RESOLUTION NO. 81-10
RESOLUTION APPROVING THE ACQUISITION BY NEGOTIATION OF CERTAIN
PROPERTY WITHIN THE CITY LIMITS OF BROOKLYN CENTER BY THE HOUSING
AND REDEVELOPMENT AUTHORITY IN AND FOR THE CITY OF BROOKLYN CENTER;
AND AUTHORIZING A LOAN FROM THE GENERAL FUND OF THE HOUSING AND
REDEVELOPMENT AUTHORITY IN AND FOR THE CITY OF BROOKLYN CENTER FOR
THE FUNDING OF SUCH ACQUISITION TO BE REPAID BY THE BROOKLYN CENTER
ALTERNATIVE ELDERLY HOUSING PROJECT TAX INCREMENT DISTRICT IF AND
WHEN SUCH DISTRICT IS CREATED.

WHEREAS, in furtherance of the objectives of the Municipal Housing
and Redevelopment Act, Minnesota Statutes, Section 462.411, et seq., the
Housing and Redevelopment Authority in and for the City of Brooklyn Center
(the "HRA") intends to create a project for the construction of housing for
low and moderate income elderly people, which project will be designated the
Brooklyn Center Elderly Housing Project (hereinafter referred to as the
"Project"), and a tax increment district pursuant to Minnesota Statutes,
Section 273.74, et seq., designated the Brooklyn Center Alternative Elderly
Housing Tax Increment District (hereinafter referred to as the "District"); and
WHEREAS, the Project and the District have not yet been created; and
WHEREAS, the HRA now has an opportunity to acquire by negotiation
at a reasonable price certain real property described in Exhibit A, attached
hereto, which property is included in the site of the Project; and
WHEREAS, the HRA has in its General Fund money sufficient to purchase
the real property described in Exhibit A; and
WHEREAS, pursuant to Minnesota Statutes, Section 462.455, Subdivision
1 (7), the HRA has the power to acquire by negotiation unimproved real property
within its area of operation without the adoption of an urban renewal plan, and
to finance such acquisition by means of tax increment;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the
Housing and Redevelopment Authority in and for the City of Brooklyn Center that:
1. The Executive Director and Staff of the HRA are hereby authorized
to acquire by negotiation the real property described in Exhibit
A; and
2. In order to fund the acquisition of the real property described
in Exhibit A a loan from the HRA's General Fund to the Project
Fund to be repaid by unencumbered tax increment funds generated
by the Project and District is hereby authorized.

taken for state and U. S. highways

The motion for the adoption of the foregoing resolution was duly seconded by
member Gene Lhotka , and upon vote being taken thereon, the following
voted in favor thereof: Dean Nyquist, Tony Kuefler, Bill Fignar, Gene Lhotka,
and Celia Scott;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
