AN ORDINANCE AMENDING CHAPTER 35 OF THE CITY ORDINANCES REGARDING BUILDING SETBACKS ALONG MAJOR THORQUGHHARES THE CITY COUNCIL OF 'HE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Chapter 35 of the City Ordinances of the City of Brooklyn Center is hereby amended in the following manner Section 35 -400. TABLE OF MINIMUM. DISTRICT RE QUIREMENTS. Every useof land wit within' conform .to the followin minimum requirements w3ih are applicable to the Ian use district in which such use is contemplated. 10. Setbacks along major thoroughfares as designated in Section 35 -900 shall in all cases be at least 50 feet, mea- sured from the street right-of-way line, except for com (Cl and C2) or accessory structures or where the'proper- ty abuts a marginal access street or where the property abuts a noise wall or noise berm constructed by Mn/DOT, or where the City Council finds that excess right -of- way mitigates the effects of traffic noise, dust, and fumes. In such cases, the setback requirements shall be as contained in the Table of Minimum District Requirements. Section 2. This ordinance shall become effective after adoption and upon thirty days following its legal publica- tion.
