Richard Hendrickson, being duly sworn on an oath states or affirms, that he is the Chief

has full knowledge of the facts stated below:
(A) The newspaper has complied with all of the requirements constituting qualification as
a qualified newspaper, as provided by Minn. Stat. §331A.02, §331A.07, and other

Notice is hereby given that a public hearing will be held on
the 14th day of June 2004 at 7:00 p.m. or as soon there-
after as the matter may be heard at City Hall, 6301 Shin-
gle Creek Parkway, to consider An Ordinance Providing for
the Sale of Certain Land in the City.
Auxiliary aids for handicapped persons are available upon
request at least 96 hours in advance. Please notify the
Deputy City Clerk at 763- 569 -3300 to make arrange-
ments.
ORDINANCE NO.
AN ORDINANCE AUTHORIZING THE
SALE OF CERTAIN LAND IN THE CITY-
THE CITY COUNCIL OF THE CITY OF BROOKLYN
CENTER DOES ORDAIN AS FOLLOWS:
I. BACKGROUND
The City is the owner of certain real properties in
the City of Brooklyn Center, consisting of excess highway
right of way adjacent to Interstate Highway No. I -94 from
the south city limits to Interstate Highway No. I-694, and
legally described in Resolution No. 2004 -66 (the "Subject
Properties
1.2. The City Council has determined that it is in the
best interest of the City to sell the Subject Properties to the
owners of adjacent properties for combination with the ad-
jacent properties, on the terms and conditions of a Pur-
chase Agreement, a copy of which is on file with the City
Clerk (hereinafter the "Purchase Agreement
1.3. The City Council hereby determines that the pro-
posed disposal of the Subject Properties has no relation-
ship to the comprehensive municipal plan.
II. SALE OF PROPERTY
2.L The Mayor and City Manager are authorized and
directed to execute the Purchase Agreement with respect
to any one or more of the Subject Properties and take all
steps necessary to effect the terms thereof including the
conveyance of one or more of the Subject Properties upon
satisfaction by buyer of all terms of the Purchase Agree-
ment.
2.2. The sale prices of the. Subject Properties are set
forth in Resolution No. 2004 -66. It is expected that the
sales of the Subject Properties may occur over a period of
several years. The City Manager is authorized to annual-
ly re- establish the sale prices for the Subject Properties,
using the same criteria that were used to establish the sale
prices set forth in Resolution No 2004 -66.
2.3. The actions of City staff the Mayor and City Man-
ager in conveying any of the Subject Properties prior to the
date of this Ordinance are hereby ratified and approved in
all respects, and those sales are authorized by this Ordi-
nance.
Adopted this day of 2004.
III. EFFECTIVE DATE
3.1. This Ordinance shall become effective after adop-
tion and upon thirty (30) days following its legal publica-
tion.
