Notice is hereby given that a public hearing will be held on the
12th day of April, 1993 at 7:15 p.m. at the City Hall, 6301
Shingle Creek Parkway, to consider an amendment to the Zoning
Ordinance regarding zoning regulation compliance.
Auxiliary aids for persons with disabilities are available upon
request at least 96 hours in advance. Please contact the

93 -04
AN ORDINANCE AMENDING CHAPTER 35 OF THE CITY
ORDINANCES REGARDING ZONING REGULATION COMPLIANCE
THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS
FOLLOWS:
Section 1. Chapter 35- 413.12 of the City Ordinances
of the City of Brooklyn Center is hereby amended in the
following manner:
Section 35- 413.12. Compliance
None of the permitted uses in either the general
industrial district or the industrial park district,
during the period of their operations, shall fail to
satisfy any of the standards set forth above. The
city manager or designee shall be responsible for
determining compliance with those standards and shall
personally visit any site of alleged noncompliance
Upon making a determination of noncompliance, the city
manager shall order the violator to discontinue the
Process causing the noncompliance. [In determining
compliance with those standards, the majority vote of
the City Council shall be the test of detectability
for vibration, particulate matter, and odor, glare and
heat. Before making this determination, the Council
shall personally observe any alleged noncompliance.]
Prior to the resumption of the process, it shall be
the responsibility of the violator to present to the
city manager such evidence as is necessary to show
compliance. [For noise, odor, smoke and wastes,
determination of compliance shall be by any
independent testing organization satisfactory to all
parties concerned, or if there is failure to agree, by
such testing organizations as may be selected by the
City Council after 10 days notice to the alleged
violator.]
ORDINANCE NO. 93 -04
Section 2. This ordinance shall be effective after
adoption and thirty days following its legal publication.
