The Housing Commission needs a mission, goals and tasks as soon as passible.
For over six months we have met oniy to discuss what we did not do the previous month.
This has been frustrating for ail participants and is wasteful of time for everyone concerned.
We need real goals, real tasks and reai work or we may find ourseives with muitipte apenings
on the Housing Commission.
As I stated during last week's meeting, I have absolutely no prablem with the council
disbanding the Housing Commission if we feel there is no need or function for the graup. If
there is a more effective way to make MEANINGFUL progress with re ard to our housin

stock, I'll support it, whether on the Housing Commission or not.
While I/ we appreciate efforts by the City Councii and staff to identify needs and creatively
salve for what can/should be done supporting renta! housing stock, my impression is that we
are trying to reinvent the wheel.
o We know provisianaf licensing has had an impact on 4+ unit housing
o We know (single family) rental housing suff�rs from many of the same problems as 4+
unit housing
o We know single family rental housing is being run for profit; it seem patently uniikely
(to me) thafi we have many none-homesteaded homes being run as charities.
o As such, if the under 4-unit housing stock including singie family homes is/are being
run for pro�t, they are business.
o If said business is not regutated (as is the case now) we have a probiem.
o I have personaliy witnessed problems with two (licensed) rental homes on my biock
(7100 biock of Grimes Rve. N). Prior to vacating each praperty, there were multipie
calls far service which have NOT contributed to our existing t�acking system.
o We need to rely upon our trust of other communities who have impiemented poficies
and procedures (including but not limited to provisional lieensing for single famify

hames) which wilt benefit aur city through the elimination of some o� the legwork.
o I wil! be an angry citizen if we drag provisional licensing for under 4 unit and single
family provisional licensing as we have done for Paint of Sale, I believe we have now
wasted 10 years on tossing this hot potato around and based on feedback to the
Housing Cammission do not seem any closer tp making an educated decision without
yet more meetings and discussion.

1. Informal Open Forum With City Council 6:45 p.m.
—provides an opportunity for the public to address the Council on items which are not on the
agenda. Open Forum will be limited to 15 minutes, it is not televised, and it may not be used
to make personal attacks, to air personality grievances, to make political endorsements, or
for political campaign purposes. Council Members will not enter into a dialogue with
citizens. Questions from the Council will be for clarification only. Open Forum will not be
used as a time for problem solving or reacting to the comments made but, rather, for hearing
the citizen for informational purposes only.

CALL TO ORDER
The Brooklyn Center City Council met in Study Session called to order by Mayor Tim Willson at
6:00 p.m.
ROLL CALL
Mayor Tim Willson and Councilmembers Kay Lasman, Mary O'Connor, Dan Ryan, and Mark
Yelich. Also present were City Manager Curt Boganey, Public Works Director/City Engineer Todd
Blomstrom, Director of Fiscal Support Services Dan Jordet, Community Development Director
Gary Eitel, and Deputy City Clerk Camille Worley.
CITY COUNCIL DISCUSSION OF AGENDA ITEMS AND QUESTIONS
There was discussion regarding the process of Informal Open Forum and Public Hearings.
City Manager Curt Boganey explained that the Housing and Redevelopment Authority (HRA)
meeting should be held prior to the Regular City Council meeting so that the items involved are
considered in the correct order. It was the majority consensus of the City Council to hold the HRA
meeting after the Invocation, during the Regular City Council meeting.
There was discussion on the dollar amount of delinquent utilities and the effects on the City's cash
flow. Mr. Boganey stated the delinquent bills do affect the City's cash flow; however it does not
create a hardship for the City. There was discussion on the method of reporting delinquent bills to
both the renter and the owner of the property and of those delinquent properties that are rental
properties.
Councilmember O'Connor requested the following change to the Regular Session minutes of August

L.J. Rotman, Attorney representing Sears, discussed the objection from Sears' perspective.
He stated issues such as congestion in the mall, loss of signalization on Bass Lake Road,
segregation of Sears from the Mall, and loss of parking. He stated Sears requests that the
application be tabled
It was the majority consensus of the City Council to sustain this portion of the Regular Session
minutes of August 27, 2007.
Councilmember O'Connor requested the following change to the Study Session minutes of August
27, 2007:

It was the majority consensus of the City Council to sustain this portion of the Study Session minutes
of August 27, 2007.
MISCELLANEOUS
There was discussion on the inclusion of: Miscellaneous on both the Study Session and Work Session
agendas.
There was discussion on the Administrative Fines issue where Mr. Boganey indicated that the matter
would be presented to the City Council after it has been reviewed by the Charter Commission.
DISCUSSION OF WORK SESSION AGENDA ITEMS AS TIME PERMITS
RESOLUTION CALLING FOR CREATION OF A PATH TOWARD LAWFUL
PERMANENT RESIDENT STATUS FOR LIBERIANS COUNCILMEMBER RYAN
Councilmember Ryan discussed the sample Resolution Calling for Creation of a Path Toward Lawful
Permanent Resident Status for Liberians. He discussed the purpose of the resolution and the need for
support. He discussed other City Councils who have passed the resolution and urged the City Council
to support the resolution. He discussed the number of Liberians in Brooklyn Center and Brooklyn
Park. He discussed the potential of additional abandoned homes in Brooklyn Center if the Liberian
residents of Brooklyn Center are deported.
Mayor Willson stated support for the resolution.

Councilmember Yelich stated sympathy for the Liberians, however stated he was uncomfortable with
the City Council taking on topics that are beyond the realm of its responsibility.

Councilmember Lasman moved and Councilmember Yelich seconded to close the Study Session at
6:45 p.m.
Motion passed unanimously.
RECONVENE STUDY SESSION
Councilmember Lasman moved and Councilmember Ryan seconded to reconvene the Study Session
at 6:47 p.m.
Motion passed unanimously.
It was the majority consensus of the City Council to direct staff to prepare a Resolution Calling for
Creation of a Path Toward Lawful Permanent Resident Status for Liberians for consideration at the
next City Council meeting.
BASS LAKE ROAD LANDSCAPE PLAN
Mr. Boganey discussed the history of the Bass Lake Road Landscape Plan and the purpose of such.
He stated concept drawings will be presented tonight and if the City Council is in agreement, a more
detailed plan will be presented in the future.

stops and drivers should use caution. She also reminded drivers to stop when the red lights are
flashing on school buses.
Councilmember Yelich stated he had nothing to report.
Councilmember O'Connor stated she had nothing to report.
Mayor Willson reported attending the retirement party of Fire Chief Ron Boman on September 6,
2007.

Augustus Cole, 5101 63 Ave N, discussed his unemployment that caused the delinquent amount
and stated he could pay a partial amount and requested that the assessment be held until he is able to
pay the total amount.
City Manager Curt Boganey discussed the proper procedure of certification of delinquent utilities.
He explained that Staff is unable to make an arrangement for partial payment.
Councilmember Lasman moved and Councilmember Ryan seconded to close the Public Hearing.

1. RESOLUTION NO. 2007-124 APPROVING A PRELIMINARY TAX
CAPACITY LEVY FOR THE GENERAL FUND AND DEBT SERVICE
FUNDS AND A MARKET VALUE TAX LEVY FOR THE HOUSING AND
REDEVELOPMENT AUTHORITY FOR PROPERTY TAXES PAYABLE IN
2008
Mr. Boganey introduced the item, and discussed the Preliminary Budget and Levy Approval.
There was discussion on the amount of property ta� increase for individual property owners. There
was an opinion expressed that the proposed increase is too high and there should be no property tax
increase.
Councilmember Lasman moved and Councilmember Ryan seconded to adopt RESOLTION NO.
2007-124 Approving a Preliminary Tax Capacity Levy for the General Fund and Debt Service Funds
and a Market Value Tax Levy for the Housing and Redevelopment Authority for Property Taxes
Payable in 2008.
Councilmember O'Connor voted against the same. Motion passed.

THE 2008 FISCAL YEAR

Session called to order by Mayor/President Tim Willson at 8:21 p.m.
ROLL CALL
Mayor/President Tim Willson and Councilmembers/Commissioners Kay Lasman, Mary
O'Connor, Dan Ryan, and Mark Yelich. Also present were City Manager Curt Boganey, and
Deputy City Clerk Camille Worley.
BASS LAKE ROAD LANDSCAPE PLAN
Tim Erkkila and Jon Loidolt, Westwood, discussed the analysis/opportunities of the Bass Lake
Road Landscaping plan. They discussed the trails system and connections to Brooklyn Blvd and
the bridge crossing. They discussed the Xerxes Avenue and Northway Drive Area and
challenges with jay walking. They discussed suggestions for commercial areas such as the
Highway 100 and Logan Avenue North. They discussed recommendations to the City regarding
the landscaping plan in the Brookdale area.
There was discussion of the sustainability of landscaping on the center island with salt spray
during the snow season. Underground irrigation on the center island was discussed.
There was discussion on funding of the Landscape Plan where Mr. Boganey discussed different
approaches of funding including available grant funds that depend on the timing of the
application. Mr. Boganey stated TIF funds are available to be applied to this project. He
discussed the goal to create an aesthetically appealing downtown area.
There was discussion regarding the Brookdale Mall area and the owners view of the plan. Mr.
Loidolt discussed the loss of parking and severing the Brookdale site as possible concerns of the
property owner.
Support for the Bass Lake Road Landscape Plan was expressed by Mayor Willson, and
Councilmembers Lasman, Ryan, and Yelich.

Recommendation:
Public Works staff recommends that the Brooklyn Center City Council conduct a second
consider an ordinance vacatin certain easements within the plat of

BROOKLYN FARM.
Background:
The City Council previously approved the final plat for BROOKLYN FARM 2
ADDITION as part of the process to facilitate construction of the Embassy Suites Hotel
project adjacent to the Earle Brown Heritage Center. As a general housekeeping item, the
proposed ordinance would vacate the underlying dra.inage and utility easements that exist
within the lot that would be conveyed for the hotel. The new plat of BROOKLYN FARM
2''' ADDITION will rededicate all of the areas currently covered with e�cisting easements.
On August 27, 2007 the City Council conducted a first reading of the proposed ordinance.
Staff recommends that the City Council proceed with a public hearing and consideration of
the easement vacation ordinance.
Budget Issues:
The City Economic Development Authority (applicant) is required to pay a cash fee in
the amount of $125 as part of the application process to vacate the easements.

'THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS
FOLLOWS:
Section 1. Utility Easements and Utility Drainage Easements within Lot 1,
Block 1 of the plat BROOKLYN FARM, Hennepin County, Minnesota that were
dedicated with the recording of said plat and designated on said plat are hereby vacated.
Section 2. This ordinance sha11 be effective after adoption and thirty days
following its legal publicadon and after the recording of the plat of BROOKLYN FARM
2�' ADDITION with Hennepin County, Minnesota.
Section 3. Notwithstanding the description provided above, it is the express intent
of the City not to vacate any of the following street, utility, or drainage utilit�
easements: easements dedicated with the recording of BROOKLYN FARM 2
ADDITION approved by City Council Resolution 2007-100; easements dedicated within
Lot 2, Block 1, BROOKLYN FARM, Hennepin County, Minnesota; and any easements

The Planning Commission is composed of a chairperson and six members. There is one vacancy on the
Commission. As outlined in Subdivision 6, Resignations-Removal from Office-Vacancies, of the
Resolution Defining Duties and Responsibilities of the Brooklyn Center Planning Commission, the
following procedures for filling Commission vacancies were followed.
Notice of vacancies on the Commission was posted at City Hall and Community Center and on the City's
web site and aired on Cable Channel 16 beginning August 6, 2007. Announcement was made in the
August 15, 2007, edition of the Brooklyn Center Sun-Post and in the Fall 2007 City Watch resident
newsletter.
A letter was sent to those persons who previously had submitted an application for appointment to a
Brooklyn Center advisory commission infortning them of the vacancy and requesting that they call the
City Clerk if they are interested in applying for the Commission. They were given the choice of either
submitting a new application or having their application previously submitted considered. Notices were
also sent to current advisory commission members.
Copies of the applications received were forwarded to City Council Members on September 14, 2007.

SUBJECT: Resolution calling for the creation of a path toward lawful permanent
status
Recommendation:
It is recommended that the City Council consider adoption of the subject resolution
encouraging the adoption of federal legislation that would extend the time for Temporary
Protected Status for Liberians and create a means for lawful permanent status for these
individuals.
Background:
Upon the request of Councilmember Ryan, this matter was brought to the City Council at
the last work session. The matter was discussed and the majority consensus was to bring
the resolution forward for Council consideration at the next City Council meeting.
Subsequent to this meeting President Bush extended the Temporary Protective Status of
Liberians for 18 additional months until March 31, 2009.
In speaking with Councilmember Ryan he has indicated that he may wish to have the
proposed action held in abeyance at this time.

WHEREAS, the City of Brooklyn Center is home to Liberians who sought safety
in the United States from the brutal armed conflict in their homeland; and
WHEREAS, many of the Liberians living in Brooklyn Center aze lawfully here in
the United States under Temporary Protected Status, which has been afforded to citizens of
Liberia since the outbreak of the conflict in 1991; and
WHEREAS, the Secretary of Homeland Security has announced that, as of
October 1, 2007, Temporary Protected Status for Liberians will terminate; and
WHEREAS, upon the termination of Temporary Protected Sta.tus, Liberians who
have held this status will be subject to deportation from the United States, often without regazd to
the family, properry, or careers they leave behind in the United States; and
WHEREAS, the political and human rights situation in Liberia, although
improved since the time of the civil conflict, remains unclear as the new Liberian government
transitions to democracy; and
WHEREAS, much of the infrastructure of Liberia fias been destroyed as a result
of the conflict, leaving Liberians without running water, electricity, access to basic health caze,
and with a national unemployment ra.te of eighty-five percent; and
WHEREAS, the police and judicial systems in Liberia aze in the eazly stages of
rebuilding following the conflict and the regime of Charles Taylor; and
WHEREAS, Senate File 656, the Liberian Refugee Immigration Fairness Act of
2007, was introduced in the Senate on February 16, 2007; the House companion, the Liberian
Refugee Immigration Protection Act of 2007, H.R. 1941 was introduced on April 19, 2007; and
passage of this legislation would a11ow eligible Liberians living in the United States to apply for
lawful permanent resident status; and
WHEREAS, on July 30, 2007, the House approved H.R. 3123, which grants a
one-yeaz extension of Temporary Protected Status and a Senate File has yet to be introdueed; and

lives, safety, and wetl-being of Liberians living in the City of BrookIyn Center.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota, that the City of Brooklyn Center encourages the Senate to follow
the path set by the House and grant the extension of Temporary Protected Sta.tus until such a
permanent solution is enacted.
BE IT FURTHER RESOLVED that the City Council of the City of $rooklyn
Center urges the Minnesota Federal delegates to prioritize the debate and enactment of
legislation allowing Liberians living in the Uanited States to apply for lawful permanent resident
status.

This is about our conversation last night regazding the addition of a work session item at the September l Oth

I regret that I failed to present this to you at an earlier date. I am concerned about the timing of our council

Trees
Recommendallon:
Public Works staffrecommends that the Brooklyn Center City Council declare a public nuisance and
order the removal of diseased trees as listed on the resolution document.
Background:
The attached resolution represents the official Council action required to expedite removal of the
diseased elm trees most recently marked by the city tree inspector, in accordance with approved
procedures. The City of Brooklyn Center has historically maintained a policy of removing diseased
trees promptly (in three weeks or less) and enforcement of proper disposal in order to keep this
disease from escalating in our community.

The City's share of the cost of removal for diseased trees within the public right-of-way and City
property is included in the 2007 Budget under the Public Works Forestry operating budget. The cost
of removal for diseased trees located on private property is the responsibility of the respective
property owner.
Disease Tree Removal Resolution
Member introduced the following resolution and moved its

RESOLUTION NO.
RESOLUTION DECLARING A PUBLIC NUISANCE AND ORDERING THE
REMOVAL OF DISEASED TREES
WHEREAS, a Notice to Abate Nuisance and Diseased Tree Removal Agreement has been
issued to the owners of certain properties in the City of Brooklyn Center giving the owners twenty
(20) days to remove diseased trees on the owners' property; and
WHEREAS, the City can expedite the removal of these diseased trees by declaring them a
public nuisance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn
Center, Minnesota that:
1. The diseased trees at the following addresses are hereby declared to be a public
nuisance:

removed by the City. All removal costs, including legal, financing, and
administrative charges, shall be specially assessed against the property.
