RESOLUTION NO. 2007-38
RESOLUTION CERTIFYING SPECIAL ASSESSMENTS FOR DISEASED TREE
REMOVAL COSTS TO THE HENNEPIN COUNTY TAX ROLLS

WHEREAS, the City of Brooklyn Center has caused the removal of trees on certain
properties within the City during 2006 under the authority of Minnesota Statutes, Section 18G.13,
18G.16 and by written agreement with the owners of such property; and
WHEREAS, an assessment roll, a copy of which is attached hereto and made part hereof
by reference, has been prepared by the City Clerk, tabulating those properties where tree removal costs
are to be assessed, together with the amounts proposed to be assessed to each property; and
WHEREAS, pursuant to proper notice duly given as required by law, the Council has met
and heard and passed upon all objections to the proposed assessment for tree removal costs.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn
Center, Minnesota that:
1. The special assessment roll of tree removal costs incurred during the year 2006 is
adopted and certified as Levy No. 16811.
2. The special assessments as adopted and confirmed shall be payable in equal annual
installments with interest thereon at six (6) percent per annum, extending over a
period of five years. The first of the installments shall be payable with ad valorem
taxes in 2008, and shall bear interest on the entire assessment from May 1, 2007
through December 31, 2008. To each subsequent installment when due shall be
added interest for one year on all unpaid installments.
3. The owner of any property so assessed may at any time prior to the certification of
the assessment to the County Auditor pay the whole of the assessment, to the City
Treasurer, without interest, if the entire assessment is paid on or before April 30,
2007. After April 30, 2007, he or she may pay the total special assessment, plus
interest. Interest will accumulate from May 1, 2007, through the date of payment.
Such payment must be made by the close-of-business November 29, 2007, or interest
will be charged through December 31 of the succeeding year. If the owner wishes to
pay off the balance at some point in the future, such payment must be made before
November 15 or interest will be charged through December 31 of the succeeding
year.

4. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the
County Auditor to be extended on the proper tax lists of the county, and such
assessments shall be collected and paid over in the same manner as other municipal
taxes.

The motion for the adoption of the foregoing resolution was duly seconded by member
Mark Yelich
and upon vote being taken thereon, the following voted in favor thereof:
Tim Willson, Kay lasman, Mary O'Connor, and Mark Yelich;
and the following voted against the same: none;
whereupon said resolution was declared duly passed and adopted.
