Approval of Agenda and Consent Agenda —The following items are considered to be routine by the Economic Development Authority (EDA) and will be enacted by one motion. There will be no separate discussion of these items unless a Commissioner so requests, in which event the item will be removed from the consent agenda and considered at the end of Commission Consideration Items., a. Approval of Minutes Commissioners not present at meetings will be recorded as abstaining from the vote on the minutes. 1. July 11, 2005 Regular Session 4. Commission Consideration Items a. Resolution Accepting Bid and Awarding Contract for Asbestos Abatement and Hazardous Material Removal at EDA Owned Retail Center Located at 57 and Logan Avenues North -Requested Commission Action: Motion to adopt resolution. 5. Adjournment EDA Agenda Item No. 3a MINUTES OF THE PROCEEDINGS OF THE ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA REGULAR SESSION JULY 11, 2005 CITY HALL COUNCIL CHAMBERS 1. CALL TO ORDER The Brooklyn Center Economic Development Authority (EDA) met in Regular Session and was called to order at 9:18 p.m. by President Myrna Kragness. 2. ROLL CALL President Myrna Kragness and Commissioners Kathleen Carmody, Kay Lasman, Diane Niesen, and Mary O'Connor. Also present were Acting Executive Director Curt Boganey, Public Works Director /City Engineer Todd Blomstrom, City Attorney Charlie LeFevere, and Deputy City Clerk Maria Rosenbaum. 3. APPROVAL OF AGENDA AND CONSENT AGENDA There was a motion by Commissioner Carmody, seconded by Commissioner Lasman to approve the agenda and consent agenda. Motion passed unanimously. 3a. APPROVAL OF MINUTES There was a motion by Commissioner Carmody, seconded by Commissioner Lasman to approve the June 27, 2005, Regular Session minutes. Motion passed unanimously. 4. COMMISSION CONSIDERATION ITEMS 4a. RESOLUTION ACCEPTING QUOTATIONS AND AWARDING CONTRACT FOR ENVIRONMENTAL CONSULTING SERVICES REGARDING ASBESTOS AND HAZARDOUS MATERIALS ASSESSMENT AND REMOVAL AT EDA OWNED SITE AT 57' AND LOGAN AVENUES NORTH Acting Executive Director Curt Boganey discussed that two quotes had been received for consulting services to assist the City with the environmental work that is required for the property at 57 and Logan Avenues North. Legend Technical Services is a company that has provided this service to the City in the past, has done an excellent job, and had submitted the lowest bid. 07/11/05 -1- DRAFT Commissioner O'Connor questioned informal quotations. Mr. Boganey discussed that be believes there were no set specifications, mailings, public notice in the newspaper, or notifications to potential firms and that staff contacted the firms that the City is familiar with and do this type of business and asked them to submit a proposal for this work. She questioned why the quotes were so different. Mr. Boganey discussed it is his belief that when other firms find out that Legend Technical Services is providing a bid, many others do not try to compete. It seems that Legend Technical Services is extremely efficient. She inquired if the price to Legend Technical Services would be $11,000. Mr. Boganey responded that is a not to exceed amount. She inquired about the extra services payment section in the contract and questioned what those services would be. Mr. Boganey responded that it would be something that was not anticipated and if some work was required that was not anticipated in the proposal that is how the work would be covered. RESOLUTION NO. 2005-12 Commissioner Lasman introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING QUOTATIONS AND AWARDING CONTRACT FOR ENVIRONMENTAL CONSULTING SERVICES REGARDING ASBESTOS AND HAZARDOUS MATERIALS ASSESSMENT AND REMOVAL AT EDA OWNED SITE AT 57 AND LOGAN AVENUES NORTH The motion for the adoption of the foregoing resolution was duly seconded by Commissioner Carmody. Motion passed unanimously. 5. ADJOURNMENT A motion by Commissioner Niesen, seconded by Commissioner Lasman to adjourn the meeting at 9:22 p.m. Motion passed unanimously. McCauley, City Manager FROM: Tom Bublitz, Community Development Specialist DATE: August 17, 2005 SUBJECT: Resolution Accepting Bid and Awarding Contract for Asbestos Abatement and Hazardous Material Removal at EDA Owned Retail Center Located at 57 and Logan Avenues North Bids were opened on August 16, 2005 for asbestos abatement and hazardous materials removal at the EDA owned retail center located at 57 and Logan Avenues North. Bids were received from three bidders and Mavo Systems, Inc. of Fridley, Minnesota submitted a low bid of $128,750. Legend Technical Services is under contract with the EDA to prepare specifications and perform project management on the abatement and hazardous material removal. Legend also assisted staff with the pre -bid site visit for potential bidders. It should be noted that nine abatement companies attended the pre -bid walk through of the site and all nine obtained copies of the bid documents. The representative from Legend Technical Services, Inc. indicated that several of the companies not submitting bids explained to him they believed the job was too large relative to their workforce and that they could not complete it within the required time schedule. The Legend representative also indicated Mavo Systems, Inc. is an excellent company and that their bid is a reasonable bid considering the quantity of asbestos and hazardous material to be removed The specifications require the asbestos abatement and hazardous material removal be completed by September 16, 2005, based on an August 31, 2005 notice to proceed to the contractor. The retail center site contains over 61,000 sq. ft. of Asbestos Containing Material (ACM) consisting, primarily of floor tile and floor tile adhesive. All materials defined as hazardous material must also be removed from the site. Hazardous materials include all items that cannot be disposed of at a demolition landfill. The term hazardous materials as used in this contract is defined by the Minnesota Pollution Control Agency and essentially includes all non building materials. Generally, hazardous materials as defined in this contract include items that would be found in many households including fluorescent bulbs, electrical appliances, household chemicals, mercury containing devices, HVAC units, etc. Staff recommends approval of the resolution accepting bid and awarding contract for asbestos abatement and hazardous material removal at the EDA owned retail enter located at 57 and Logan Avenues North. Commissioner introduced the following resolution and moved its adoption: EDA RESOLUTION NO. RESOLUTION ACCEPTING BID AND AWARDING CONTRACT FOR ASBESTOS ABATEMENT AND HAZARDOUS MATERIAL REMOVAL AT EDA OWNED RETAIL CENTER LOCATED AT 57 LOGAN AVENUES NORTH WHEREAS, pursuant to an advertisement for bids for asbestos abatement and hazardous'materials removal at the EDA owned retail center located at 57 and Logans Avenues North, bids were received, opened and tabulated on August 16, 2005. Said bids were as follows: Bidder Bid Amount Mavo Systems, Inc. 128,750 Vruno and Williams, Inc. $143,070 EnviroTech Remediation Services, Inc. $145,000 WHEREAS, it appears that Mavo Systems, Inc. of Fridley, Minnesota is the lowest responsible bidder. NOW, THEREFORE, BE IT RESOLVED by the Economic Development Authority in and for the City of Brooklyn Center, Minnesota that: 1. The EDA Executive Director is hereby authorized and directed to enter into a contract with Mavo Systems, Inc. of Fridley, Minnesota in the name of the Economic Development Authority in and for the City of Brooklyn Center for Asbestos Abatement and Hazardous Materials removal at the EDA owned retail center located at 57 and Logan Avenues North, according to the asbestos abatement and hazardous material removal specifications 57 and Logan Avenues North retail center prepared by Legend Technical Services, Inc. and on file in the City's Community Development Department. 2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except that the deposit of the successful bidder and the next lowest bidder shall be retained until a contract is signed. .Date President The motion for the adoption of the foregoing resolution was duly seconded by commissioner and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: whereupon said resolution was declared duly passed and adopted.
