HomeMy WebLinkAbout2006-038 CCRMember Kay Lasman introduced the following resolution and moved its adoption: RESOLUTION NO. 2006-38 RESOLUTION CERTIFYING SPECIAL ASSESSMENTS FOR IMPROVEMENT PROJECT NOS. 2006-05, HUMBOLDT AVENUE AND EARLE BROWN DRIVE STREET IMPROVEMENTS TO THE HENNEPIN COUNTY TAX ROLLS WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed Special Assessment Levy Nos. 16574 and 16575; and WHEREAS, special assessment rolls, copies of which are attached hereto and part hereof by reference, have been prepared by the City Clerk, tabulating those properties where street improvement costs are to be assessed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota that: 1. Special assessments, Special Assessment Levy No. 16574 and Special Assessment Levy No. 16575 for street improvements, made a part hereof, are hereby accepted and shall constitute the special assessments against the lands named therein, and each tract of land therein included is hereby found to be benefited by the improvement in the amount of the assessments levied against said properties. 2. Such assessments shall be payable in equal annual installments extending over a period of ten (10) years as indicated on the assessment roll. The first of the installments shall be payable with ad valorem taxes in 2007, and shall bear interest on the entire assessment at the rate of five and one half (5.5) percent per annum from October 1, 2006 through December 31, 2007. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may at any time prior to the certification of the assessment to the County Auditor pay the whole of the assessment, to the City Treasurer, without interest, if the entire assessment is paid on or before September 30, 2006. After September 30, 2006, he or she may pay the total assessment, plus interest. Interest will accumulate from October 1, 2006 through the date of payment. Such payment must be made by the close-of-business November 29, 2006, or interest will be charged through December 31 of the succeeding year. If the owner wishes to pay off the balance at some point in the future, such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year RESOLUTION NO. 2006-38 4. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the proper tax lists of the county, and such assessments shall be collected and paid over in the same manner as other municipal taxes.
