HomeMy WebLinkAbout1999-10 06-14 CCOCITY OF BROOKLYN CENTER Notice is hereby given that a public hearing will be held on the 14th day of June 1999, at 7 p.m. or as soon thereafter as the matter may be heard at the City Hall, 6301 Shingle Creek Parkway, to consider an amendment to Chapter 19 of the City Ordinances providing for the control of noxious weeds. ORDINANCE NO. 99 -10 AN ORDINANCE AMENDING CHAPTER 19 OF THE CITY ORDINANCES PROVIDING FOR THE CONTROL OF NOXIOUS WEEDS THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Chapter 19 of the City Ordinances of the City of Brooklyn Center is hereby amended as follows: Section 19 -1601. CONTROL OF NOXIOUS WEEDS. It shall be the duty of every occupant of land or, if the land is unoccupied, the owner thereof, or his agent, or the public official in charge thereof, to cut down, otherwise destroy, or eradicate all noxious weeds as hereinafter defined, standing, being, or growing upon such land, except for areas within natural preserves, in such manner and at such times as may be directed or ordered by the Brooklyn Center Weed Inspector. Natural preserves shall be publicly owned lands designated as park or open space or private properties approved by the City. Section 19 -1602. ADOPTION OF STATUTES BY REFERENCE. The regulatory provisions of Minnesota Statutes Sections 18.181 and 18.281 to 18.311 18.76 to 18.88 "Minnesota Noxious Weed Law" are hereby adopted by reference for the control of noxious weeds within the City of Brooklyn Center. Said State regulations are incorporated in and made a part of this ordinance as completely as if set out here in full. Section 19 -1603. NOXIOUS WEEDS DEFINED. a. For purposes of this ordinance and in addition to provisions of Minnesota "noxious weeds" means the following plants: Common Name Botanical Name Field Bindweed Convolvulus arvcnsis IIcmp Cannabis sativa Poison Ivy Rhus radicans Spurgc, leafy Euphorbia csula ORDINANCE NO. 99 -10 any plant which is identified by the Minnesota Commissioner of Agriculture as a noxious weed or secondary noxious weed pursuant to Minnesota Statutes Section 18.77. Subdivision 8. b. Any weeds or grass growing to a height greater than eight (8) inches or which have gone or about to go to seed. Section 19 -1604. PENALTIES. Any person, firm or corporation violating provisions of this ordinance by failing, neglecting, or refusing to comply with the provisions thereof, shall, upon conviction thereof, be punished by a fine not to exceed seven hundred dollars ($700) or imprisonment not to exceed ninety (90) days or both, together with the costs of prosecution. Section 2. This ordinance shall be effective after adoption and thirty days following its legal publication. Adopted th f day of 1 4- 1999.
