HomeMy WebLinkAbout1999-08 02-22 CCOCITY OF BROOKLYN CENTER Notice is hereby given that a public hearing will be held on the 22nd day of February, 1999, at 7 p.m. or as soon thereafter as the matter may be heard at the City Hall, 6301 Shingle Creek Parkway, to consider An Ordinance Amending Chapter 23 of the City Ordinances Relating to Payment by Pawnbrokers and Secondhand Goods Dealers for Items Pledged and Location of Pawnbrokers. Auxiliary aids for persons with disabilities are available upon request at least 96 hours in advance. Please contact the City Clerk at 569 -3300 to make arrangements. ORDINANCE NO. 99 -08 AN ORDINANCE AMENDING CHAPTER 23 OF THE CITY ORDINANCES RELATING TO PAYMENT BY PAWNBROKERS AND SECONDHAND GOODS DEALERS FOR ITEMS PLEDGED AND LOCATION OF PAWNBROKERS THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Brooklyn Center City Code Section 23 -627 is repealed as follows: Scction 23 -627. PAYMENTS BY CIIECK. When a pawnbroker makes payment for an itcm plcdgcd or received at thc license place of busincss, payment must be made by check, Section 2. Brooklyn Center City Code Section 23 -674 is repealed as follows: Z nral an amount greater than one hundred dollars ($100) for an itcm or items vie payable to thc -named payee, who is actually thc intended seller. Section 3. Brooklyn Center City Code Section 23 -606 is amended as follows: Section 23 -606. SITE PLAN. Subdivision 1. The application for a pawnbroker license must be accompanied by a site plan drawn to scale. The site plan must contain: a. A legal description of the property upon which the proposed license premises is situated. b. A survey. c. The exact location of the license premise on the property, customer and employee parking areas, access onto the property, and entrances into the premises. ORDINANCE NO. 99 08 Section 23 -610. PLACES INELIGIBLE FOR LICENSES. A license will not be issued or renewed under this section for any place or for any business: Date of Publication Effective Date d. The location of any church, school, day -care center, hospital, on -sale liquor establishment, halfway house, check cashing operation, theater, or residence within 300 feet of any portion of the premises occupied by the applicant. e. A floor plan of the license premises. Section 4. Brooklyn Center City Code Section 23 -610 is amended as follows: a. If taxes, assessments or other financial claims of the City or the State of Minnesota on the licensee's business premise are delinquent and unpaid; b. If the premise is located within 300 feet of a school, day -care center, or church, hospital, on -sale liquor establishment, halfway house, check cashing operation, theater, or residence; c. Where operation of a licensed premise would violate zoning ordinances; d. Where the applicant's present license was issued conditioned upon the applicant making specified improvements to the licensed premise or the property of the licensed premise which improvements have not been completed or; e. Established as a pawnshop after April 2, 1996, which is within ten (10) driving miles of any gambling casino. Section 5. This ordinance shall be effective after adoption and thirty days following its legal publication. Adopted this 22nd day of February 1999.
