Commissioner Diane Niesen introduced the following resolution and
moved its adoption:
EDA RESOLUTION NO. 2003 -07
RESOLUTION CALLING FOR A PUBLIC HEARING REGARDING THE SALE OF
CERTAIN EDA OWNED PROPERTY LOCATED AT 5900 EMERSON AVENUE NORTH
AND 5912 CAMDEN AVENUE NORTH IN BROOKLYN CENTER, MINNESOTA,
PURSUANT TO MINNESOTA STATUTUES, SECTION 469.012 SUBDIVISION 7 AND
SECTION 469.029
WHEREAS, the City of Brooklyn Center Economic Development Authority
approved Resolution No. 2003 -06 Authorizing the Sale of Economic Development Authority
(EDA) Owned Property at 5900 Emerson Avenue North and 5912 Camden Avenue North, and;
WHEREAS, the EDA is authorized, pursuant to Minnesota Statutes, Section
469.012, Subdivision 7, within its area of operation and without the adoption of an Urban
Renewal Plan, to acquire real property, demolish the buildings and improvements thereon, and
sell such property in accordance with Minnesota Statutes Section 469.029, as long as the
buildings on such real property are substandard, and;
WHEREAS, the EDA has determined that the buildings located on the properties
described above were dilapidated and obsolescent and the clearance, thereof, was in the best
interest of the public health and welfare of the City of Brooklyn Center, and;
WHEREAS, proposals for development of the properties have been solicited and
received from builders pursuant to "City of Brooklyn Center Economic Development Authority
Lot Sale Procedures and Specifications for Construction of New Single Family Homes at 5900
Emerson Avenue North and 5912 Camden Avenue North" and the sale of the properties were
advertised in the City's official newspaper, and;
WHEREAS, the EDA has reviewed the proposals received for construction of
new single family homes at the properties, and;
WHEREAS, Minnesota Statutes Section 469 -029 requires that a public hearing be
held regarding the terms and conditions relative to the sale of the property.
NOW, THEREFORE, BE IT RESOLVED by the Economic Development
Authority in and for the City of Brooklyn Center, Minnesota that:
A public hearing is hereby authorized to be held on September 8, 2003, at 7:00 p.m. or
soon thereafter as the matter may be heard in the Brooklyn Center City Hall Council
Chambers regarding the proposed sale of properties described herein.
The proposal submitted by Exceptional Homes, Inc. for 5900 Emerson
Avenue North and the proposal submitted by Exceptional Homes, Inc. for 5912
Camden Avenue North best meet the requirements set forth in the "Lot Sale Procedures

and Specifications for Construction for New Single Family Homes at 5900 Emerson
Avenue North and 5912 Camden Avenue North
The EDA Executive Director is authorized to prepare purchase agreements for the
properties described herein establishing the terms and conditions of the sale of the
properties to Exceptional Homes, Inc.
The EDA Executive Director is hereby authorized and directed to publish the attached
notice of public hearing in the City's official newspaper on
August 11, 2003

The motion for the adoption of the foregoing resolution was duly seconded by commissioner
Bob Peppe and upon vote being taken thereon, the following voted in favor thereof:
Myrna Kragness, Kathleen Carmody, Kay Lasman, Diane Niesen, and Bob Peppe;
and the following voted against the same: none;
whereupon said resolution was declared duly passed and adopted.
