Commissioner Celia Scott introduced the following resolution
and moved its adoption:
EDA RESOLUTION NO. 94 -51
RESOLUTION MODIFYING HOUSING DEVELOPMENT AND
REDEVELOPMENT PROJECT NO. 1; ESTABLISHING TAX INCREMENT
FINANCING DISTRICT NO. 03; AND APPROVING AND ADOPTING THE
REDEVELOPMENT PLAN AND TAX INCREMENT FINANCING PLAN
RELATING THERETO
WHEREAS, the City Council (the "Council of the City of Brooklyn Center (the
"City") has proposed to modify the Redevelopment Plan for Housing Development and
Redevelopment Project No. 1 and adopt a Tax Increment Financing Plan for Tax Increment
Financing District No. 03, all pursuant to and in accordance with Minnesota Statutes, Sections
469.001 to 469.047; Minnesota Statutes, Sections 469.090 to 469.1081; and Minnesota Statutes,
Sections 469.174 to 469.179, inclusive, as amended; and 1994 Minnesota Laws, Chapter 587,
Article 9, Section 14; and
WHEREAS, Council has transferred control, authority, and operation of Housing
Development and Redevelopment Project No. 1 and certain tax increment financing districts
from the Brooklyn Center Housing and Redevelopment Authority to the Brooklyn Center
Economic Development Authority (the "Authority") and the Authority has accepted responsibility
for Housing Development and Redevelopment Project No. 1 and certain tax increment financing
districts; and
WHEREAS, the Authority and the Council have investigated the facts and have
caused to be prepared a modified Redevelopment Plan for Housing Development and
Redevelopment Project No. 1 and a Tax Increment Financing Plan for Tax Increment Financing
District No. 03 (the "Plans and
WHEREAS, proposed developments as described in the Plans in the opinion of
the Authority would not reasonably be expected to occur solely through private investment
within the reasonable foreseeable future and, therefor, the use of tax increment financing is
deemed necessary; and
WHEREAS, the Authority and City have performed all actions required by law
to be performed prior to the modification of Housing Development and Redevelopment Project
No. 1 and the establishment of Tax Increment Financing District No. 03, including, but not
limited to, notification of Hennepin County and School District Nos. 11, 279, 281 and 286
having taxing jurisdiction over the property included in Tax Increment Financing District No.
03, a review by the City Planning Commission of the proposed Plans, and the scheduled holding
of a public hearing upon published notice as required by law.
NOW, THEREFORE, BE IT RESOLVED by the Economic Development
Authority in and for the City of Brooklyn Center as follows:

1. The Plans are hereby approved and adopted and shall be placed on file in the
office of the Executive Director.
2. Upon approval of the Plans by the City Council, the staff, the Authority's
advisors and legal counsel are authorized and directed to proceed with the
implementation of the Plans and for this purpose to negotiate, draft, prepare and
present to this Board for its consideration all further plans, resolutions, documents
and contracts necessary for this purpose.
3. Upon approval of the Plans by the City Council, the Executive Director is
authorized to forward a copy of the Plans to the Hennepin County Auditor and
the Minnesota Department of Revenue pursuant to Minnesota Statutes, Section
469.175, Subd. 2.

The motion for the adoption of the foregoing resolution was duly seconded by commissioner
Dave Rosen and upon vote being taken thereon, the following voted
in favor thereof:
Todd Paulson, Celia Scott, Dave Rosene, Barb Kalligher, and Kristen Ma
and the following voted against the same: none,
whereupon said resolution was declared, duly passed and adopted.
