AN ORDINANCE AMENDING CHAPTER 23 OF THE CITY ORDINANCES RELATING TO PAY MENT BY PAWNBROKERS AND SECONDHAND GOODS DEALERS FOR ITEMS PLEDGED AND LO- CATION OF PAWNBROKERS THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Brooklyn Center City Code Section 23 -627 is repealed as follows: Section 2. Brooklyn Center City Code Section 23 -674 is repealed as follows: Section 3. Brooklyn Center City Code Section 23 -606 is amended as follows: Section 23 -606. SITE PLAN. Subdivision 1. The application for a pawnbroker li- cense must be accompanied by, a site plan drawn to scale. The site plan must contain: a: A legal description of the property upon which the proposed license premises is situated. b. A survey. c. The exact location of the license premise on the prop- erty, customer and employee parking areas, access onto the property, and entrances into the premises. d. The location of any church, school, day -care center, hospital, on -sale liquor establishment. halfway bowie. check cashing operation. theater, or resi- dence within 300 feet of any portion of the premises occupied by the applicant. e. A floor plan of the license premises. Section 4. Brooklyn Center City Code Section 23 -610 is amended as follows: Section 23 -610. PLACES INELIGIBLE' FOR LI- CENSES. A license will not be issued or renewed under this section for any place or for any business: a. If taxes, assessments or other financial claims of the City or the State of Minnesota on the licensee's busi- ness premise are delinquent and unpaid; b. If the premise is located within 300 feet of a school, day -care center, or church, hospital. on -sale liquor establishment. halfway house. check cashing opera- tion. theater. or residence; c. Where operation of a licensed premise would violate zoning ordinances; d. Where the applicant's present license was issued conditioned upon the applicant making specified im- provements to the licensed premise or the property of the licensed premise which improvements have not been completed or; e. Established as a pawnshop after April 2, 1996, which is within ten (10) driving miles of any gam- bling casino. Section 5. This ordinance shall be effective after adop- tion and thirty days following its legal publication. Adopted this day of 1999.
