ORDINANCE NO. 02 AN ORDINANCE AMENDING CHAPTER 35 OF THE CITY ORDINANCES RELATING TO RESIDENTIAL FACILITIES THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Chapter 35 of the City Ordinances is hereby amended in the following manner: Section 35 -310, ONE FAMILY RESIDENCE DISTRICT 1. Permitted Uses c. Licensed residential proarams with a licensed capacity of six or fewer persons reauired to be permitted by M.S. 245A.11, Subd. 2 and M.S. 462.357. Subd. 7. d. Licensed nonresidential oroarams with a licensed capacity of 12 or fewer persons reauired to be permitted by M.S. 245A.14, Subd. 1. e. Licensed day care facilitv serving 12 or fewer persons reauired to be permitted by M.S. 462.357, Subd. 7. f. Group familv day care facilitv licensed under Minnesota Rules. parts 9502.0315 to 9502.0445, to serve 14 or fewer children reauired to be permitted by M.S. 245.14. Subd. 1 and M.S. 462.357, Subd. 7. Section 35 -311. R2 TWO FAMILY RESIDENCE DISTRICT 1. Permitted Uses c. Section 35 -322. C2 COMMERCE DISTRICT. 1. Permitted Uses f. The following medical and health uses: 4. Section 35 -900. DEFINITIONS. The language set forth in the text of this zoning ordinance shall be interpreted in accordance with the following definition. Words used in the present tense shall include the future; words used in the singular include the plural and the plural includes the singular. Dwellina, Attached (Apartment. Condominium. Cooperative, Townhouse or Duplex) A dwellina joined to one or more other dwellings by party wall or walls. Dwelling, Detached A dwellina entirelv surrounded by open space. Hospital An institution licensed by the state Department of Health primarily enaaaed in orovidina, by or under the supervision of phvsicians, to inpatients (A) diaanostic services and therapeutic services for medical diagnosis, treatment. and care of iniured, disabled or sick persons. or (B) rehabilitation services for the rehabilitation of inured, disabled. or sick persons. ORDINANCE NO. 92 Nursina Care Home. Rest Home, or Convalescent Home A facilitv which provides for the accommodation of persons who are not acutely ill and not in need of hospital care. but who do reauire nursina care and related medical services. Examples of nursing care include: bedside care and rehabilitative nursina techniques, administration of medicines, a modified diet reaime. irriaations and catheterization, aublication of dressinas or bandaaes and other treatments prescribed by a Dhvsician. In addition. the social. reliaious. education and recreational needs of these patients may be fulfilled. Proaram. Nonresidential shall have the meanina aiven it in M.S. 245A.02. Subd. 10. Proaram. (Rest Home (Nursing Home) A private home for the care of children, of the aged or infirm or a place of rest for those suffering bodily disorders. The terms "nursing home" and "rest g Y g home" shall include "nursing homes "boarding care homes child care institutions licensed and regulated by the State Commissioner of Public Welfare, but shall not include maternity care homes or hospitals which are so regulated.] Section 2. This ordinance shall become effective after adoption and upon thirty (30) days following its legal publication.
