Adjournment EDA Agenda Item No. 3a • MINUTES OF THE PROCEEDINGS OF THE ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA REGULAR SESSION JULY 28, 2003 COUNCIL/COMMISSION CONFERENCE ROOM 1. CALL TO ORDER The Brooklyn Center Economic Development Authority (EDA) met in regular session and was called to order at 9:40 p.m.by President Myrna Kragness. 2. ROLL CALL President Myrna Kragness,Commissioners Kathleen Carmody,Kay Lasman,Diane Niesen,and Bob Peppe. Also present: Executive Director Michael McCauley, Assistant City Manager/Director of Operations Curt Boganey, Fiscal and Support Services Director Doug Sell, and Deputy City Clerk Maria Rosenbaum. • 3. APPROVAL OF AGENDA AND CONSENT AGENDA A motion by Commissioner Lasman, seconded by Commissioner Peppe to approve the agenda and consent agenda. Motion passed unanimously. Commissioner Carmody left the table. 3. APPROVAL OF MINUTES A motion by Commissioner Lasman, seconded by Commissioner Peppe to approve the June 16, 2003, special session and June 23, 2003, regular session minutes. Motion passed unanimously. 4. COMMISSION CONSIDERATION ITEM 4a. POTENTIAL DEVELOPMENT ALONG HIGHWAY 252 AND 69TH AVENUE Executive Director Michael McCauley discussed that this item is a companion item with the City Council agenda item that was approved this evening to approve a letter to the Minnesota Department of Transportation(Mn/DOT)requesting the purchase of excess right-of-way along Highway 252 and 69th Avenue. The EDA is requested to authorize the survey and appraisal for this potential development. • 07/28/03 -1- DRAFT i A motion by Commissioner Lasman, seconded by Commissioner Peppe to authorize survey and • appraisal of access with the Minnesota Department of Transportation right-of-way along Highway 252 and 69th Avenue. McCauley, City Manager FROM: Tom Bublitz, Community Development SpecialijJ J DATE: August 6, 2003 SUBEJCT: Resolution Calling fora Public Hearing Regarding the Sale of Certain EDA Owned Property Located at 5900 Emerson Avenue North and 5912 Camden Avenue North in Brooklyn Center, Minnesota, Pursuant to Minnesota Statutes, Section 469.012, Subdivision 7, and Section 469.029 At its June 23, 2003 meeting, the Brooklyn Center Economic Development Authority(EDA) approved Resolution 2003-06, which authorized staff to seek proposals from qualified builders for the development of owner occupied single family homes on the EDA owned lots located at 5900 Emerson Avenue North and 5912 Camden Avenue North. Resolution 2003-06 approved a set of criteria for submitting proposals on the two lots. A copy of those specifications is included with this memorandum. Based on general inquiries from builders,potential homebuyers and in response to an ad in the City's official newspaper, staff mailed 13 sets of specifications to interested persons and builders. The EDA received four proposals for the two lots. Staff received the four proposals on July 16, 2003. All of the proposals lacked some of the information requested or required clarification of information submitted. A request for supplemental information was faxed on July 30, 2003 to the four individuals submitting proposals and responses were to be received by August 5, 2003. Based on the initial proposals and the supplemental information, the proposals received for 5900 Emerson and 5912 Camden have been evaluated by staff on attached tables for each address and titled"Builder Selection Criteria Evaluation". With regard to the builders' experience, both Twin View Development and Armstrong Construction have built single family homes in Brooklyn Center and have a positive track record with regard to their construction. Exceptional Homes, Inc. has not built any homes in Brooklyn Center,but has built one house as part of the City of Crystal's scattered site redevelopment program. Crystal city staff has indicated they are selling a second lot to Exceptional Homes, Inc. for single family home construction and indicated a positive experience with Exceptional Homes, Inc. MEIK Construction Co., Inc. has not built any single family homes in Brooklyn Center and has indicated they did not possess a residential building contractor license at the time they submitted • their proposal. State law requires that contractors be licensed by the State as residential building contractors before they can legally build a single family home. At the time of the writing of this Page 1 memorandum,MEIK Construction Co., Inc. has not indicated they possess a residential building • contractor license. MEIK Construction Co., Inc.'s proposal is included with the other proposals submitted, however, at the present time they do not meet the requirements as a licensed residential building contractor. Staff contacted the State Department of Commerce to determine if any complaints have been filed against any of the builders submitting proposals. The Department of Commerce showed no complaints against any of the builders except that no information was in the State's information system for MEIK Construction Co., Inc. since they are not a licensed residential contractor. With regard to the proposals submitted and the information reviewed in the attached Builders Selection Criteria Evaluation, Armstrong Construction and Twin View Development have submitted the most complete information in their proposals for both lots. Both Armstrong Construction and Twin View Development have provided manufacturer specifications on the building materials to be used. They both are comparable in terms of the building materials proposed. In terms of design preferences, the "Lot Sales Procedures and Specifications for Construction of New Single Family Homes at 5900 Emerson Avenue North and 5912 Camden Avenue North", indicated a preference for a rambler or a two story home. Armstrong Construction has submitted proposals for ramblers on both lots and Twin View Development has submitted proposals for split level homes on both lots. Based on the proposals meeting the requirements of the "Lot Sales Procedures and Specifications for Construction of New Single Family Homes at 5900 Emerson Avenue North and 5912 Camden Avenue North", Armstrong Construction has submitted the proposal which most closely meets all requirements in the • specifications for both lots. The resolution provided with this memorandum is included for Council consideration and calls for a public hearing on the sale of the lots at 5900 Emerson and 5912 Camden Avenue pursuant to State Statute. The appropriate sections of the resolution have been left blank so the EDA's selection of a builder or builders for the lots could be inserted. It should be noted that proposals were submitted on each lot individually and the EDA can choose one builder for both lots or different builders for each lot depending on how the EDA believes each builder has met the requirements for submitting a proposal pursuant to the "Lot Sale Procedures and Specifications for Construction of New Single Family Homes at 5900 Emerson Avenue North and 5912 Camden Avenue North". RESOLUTION CALLING FOR A PUBLIC HEARING REGARDING THE SALE OF CERTAIN EDA OWNED PROPERTY LOCATED AT 5900 EMERSON AVENUE NORTH AND 5912 CAMDEN AVENUE NORTH IN BROOKLYN CENTER, MINNESOTA, PURSUANT TO MINNESOTA STATUTUES, SECTION 469.012 SUBDIVISION 7 AND SECTION 469.029 WHEREAS, the City of Brooklyn Center Economic Development Authority approved Resolution No. 2003-06 Authorizing the Sale of Economic Development Authority (EDA) Owned Property at 5900 Emerson Avenue North and 5912 Camden Avenue North, and; WHEREAS, the EDA is authorized, pursuant to Minnesota Statutes, Section 469.012, Subdivision 7, within its area of operation and without the adoption of an Urban Renewal Plan, to acquire real property, demolish the buildings and improvements thereon, and sell such property in accordance with Minnesota Statutes Section 469.029, as long as the buildings on such real property are substandard, and; WHEREAS, the EDA has determined that the buildings located on the properties described above were dilapidated and obsolescent and the clearance, thereof, was in the best • interest of the public health and welfare of the City of Brooklyn Center, and; WHEREAS, proposals for development of the properties have been solicited and received from builders pursuant to "City of Brooklyn Center Economic Development Authority Lot Sale Procedures and Specifications for Construction of New Single Family Homes at 5900 Emerson Avenue North and 5912 Camden Avenue North" and the sale of the properties were advertised in the City's official newspaper, and; WHEREAS, the EDA has reviewed the proposals received for construction of new single family homes at the properties, and; WHEREAS, Minnesota Statutes Section 469-029 requires that a public hearing be held regarding the terms and conditions relative to the sale of the property.
