AN ORDINANCE AMENDING CHAPTER 7 OF THE CITY ORDINANCES JtEGARDING RECYCLING SERVICES FOR MULTIFAMILY DWELLINGS THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOL- LOWS: Section. 1. Chapter 7 of the City Ordinances of the City of Brooklyn Center is hereby amended to read as follows: Section 7 -113 MULTIFAMILY DWELLINGS. Subdivision 1. Recycling Services. Owners of multifamily dwellings containing more than eight units must provide recycling collection services to all residents of the dwelling. [The recycling collection services provided under this subsection must meet the requirements of applicable county ordinances.] Subdivision 2. Definitions. For purposes of this subsection, the term "multifamily dwelling" has the meaning given in the Brooklyn Center Zoning Ordinance. The term 'recy- clable materials" has the meaning given by Minnesota Statutes. Section 115A:03. subdivision 2 Subdivision 3. [Penalty. Violation of subdivisions 1. 3. 4. or 5 of this subsection is pun- ishable as a'vetty misdemeanor Upon a third or subsequent vinlation of snhdiviaions 1. 4 or 5 by the same owner. the violation is punishable as a misdemeanor. Violation of subdivi- pion 6 of this subsection is punishable as a misdemeanor. Section 2. This ordinance shall be effective after adoption and thirty days following its legal publication.
