and remove the cement and wooden structure
located at 5444 Humboldt Avenue North, Brooklyn Center, Minnesota, on the
property legally described as:
Lot 26, Block 2, Fairhaven Park, Hennepin County, Minnesota
And that this action is being taken pursuant to Minnesota Statutes Annotated
ss. 463.15 463. 26 on the grounds that said building is a hazardous building
within the meaning of that statute;

BE IT FURTHER RESOLVED that Twin City Federal Savings Loan Association,
his heirs or assigns, must comply with this order within twenty (20) days from
the date of service upon him or within twenty (20) days file an answer thereto,
otherwise a motion for summary enforcement of this order will be taken by
the Village of Brooklyn Center in the Hennepin County District Court.

The motion for the adoption of the foregoing resolution was du seconded

by member John Leary and upon vote being taken thereon the
following voted in favor thereof: Philip Cohen, John Leary, Earl Simons,
Howard Heck and TheodoreWillard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
