HomeMy WebLinkAbout1990 07-23 HCM MINUTES OF THE PROCEEDINGS OF THE HOUSING COMMISSION OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA SPECIAL SESSION JULY 23, 1990 CITY HALL CALL TO ORDER The Brooklyn Center housing commission was called to order by Chairman Eoloff at 6:30 p.m. ROLL CALL Chairman Eoloff, Commissioners Robert Torres, Ernie Erickson, Reynold Johnson, Pamela Frantum, Neal Nelson and Barbara Jensen. Commissioner Kalligher was absent and excused from this evenings meeting. Also present were City Council liaison Phil Cohen and Assistant EDA Coordinator Tom Bublitz. APPROVAL OF AGENDA There was a motion by Commissioner Johnson and seconded by Commissioner Erickson to approve the agenda for the special meeting. ADOPTION OF HOUSING IMPLEMENTATION PLAN Mr. Bublitz pointed out that he had prepared a Staff Summary of the major elements of the Housing Implementation Plan and the Maxfield Study and included the summary in the information sent with the notice for this evening's special meeting. He explained the Staff Summary presents material from both documents organized along functional categories of the City's operating departments, such as Ordinance and Code Enforcement, Planning, Zoning, and Land Use, etc. Mr. Bublitz explained additionally, the Staff Summary includes one item not contained in the original Housing Implementation Plan. The item is found on page 4 of the summary, and it addresses a review of an existing provision in the City's zoning ordinance regarding a limit on the number of three- and four bedroom units which can be part of a multi family rental development. He explained this addition to the plan would provide that this issue all review of Planning, Zoning and reviewed as g, 9 be rev art of the over p Land Use related to housing. He explained the specific provision in the existing ordinance places a limit on three- and four bedroom units to a maximum of ten percent of the total units in a multi family development. Councilmember Cohen explained, at the time of the initial passage of the ordinance provision, the need in the community was for one and two bedroom units. He noted the question is now whether the City should consider revising the ordinance provision to allow for 07/23/90 1 more three- and four bedroom units to accommodate families requiring additional living space in a multi- family dwelling. He pointed out that as the number of bedroom units is expanded, the open -space requirements must be expanded accordingly. The history of the ordinance was that at the time of its enactment, the need was for units with fewer bedrooms. He further explained the Fair Housing Act of 1987 stipulates that anything which discriminates against families would require court review. Also, he pointed out, in order to take advantage of the current system of tax credits, developers must have a specific number of three bedroom units. Commission members discussed the Staff Summary of the Housing Implementation Plan and the additional provision recommended by staff contained on page 4 of the Staff Summary. There was a motion by Commissioner Jensen and seconded by Commissioner Johnson to accept the Brooklyn Center Housing Implementation Plan and to include the Staff Summary of the Housing Implementation Plan and Maxfield Study as a key element of the plan, including the additional item regarding the issue of a review of the ordinance provision which limits three- and four bedroom units to a maximum of ten percent of the total units in a multi family development and to recommend to the Brooklyn Center City Council that the Housing Implementation Plan along with the Staff Summary be adopted by the City Council of the City of Brooklyn Center. The motion passed unanimously. Councilmember Cohen commented on the need to continually review the plan and to stay with the document and update it on a regular basis so it does not become outdated. ADJOURNMENT There was a motion by Commissioner Nelson and seconded by Commissioner Erickson to adjourn the meeting. The motion passed.
