HomeMy WebLinkAbout1978-09 05-22 CCO CITY OF BROOKLYN CENTER ORDINANCE NO. 78 -9 AN ORDINANCE AMENDING CHAPTER 3 OF THE CITY ORDINANCES REGARDING CODE REFERENCES, PERMITS, AND PERMIT FEES THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Section 3 -101 of the City Ordinances is hereby amended as follows: Section 3 -101. Adoption of the Minnesota [State] Building Code. The City of Brooklyn Center hereby adopts by reference those [S.B.C.1 State Regulations S.B.C. 101 through S.B.C. 8901 collectively known as the Minnesota [State] Building Code, filed with the Secretary of State and the Commissioner of Administration on January 6, 1972, and subsequent amendments to those regulations duly adopted and filed by the State Department of Administration; three copies of which Code shall be on file and available for inspection in the Office of the City Clerk. Those regulations, combined with the provisions of this Chapter of the City Ordinances shall hereinafter be known as the "Building Code." Section 2. Section 3 -103 (D) of the City Ordinances is hereby amended as follows: (D) Submission of Plans and Specificiations. [With each application for a building permit, and when otherwise required by the Building Official, two sets of plans and specifications bearing appropriate engineering or architectural certifications shall be submitted to the Building Official.] Each application for a Building Permit shall include at least two sets of plans and specifications, in the case of one and two family dwellings and residential accessory buildings; and at least three sets of plans and specifications in the case of all multiple family dwellings and accessory buildings, commercial buildings, industrial buildings, and other non- residential buildings. Building plans and specifications shall bear the certi- fication of a Minnesota Registered architect and /or engineer in the case of all multiple family buildings and non residential buildings, and in all other cases when required by the Building Official. At the discretion of the Building Official, plans and specifications need not be submitted for the following; (1) One -story building[s] additions of Type V conventional wood stud construction with an area not exceeding 600 sq. ft. (2) Group [J1 M Division 1, occupancies of Type V conventional wood stud construction. (3) Minor projects. ORDINANCE NO. 78 -9 Plans and specifications shall be drawn with sufficient clarity and detail to assure total conformity with provisions of the Building Code, as determined by the Building Official. Computations, stress diagrams, and other data sufficient to justify the plan detail shall be submitted when required by the-Building Official. Plans for all new one and two family residential buildings and building additions shall include an accurate dimensioned plot plan showing the size and location of all existing and proposed buildings, and the legal boundaries of the property. An accurate survey of the property certified by a Minnesota Registered Land Surveyor shall be submitted when required by the Building Official. Plans for all other buildings and building additions shall include an accurate dimensioned site plan as approved under the requirements of the Zoning Ordinance. Information, appropriately certified, relative to soil conditions, topography, and the like shall be submitted as required by the Building Official. Each application for a Plumbing System, Electrical System, or Mechanical System Permit shall include detailed plans and specifications when required by the Building Official. Such plans and specifications shall bear the certification of a Minnesota Registered architect and /or engineer when required by the Building Official. Section 3. Sections 3 -103 (G) (1) through 3--103 (G) (4) of the City Ordinances are hereby amdended as follows: (G) Permit Fees. (1) Building Permit Fees. The fee for any Building Permit shall be determined according to the provisions of Section 303 of the edition of the Uniform Building Code, Volume 1, [1970 Edition]`, currently referenced by the Minnesota Building Code. The building valuation referred to therein shall be computed using the up -to -date average construction cost per square foot established from time to time by the State Building Inspector. [The fee charged for a permit for the repair, remodeling, or alteration to any existing building or structure shall be as follows:] [(a) No charge if the estimated cost of all proposed work is $100 or less.] [(b) If the estimated cost for the proposed work is between $100 and $500 the fee shall be $5.1 (c) If the estimated cost for the proposed work is between $500 and $1,000 the fee shall be $1 for each $100 of estimated cost.] [(d) If the estimated cost for the proposed work exceeds $1,000 the fee shall be $10 plus $5 for each $1,000 of estimated cost or a fraction thereof in excess of $1,000.] ORDINANCE NO. 78 -9 (2) Plumbing Permit Fees. Fees for plumbing permits shall be computed on the basis of the number of plumbing fixtures and devices and of the type of system or plumbing work as set forth below. For the purpose of this ordinance a plumbing fixture is defined as a device intended to be connected to the plumbing system, such as any sink, laundry tub, bath tub, wash basin, drinking fountain, floor drain, water closet, water heater or any other such devices. Unit fees shall be as follows: There shall be a minimum permit fee of $10.00. Plumbing fixtures installed $,[31 5 Plumbing fixture opening for future installation 21 4 Catch basin installed [4] 10 Water heater installed [3] 5 Ground run to building [5] 10 [Hydraulic valve] [41 Rainwater leader [4] 5 Installation of water treating or filter device [5] 7 [Fire line] [10] Potable water well drilling 15 Irrigation connection [51 15 Repair or alteration of existing 3% of estimated plumbing or water distribution system cost Fire Suppression Systems Standpipes, 1 -3 floors 15.00' Each additional floor 1.50 Automatic Sprinklers First floor 30.00 Each additional floor 10.00 The fee on any new single family dwelling plumbing system including fixtures, devices, openings, and water piping shall be $30.00. A Plumbing Permit shall be required for gas piping; the permit fees are set forth below. Fees for gas fitting of appliances and heating systems are set forth under Mechanical System Permit Fees (Section 3 -103 (G) (4). ORDINANCE NO. 78-9 Up to 2 -inch diameter pipe $3.50 1 -3 openings Each additional opening 1.50 2 -inch and over diameter pipe 1 -3 openings 10.00 Each additional opening 2.00 (3) Electrical System Permit Fees. Fees shall be calculated and paid according to the following schedule. There shall be a miminum permit fee of $10.00. (a) Services, changes of services, temporary services, additions, alterations or repairs on either primary or secondary services shall be computed separately. In the case of services in excess of 230 volts, the following fee amounts shall be doubled. 0 to and including 60 amp capacity [$4.50] $5.00 61 to and including 100 amp capacity $6.00 101 to and including 200 amp capacity $7.50 For each additional 100 amp capacity or fraction thereof $3.00 (b) The fee for circuits [shall be $4 plus the computed amount,] install ations of, additions to, alterations of or repairs of each circuit or sub feeder shall be computed separately, including circuits fed from sub feeders and including the equipment served, except as provided for in items (c) through (h). In the case of services in excess of 230 volts, the following fee amounts shall be doubled. 0 to and including 30 amp capacity (maximum number of 0 to 30 amp circuits to be paid on is 30 in any one cabinet) $1.50 31 to and including 100 amp capacity $3.00 For each additional 100 amp capacity or fraction thereof $1.00 (c) The fee on any new single family dwelling electrical system, including service, feeders, circuits, fixtures and equipment, shall be $30. ORDINANCE NO. 78 -9 (d) The fee on a new multiple family dwelling building shall be $14 per dwelling unit for the first 20 units and $10 per dwelling unit for the balance of the units. (e) In addition to other fees, all transformers and generators for light, heat, and power shall be computed separately at [$2] 4 per unit plus 001 .25 per KVA up to and including 100 KVA and [05] .25 per KVA for 101 KVA and over. The maximum fee for any transformer or generator in this category shall be $[20] 40. (f) In addition to other fees, all transformers for signs and outline lighting shall be computed at $[2] 6 for the first 500 VA or fraction thereof per unit, plus $.20 for each 100 VA or fraction thereof in excess of 500 VA per unit. (g) In addition to other fees, (except dwellings) remote control, signal circuits, and circuits of less than 50 volts shall be computed at [21 5 per each ten openings or devices of each system plus 50t for each additional ten or fraction thereof. (h) For special inspections or services, or for reinspections of improper work, the Building Official may impose such additional charges as are reasonably related to the cost of providing the service. (4) Mechanical System Permit Fees. Fees shall be paid according to the following schedule: (a) Installation, alteration, reconstruction, or repair of any heating, ventilating, comfort cooling, or refrigeration equipment, shall be computed on the basis of the estimated cost of the proposed work, except as herein provided. Up to and including $500 $5 Over $500 but not over $50,000 [11] 2% of.vel*uation Over $50,000 [1/2] 1y, of valuation (b) [Gas piping] [$5] A Mechanical Permit shall be required for gas pipe fitting for connection to any gas burning device, except as herein provided; the fees are set forth below. Fees for gas piping are additional and are set forth under Plumbing System Permit Fees (Section 3 -103 (G) (2). The appropriate fee for gas water heaters shall be applied to the Plumbing Permit, rather than a Mechanical Permit. ORDINANCE NO. 78 -9 The permit fee for installing each gas stove, range, water heater, process burner, or similar gas burning device not used in connection with a heating system shall be: Input (B.T.U.'s) Not exceeding 99,999 7.00 100,000 199,000 12.00 200,000 399,000 24.00 400,000 599,000 35.00 600,000 999,000 48.00 Over 999,000 use gas burner /heating system fee schedule, below. The permit fee for installing gas burners and fittings, for use in connection with a heating system, shall be: Input (B.T.U.'s) Up to 999,000 use gas appliance /non- heating schedule, above. 1,000,000 2,449,000 80.00 2,500.000- 9,999,000 96.00 10,000,000 49,999,000 140.00 50,000,000 74,999,000 `180.00 75,000,000 and over 240.00 (c) [New installation of a standby gas or fuel oil system] [$25] A Mechanical Permit shall be required for the installation, for the removal, and for the replacement of any in- ground or above ground tanks or vessels and related piping used for the storage of gaseous or liquid fuels or chemicals. Permit fees shall be: Above ground new installation $25 In- ground new installation 35 Above ground removal $15 In- ground removal 25 Replace like tank to existing system $25 (d) It is not intended that permits shall be required for portable heating, ventilating, comfort cooling, or refrigeration equipment, nor for the replacement of any component part or assembly of an appliance which does not alter its original approval and which complies with other applicable requirments of the Building Code. i ORDINANCE NO. 78 -9 Section 4. Section 3 -103 (I) of the City Ordinances is hereby amended as follows: (I) Certificate of Occupancy. No building or structure except those in Groups fA to H inclusive] R -3 and M shall be used or occupied, and no change in the existing occupancy classification of a', building or structure or portion thereof shall be made, unless the Building Official has issued a Certificate of Occupancy therefor. Changes in the character or use of a building shall not be authorized if a new or proposed use is more hazardous in terms of life and fire risk than in the existing use. Upon a determination that a building complies with the provisions of the Building Code, the Building Official shall issue a Certificate of Occupancy in a form of his determination. A temporary Certificate of Occupancy may be issued at the discretion of the Building Official for a particular portion of a building prior to completion of the entire building. ORDINANCE NO. 78 -9 Section 5. This ordinance shall become effective after adoption and upon thirty (30) days following its legal publication.
