Commissioner Debra Hilstrom introduced the following resolution
and moved its adoption:
EDA RESOLUTION NO. 95 28
RESOLUTION PROVIDING FOR A PUBLIC HEARING REGARDING THE
SALE OF LAND BY THE ECONOMIC DEVELOPMENT AUTHORITY IN
AND FOR THE CITY OF BROOKLYN CENTER AND AUTHORIZING THE
EXECUTIVE DIRECTOR TO NEGOTIATE A PURCHASE AGREEMENT
FOR THE SALE OF SUCH LAND LOCATED AT 6601 BRYANT AVENUE
NORTH IN BROOKLYN CENTER
WHEREAS, pursuant to EDA Resolution No. 95 -16, the Brooklyn Center
Economic Development Authority authorized the EDA Executive Director to seek offers to
purchase the property located at 6601 Bryant Avenue North; and
WHEREAS, Minnesota Statutes, Section 469.029, Subd. 2, requires a public
hearing for the sale of land by the Brooklyn Center Economic Development Authority; and
WHEREAS, the Brooklyn Center Economic Development Authority has received
an offer from Howard Bohanon Homes, Inc. for the purchase of the EDA -owned land at 6601
Bryant Avenue North described by the following legal description:
That part of Lot 43 lying easterly of a line running from a point
in the north line thereof, distance 163.3 feet west from the
northeast corner thereof, to a point in the south line thereof,
distance 163.28 feet west from the southeast corner thereof except
street, Lot 43, Auditor's Subdivision 310 to Hennepin County; and
WHEREAS, the EDA staff has reviewed the proposal and has recommended the
EDA Board hold a public hearing on the offer and authorize the EDA Executive Director to
negotiate a purchase agreement with Howard Bohanon Homes, Inc., for the purchase of the
property.
NOW, THEREFORE, BE IT RESOLVED by the Economic Development
Authority in and for the City of Brooklyn Center that it has determined it is in the best interest
of the City of Brooklyn Center to authorize the EDA Executive Director to negotiate a purchase
agreement for the sale of the property to Howard Bohanon Homes, Inc, the terms of such
purchase agreement to be subject to the further review and acceptance by the EDA.
BE IT FURTHER RESOLVED that the Brooklyn Center Economic Development
Authority hereby authorizes a public hearing to be held on October 23, 1995, at 7:00 P.M. or
as soon thereafter as the matter may be heard in the Brooklyn Center City Hall Council
Chambers regarding the proposed sale of property described herein to Howard Bohanon Homes,
Inc., and the provisions of such sale.

BE IT FURTHER RESOLVED that the Executive Director is hereby authorized
and directed to publish the attached notice of public hearing in the City's legal newspaper on
October 4, 1995.

The motion for the adoption of the foregoing resolution was duly seconded by commissioner
Kathleen Carmody and upon vote being taken thereon, the following voted
in favor thereof: Myrna Kragness, Kristen Mann, Debra Hilstrom, and Kathleen Carmody;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.

NOTICE OF PUBLIC HEARING
REGARDING THE SALE OF LAND
BY THE ECONOMIC DEVELOPMENT AUTHORITY
IN AND FOR THE CITY OF BROOKLYN CENTER
Notice is hereby given that the Economic Development Authority in and for the City of
Brooklyn Center will hold a public hearing on October 23, 1995, at 7:00 P.M., or as soon
thereafter as the matter may be heard, at the Brooklyn Center City Hall located at 6301 Shingle
Creek Parkway, Brooklyn Center, Minnesota, pursuant to Minnesota Statutes Section 469.029,
Subd. 2, regarding the proposed sale of the following described property:
That part of Lot 43 lying easterly of a line running from a point in the north line
thereof, distance 163.3 feet west from the northeast corner thereof, to a point in
the south line thereof, distance 163.28 feet west from the southeast corner thereof
except street, Lot 43, Auditor's Subdivision 310 to Hennepin County.
All persons desiring to be heard shall appear at the time and place referenced above.
