HomeMy WebLinkAbout1996-08 06-24 CCOCITY OF BROOKLYN CENTER Notice is hereby given that a public hearing will be held on the 24th day of June, 1996, at 7 p.m. or as soon thereafter as the matter may be heard at the City Hall, 6301 Shingle Creek Parkway, to consider an amendment to Chapter 19 of the City Ordinances regarding the abatement of noise. Auxiliary aids for persons with disabilities are available upon request at least 96 hours in advance. Please contact the Personnel Coordinator at 569 -3300 to make arrangements. ORDINANCE NO. 96 -08 AN ORDINANCE AMENDING CHAPTER 19 OF THE CITY ORDINANCES PROVIDING FOR THE ABATEMENT OF NOISE; DELETING SECTION 19 -1203 AND ADDING NEW SECTIONS 19 -1203 AND 19 -1204 THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Chapter 19 of the City Ordinances of the City of Brooklyn Center is hereby amended by deleting section 19 -1203 and adding new sections 19 -1203 and 19 -1204 as follows: Section 19- 1203. RADIOS. TAPE AND DISC PLAYERS. ETC. Subdivision 1. No person shall play. use. or operate on public or private property any radio. tape or disc player. musical instrument. phonograph. or other machine or device for the production or amplification of sound in such a manner. considering the time and place and the purpose for which the sound is produced. as to unreasonably disturb the peace. quiet. or repose of a person or persons of ordinary sensibility. Subdivision 2. The play. use. or operation of any radio. tape or disc player. musical instrument. phonograph. or other machine or device for the production or amplification of sound in such a manner as to be plainly audible at a distance of fifty (50) feet from said machine or device shall be prima facie evidence of a violation of this section. Subdivision 3. When sound violating this section is produced by a machine or device that is located in or on a vehicle. the vehicle's owner is not present. the person in charge of the vehicle at the time is guilty of the violation. Subdivision 4. This section shall not apply to sound produced by the following: a. Amplifying equipment used in connection with activities for which permits have been granted: ORDINANCE NO. 96 -08 b. PENALTY Any person violating the provisions of Sections 19 -1201 through 19 -1203 shall. upon conviction. be punished by a fine of not more than seven hundred dollars ($700) or imprisonment not to exceed ninety (90) days. or both. together with the costs of prosecution. Section 2. This ordinance shall be effective after adoption and upon thirty (30) days following its legal publication. Adopted this 24th day of June 1996.
