Resolution Approving the Preliminary Budget for the City of Brooklyn Center Housing and Redevelopment Authority Pursuant to Minnesota Statutes Chapter 469 Requested Commission Action: -Motion to adopt resolutions. 5. Adjournment HRA Agenda Item No. 3a MINUTES OF THE PROCEEDINGS OF THE HOUSING AND REDEVELOPMENT AUTHORITY OF THE CITY OF BROOKLYN CENTER 1N THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA SPECIAL SESSION DECEMBER 8, 2003 CITY HALL COUNCIL CHAMBERS 1. CALL TO ORDER The Brooklyn Center Housing and Redevelopment Authority (HRA) met in Special Session and was called to order by Chair Myrna Kragness at 7:00 p.m. 2. ROLL CALL Chair Myrna Kragness, Commissioners Kay Lasman, Diane Niesen, and Bob Peppe. Commissioner Kathleen Carmody was absent and excused. Also present: Executive Director Michael McCauley, Public Works Director/City Engineer Todd Blomstrom, City Attorney Charlie LeFevere, and Deputy City Clerk Maria Rosenbaum. 3. APPROVAL OF MINUTES A motion by Commissioner Lasman, seconded by Commissioner Peppe to approve the minutes from the special session on September 8, 2003. Motion passed unanimously. 4. COMMISSION CONSIDERATION ITEM 4a. HRA 2004 TAX LEVY AND BUDGET 1. RESOLUTION ESTABLISHING A FINAL MARKET VALUE LEVY FOR THE PURPOSE OF DEFRAYING THE COST OF OPERATION, PROVIDING INFORMATIONAL SERVICES AND RELOCATION ASSISTANCE PURSUANT TO THE PROVISIONS OF MINNESOTA STATUTES CHAPTER 469.033 FOR THE CITY OF BROOKLYN CENTER HOUSING AND REDEVELOPMENT AUTHORITY FOR FISCAL YEAR 2004 12/08/03 -1- DRAFT 2. RESOLUTION APPROVING THE FINAL BUDGET FOR THE CITY OF BROOKLYN CENTER HOUSING AND REDEVELOPMENT AUTHORITY PURSUANT TO NIINNESOTA STATUTES CHAPTER 469 Executive Director Michael McCauley discussed these resolutions would approve the HR.A final lPvy and budget for the year 2004 based on the numbers provided from Hennepin County. RESOLUTION NO. 2003-03 Commissioner Lasman introduced the following resolution and moved its adoption: RESOLUTION ESTABLISHING A FINAL MARKET VALUE LEVY FOR THE PURPOSE OF DEFRAYING THE COST OF OPERATION, PROVIDING INFORMATIONAL SERVICES AND RELOCATION ASSISTANCE PURSUANT TO THE PROVISIONS OF MINNESOTA STATUTES CHAPTER 469.033 FOR THE CITY OF BROOKLYN CENTER HOUSING AND REDEVELOPMENT AUTHORITY FOR FISCAL YEAR 2004 The motion for the adoption of the foregoing resolution was duly seconded by Commissioner Niesen. RESOLUTION NO. 2003-04 Commissioner Lasman introduced the following resolution and moved its adoption: RESOLUTION APPROVING THE FINAL BUDGET FOR THE CITY OF BROOKLYN CENTER HOUSING AND REDEVELOPMENT AUTHORITY PURSUANT TO I��INNESOTA STATUTES CHAPTER 469 The motion far the adoption of the foregoing resolution was duly seconded by Commissioner Niesen. Motion passed unanimously. 5. ADJOURNMENT A motion by Commissioner Niesen, seconded by Commissioner Lasman to adjourn the meeting at 7:02 p.m. Motion passed unanimously. Chair 12/08/03 -2- DRAFT I HRA Agenda Item No. 4a I�emorandum Date: 15 March 2004 To: Michael McCauley City Manager From: Daniel Jordet Director of Fiscal Support Servic Re: Statutory Tort Liability Limits Each year the Housing and Redevelopment Authority must decide whether to waive the statutory limitations on tort liability. In the past the HRA has decided not to waive the limitations and purchase additional insurance coverage to protect itself against higher potential tort liability claims. This will save the HRA premium payments for excess coverage not required by state statute. Staff requests consideration of the attached resolution by the HRA at its next regular meeting. Commissioner introduced the following resolution and moved its adoption: HR.A RESOLUTION NO RESOLUTION SELECTING THE NO WAIVER OPTION FOR STATUTORY TORT LIABILITY WHEREAS, the Housing and Redevelopment Authority (HRA) has the option to waive its protection under tort liability limitations as contained in Minnesota Statute; and WHEREAS, the statutory tort limitation is $300,000 per individual and an aggregate of $1,000,000 per incident; and WHEREAS, the HRA is required to make formal declaration of its intent each policy year. NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Authority in and for the City of Brooklyn Center that it chooses not to waive its rights to limited liability under Minnesota State Statutes. �entP .mher 1 ?.�(14 Date Chair The motion for the adoption of the foregoing resolution was duly seconded by commissioner and upon vote being taken thereon, the following voted in favar thereof: and the following voted against the same: whereupon said resolution was declared duly passed and adopted. LMCIT LIABILITI' COVERAGE WAIVER FORM Cities obtaining liability coverage from the League of Minnesota Cities Insurance Trust must decide whether or not to waive the statutory tort liability limits to the e�;tent of the coverage purchased. The decision to waive or not to waive the statutory limits has the following effects: If the city does not waive the statuto�y tort limits, an individual claimant would be able to recover no more than $300,OOO.on any claim to which the statutory tort limits apply. The total which all claimants would be able to recover for a single occurrence to which the statutory tort limits apply would be limited to $1,000,000. These statutory tort limits would apply regardless of whether or not the city purchases the optional excess liability coverage. If the city waives the statuto�y tort limits and does not purchase excess liabiliry coverage, a single claimant could potentially recover up to $1,000,000. on a single occurrence. The total which all claimants would be able to recover for a single occurrence to which the statutory tort limits apply would also be limited to $1,000 regardless of the number of claimants. If the city waives the statutory tort linzits and purchases excess liability coverage, a single claimant could potentially recover an amount up to the limit of the coverage purchased. The total which all claimants would be able to recover for a single occurrence to which the statutory tort limits apply would also be limited to the amount of coverage purchased, regardless of the number of claimants. Claims to which the statutory municipal tort limits do not apply are not affected by this decision. This decision must be made by the city council. Cities purchasing coverage must complete and return this form to LMCIT before the effective date of the coverage. For further information, contact LMCIT. You may also wish to discuss these issues with your city attomey. The City of accepts liability coverage limits of from the League of Minnesota Cities Insurance Trust (LMCIT). Check one: The city DOES NOT WAIVE the monetary limits on municipal tort liability established by Minnesota Statutes 466.04. The city WAIVES the monetary limits on tort liability established by Minnesota Statutes 466.04, to the extent of the limits of the liability coverage obtained from LMCIT. The amount is calculated by determining .0144% of the taxable market value of the City. This calculation is the maximum established in Chapter 469.033, Subdivision 6 of Minnesota Statutes. The final levy may be lower or higher depending on the final value of taxable market value as determined by the county in December. For 2005, it is proposed that 251,295 be levied. This is the full amount allowed under Minnesota Statutes as calculated above. It is an increase of 18,897 or 8.13% over the 2004 amount. All proceeds from this collection are transferred to the Economic Development Authority fund. Member introduced the following resolution and moved its adoption: HR.A RESOLUTION NO. RESOLUTION ESTABLISHING A PRELIMINARY MARKET VALUE LEVY FOR THE PURPOSE OF DEFRAYING THE COST OF OPERATION, PROVIDING INFORMATIONAL SERVICES AND RELOCATION ASSISTANCE PURSUANT TO THE PROVISIONS OF MINNESOTA STATUTES CHAPTER 469.033 FOR THE CITY OF BROOKLYN CENTER HOUSING AND REDEVELOPMENT AUTHORITY FOR FISCAL YEAR 2005 WHEREAS, Minnesota Statutes require that the preliminary property tax levy be provided to the Hennepin County Auditor no later than December 28, 2004, for taxes payable in calendar year 2005. NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Authority of the City of Brooklyn Center, Minnesota that a special tax is hereby levied on all taxable real and personal property within the City of Brooklyn Center at the rate of 0.0144% of the total market value of real and personal property situated within the corporate limits of the City of Brooklyn Center that is not exempted by law.
