HomeMy WebLinkAbout2005-164 CCR1 Member Kathleen Carmody introduced the following resolution and moved its adoption: RESOLUTION NO. 2005-164 RESOLUTION APPROVING THE MEMORANDUM OF UNDERSTANDING FOR LOCAL 49 (PUBLIC WORKS MAINTENANCE) AND THE CITY OF BROOKLYN CENTER FOR THE POST EMPLOYMENT HEALTH CARE SAVINGS PLAN WHEREAS, the City has negotiated in good faith with Local 49 (Public Works) for a Memorandum of Understanding for a Post Employment Health Care Savings Plan; and WHEREAS, attached hereto and incorporated herein by reference as Exhibit "A" is a proposed Memorandum of Understanding. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brooklyn Center approves the attached Memorandum of Understanding with Local 49 (Public Works) effective November 17, 2005 - December 31, 2006 set forth as Exhibit "A" and the Mayor and City Manager are hereby authorized to execute the document on behalf of the City of Brooklyn Center and to enter into such other amendments for Local 49 participants in the City's Post Employment Health Care Savings Plan. November 14, 2005 Date Mayor A ATTEST: City Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Kay Tasman and upon vote being taken thereon, the following voted in favor thereof: Myrna Kragness, Kathleen Carmody, Kay Tasman, Diane Niesen, and Mary O'Connor; and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. RESOLUTION NO. 2005-164 EXHIBIT A MEMORANDUM OF UNDERSTANDING Post Employment Health Care Savings Plan 1 The City of Brooklyn Center and IUOE Local #49 are parties to a labor agreement. The City of Brooklyn Center and IUOE local 49 agree to amend Article 24 of the collective bargaining agreement and add the following language in regards to participating in the ICMA Post Employment Health Care Savings Plan (PEHSCP). ARTICLE 24 - Severance Pay Severance pay in the amount of one-third the accumulated sick leave Employees have to their credit at the time of resignation shall be paid to Employees who have been employed for at least five consecutive years. If discharged for cause, severance pay shall not be allowed. Employees hired after 1/1/1992 and having 25 vears of continuous service at the time of separation, shall be Daid 40% of their accumulated sick leave into the Citv authorized PEHSCP. In the event that the retiree benefit in effect on September 1. 2005 is completely eliminated by the emDlover for emDlovees hired before 1/1/92, the sick leave severance nav for emDlovees hired prior to 1/1/92 and having 25 vears of continuous service will be paid at 40% of their accumulated sick leave into the Citv authorized PEHSCP. If discharged for cause, severance pay shall not be allowed.
