AN EMERGENCY ORDINANCE EXTENDING
THE MOg TORIUM ON THE SITING OF ADULT ES
TABLISI{MENTS
THE CITY COUNCIL OF THE CITY OF BROOK-
LYN CENTER DOES ORDAIN AS FOLLOWS:
Section 1. Background
1.01. On March 27, 1995, the Citpr Council adopted
Ordinance No. 95 -02 entitled, AN ORDI-
NANCE PLACINGA MORATORIUM ON THE
SITING OF ADULT ESTABLISHMENTS
WITHIN ANY ZONING DISTRICT QF THE
CITY OF BROOKLYN CENTER;, AND DI-
RECTING A STUDY TO BE CONDUCTED,
which ordinance was extended by Ordinance
No. 96 -04.
1.02. The City Council finds that additional time is
needed to complete the study provided ter in Or-
dinance No. 95 -02 and that an extension of said
ordinance is necessary for the purposece of pro
tecting the planning process and the health,
safety and welfare of the citizens of the City and
to ensure that the City and its citizens retain
the benefits of the City's'Comprehensit'e Plan
and Zoning Ordinance until the study is com-
pleted and any modifications to the City's zon-
ing and land use regulations are adopted.
1.03. The City Council has had first reading on an or-
dinance extending the moratorium until March
30, 1997. However, that ordinance will not be-
come effective until after the expiration date of
the moratorium as extended by ordinance No.
96 -04. Therefore, the Council finds that an
emergency exists and that the adoption of this
emergency ordinance is necessary, pursuant to
Section 3.06 of the City Charter.
Section 2. Amendment
Section 6 of the Ordinance No. 95 -02 as end
ed by Ordinance No. 96 -04 is extended ff sixty
(60) days from the adoption of this ordinance.
Section 3. Effective Date
This ordinance shall take effect immediately
upon adoption.
