NOTICE OF ORDINANCE ADOPTION
ORDINANCE NO. 99-09
AN ORDINANCE AMENDING CHAPTER 5 OF THE
CITY ORDINANCES RELATING TO OPEN
BURNING AND THE ADOPTION OF THE
UNIFORM FIRE CODE
THE CITY COUNCIL OF THE CITY OF BROOKLYN
CENTER DOES ORDAIN AS FOLLOWS:
Section 1. Brooklyn Center City Code Section 5 -201.6
is amended as follows:
b. Adoption of Codes and Standards` There is adopted and
incorporated herein by reference as an ordinance of the
City:
1.Uniform Fir od Adonted. The Uniform Fire Code
as promulgated by the International Conference of
Building Officials and Western Fire Chiefs' Associa-
tion (19941 Edition) together with Appendices I -4
I -B. I -C. II -A. II -B. II -D. III -A. III -B. III-C. IV-A. IV-
B. VI -A. VI -B. VI -E and Minnesota Amendments as
found in Rules part 7510.3510 through 7510.3710 is
hereby adopted by reference and incorporated by

full. subject to deletions or modifications contained
in this section (which code is hereafter referred to as
the UFC code
1997 Edition.'
2. Adoption of National Fire Code. Whenever the Uni-
form Fire Coder
4589 is silent on any subject, for any reason, in any situa-
tion, the provision of protection shall be in accordance with
National Fire Code 4Q48 1997 Standards Numbered 13,
13A, 13D, 13R, 14, 20, 71, 72A, 72B, 72C, 72D, 72E, 72F,
74, 96, 101, 231, 231C, 231D, and 231F and their appen-
dices, issued by the National Fire Protection Association
(Quincy, Massachusetts, 4488 1997) which are adopted by
reference as part of this code as though set forth herein in
their entirety.
Section 2. Brooklyn Center City Code Section 5 -201.c
is amended as follows:
c. Codes on File. The eity -elerh fire chief shall file one (1)
copy of the Uniform Fire Code 44384 1997 Edition with the
State of Minnesota Amendments, and one (1) copy of those
parts of the National 'Fire Code referred to in section two
(2) of this Section, marked "Official Copy", in ,hie -ear -ham
his/her office, and the copies shall be kept available for pub
lic inspection.
Section 3. Brooklyn Center City Code Section 5 -204 is
amended by adding new paragraph i as follows:
j Open Burning:.
1. Except as authorized in thiel section. open burning of
any material is prohibited. This prohibition does not
pnply to burning conducted by governmental au-
thorities which 'have secured permission from the
fire chief or to outdoor cooking using only propane or
charcoal.
2. Outdoor recreational or cooking fires may he per
putted subiect to the following requirements
g. Such hurnine may be conducted only bv persons liv-
ing in a dwelling unit (as defined in Section 35 -900)
for which a permit has been secured from the fire
chief for burin neina specific location. Permits shall
be issued for a calendar year and only one permit
shall be issued for any dwelline unit. Subject to the
conditions and restrictions of this section and any
conditions or restrictions imposed by the fire chief,
a person holding such a permit may conduct UD to
four (4) such fires in each c, endar month.
b. All fires must be in an approved outdoor fireplace or
a nit which is at least one (1) foot below grade. A pit
must he loc: ted at least fifteen (15) feet from build-
ings. fences. property lines or flammable materials
Pits may be no more than three (3) feet in diameter
and the outside edge shall be ringed with brick or
rock. Commercially manufactured steel outdoor
fire nits may be used provided they are not more
than three (3) feet in diameter,
c. Only clean dry wood may be burned. Wood must
have been dried or cured for one (1) year or more and
protected from rain and snow. No leaves. trash,
treated or painted wood. or any other materials may
be burned. All burning material must be contained
in the pit at all times.'
11. Fires shall he so managed and maintained that fires

persons are able to stand within four (4) feet of the
fire;
e. The fire shall be attended bv an adult at all times
and must he extinguished when unattended. An ad
eouate source of water must be available at the nit
for extinguishing the fire.
f. Prior to commencement of burning the Brooklyn'
Center police department must he notified.
g, A fire may not be allowed to burn for more than six
j6) hours.
h. The fire chief is authorized to reouire that recre-
ational fires be immediately extinguished if it is de-
termine4 by the chief or the chief's designated
agent that the fire constitutes a. dangerous condi-
tion. or if the fire is burning without being permit-
ted or in violation of permit conditions Failure to
comply with anv Provision of this Chanter, with the
conditions of a permit. or with an order of the chief
or the chief's designated agent is a violation of this
section.
Section 4. Brooklyn Center Code Section 5 -204.c is
amended as follows:

1. If doors in fire corridors. separation walls. fire doors;
or smoke barrier doors are needed to he kept open
they shall be held open bv electric magnetic door
holders that are controlled and released by the trip
of a smoke detector or sprinkler head that covers
the entire bui1dine. The approval of the fire chief is
needed for this modification to a building,

Section 5. This ordinance shall be effective after adc
tion and thirty days following its legal publication.
