RESOLUTION NO. 2007-77
RESOLUTION AUTHORIZING SETTLEMENTS WITH THE
METROPOLITAN COUNCIL ENVIRONMENTAL SERVICES (MCES)
DIVISION AND METRO TRANSIT DIVISION OF THE METROPOLITAN
COUNCIL FOR SANITARY SEWER SERVICES RENDERED

WHEREAS, the Sanitary Sewer Fund for the City of Brooklyn Center was not
billed for discharges from the Joslyn Redevelopment Site for a period of at least six years; and
WHEREAS, MCES has offered to accept a lump sum payment of $580,465 as
full and complete payment for previously unbilled service rendered; and
WHEREAS, the Metro Transit Ruter Garage has been discharging storm water
into the City of Brooklyn Center sanitary sewer system since 1992 without a permit or without
payment for services rendered; and
WHEREAS, all parties wish to resolve these matters of non-payment on amicable
and fair basis.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota, that the City Manager is authorized to make a payment $580,465 as
a lump sum settlement to the MCES for unbilled Joslyn Site discharges and to accept a payment
of $133,499.21 from Metro Transit as full and complete payment for unbilled services rendered
to the Ruter Garage site.

The motion for the adoption of the foregoing resolution was duly seconded by member
Dan Ryan
and upon vote being taken thereon, the following voted in favor thereof:
Tim Willson, Kay la.sman, Mary O'Connor, Dan Ryan, and Mark Yelich;
and the following voted against the same: none;
whereupon said resolution was declared duly passed and adopted.
