RESOLUTION NO. 2004-145
RESOLUTION RELATING TO RENTAL HOUSING LICENSE FOR 5240
DREW AVENUE NORTH
WHEREAS, property located at 5240 Drew Avenue North (the "Subject Property")
has been issued a regular license authorizing the rental of dwelling units; and
WHEREAS, the license for the Subject Property expires on October 31, 2004; and
WHEREAS, Section 12-901, paragraph 2 requires all licenses to be reviewed every
six (6) months after the beginning of the license term to determine license status; and
WHEREAS, under City Code Section 12-913, licensed multiple dwellings with five
(5) or more units that have generated an average of .65 or more police or fire calls per dwelling in a
preceding one year (1) period are eligible only for provisional licenses; and
WHEREAS, the City Manager or the City Manager's designee determined that the
Subject Property had an average of 1.5 police calls per dwelling unit during the period from October
5, 2003 to August 31, 2004; and
WHEREAS, the licensee has requested a hearing on the City Manager's
determination; and
WHEREAS, pursuant to due notice, the City Council has conducted a hearing on
October 25, 2004.
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of
Brooklyn Center that the City Council makes the following findings of fact and order:
FINDINGS OF FACT
1. The Subject Property is licensed for ten (10) dwelling units. During the period from
October 5, 2003 to August 31, 2004, fifteen police calls for service were received.
All of the calls are qualified as counted calls under City Code Section 12-913,
paragraph 1.
2. The City Council has determined that it is reasonable and appropriate to count all 15
calls in determining the eligibility of the licensee for a regular license.
3. The Subject Property therefore generated more than .65 police calls during the
period indicated above.
RESOLUTION NO. 2004-145
ORDER
On the basis of the foregoing, the City Council affirms the decision of the City Manager or the City
Manager's designee and orders that the Subject Property is only eligible for a provisional license
under City Code Section 12-913. The licensee is eligible to apply for a provisional license at this
time.

The motion for the adoption of the foregoing resolution was duly seconded by member
Kathleen Carmody
and upon vote being taken thereon, the following voted in favor thereof:
Myrna Kragness, Kathleen Carmody, Kay Tasman, Diane Niesen, and Bob Peppe;
and the following voted against the same: none ;
whereupon said resolution was declared duly passed and adopted.
