Stat. § 115B.178 that certain actions proposed to be taken by Mn/DOT at the Mn/DOT TH 100 Robbinsdale Property, located at the address referenced above (the Site), will not .constitute conduct associating Mn/DOT with the release or threatened release of hazardous substances, pollutants, or contaminants at the Site for the purpose of Minn. Stat § 115B.03, subd. 3(4) (2002). The Minnesota Pollution Control Agency (MPCA) staff in the Voluntary Investigation and Cleanup (VIC) Unit has reviewed the documents submitted for the Site. The Site is a highway corridor which is known from past studies to have been impacted from a plume of contamination from the Joslyn Manufacturing & Supply Co. Superfund Site (Joslyn). The Joslyn Site is a former wood treating facility. The identified release at the Joslyn Site consists of pentachlorophenol, carcinogenic and non - carcinogenic polynuclear aromatic hydrocarbons, dioxins, and furans in soil and ground water (Identified Release). Based upon a review of the information provided to the MPCA VIC Program, and subject to the conditions set forth in this letter, a determination is hereby made pursuant to Minn. Stat. § 115B.178, subd. 1 that the proposed action (Proposed Action) as described in a letter from Nancy Radle to Gerald Stahnke of the MPCA, dated May 6, 2003 (the Letter) will not associate Mn/DOT with the Identified Release for the purpose of Minn. Stat. § 115B.03, subd. 3(4) (2002). The Proposed Action for which this determination applies is as follows: • Subcut and reconstruction of TH 100 roadways and France Avenue ramps, and reconstruction of utilities, which require temporary ground water dewatering. 520 Lafayette Rd. Ms. Nancy Radle Page 2 August 13, 2003 This determination is made in accordance with Minn. Stat. § I I5B.178, subd. 1, and is subject to the following conditions: 1. The Proposed Actions shall be carried out as described in the Letter and Response Action Plan (RAP) dated May 6, 2003, and RAP Addendum dated July 21, 2003; 2. Mn/DOT shall cooperate with the MPCA, its employees, contractors, and others acting a t the MPCA's direction, in the event that the MPCA takes, or directs others to take, response actions at the Site to address the Identified Release or any other as yet unidentified release or threatened release of a hazardous substance, pollutant, or contaminant, including, but not limited to, granting access to the Site so that response actions can be taken; 3. Mn/DOT shall avoid actions that contribute to the Identified Release or that interfere with response actions required under any MPCA- approved response action plan to address the Identified Release; and 4. In the event that any suspected hazardous substances are encountered during Site activities (i.e., demolition, grading, redevelopment, etc.), Mn/DOT shall notify the MPCA project staff immediately in order to determine appropriate handling, sampling, analysis, and disposal of such wastes. Pursuant to Minn. Stat. § I I5B.178, subd. 1, when INIn/DOT takes the Proposed Action in accordance with the determinations in this letter, subject to the conditions stated herein, the Proposed Action will not associate Mn/DOT with the Identified Release for the purpose of Minn. Stat. § 115B.03, subd. 3(4) (2002). i In addition to the No Association Determination requested_ above, Mn/DOT is also requesting, on behalf of Ames Construction Inc. (Ames) that Ames action of development of the Site in accordance with the MPCA approved RAP and RAP Addendum for the Site will not associate Ames with the Identified Release. Minn. Stat. § 115B.03, subd. 10, provides protection from liability for contractors under certain conditions specified in the statute. In general, when a contractor such as Ames performs development actions at the site of a release or threatened release, such as the Site, the contractor is not responsible for the release or threatened release, if the contractor complies with the terms and conditions of a contingency plan or other conditions approved by the MP CA. i Ms. Nancy Radle Page 3 August 13, 2003 The determination made in this letter applies to Mn/DOT's successors and assigns if the successors and assigns: 1) are not otherwise responsible for the Identified Release at the Site; 2) do not engage in activities with respect to the Identified Release which are substantially different from the activities which Mn/DOT proposes to take as described in the Letter, P � r, and 3) comply with the conditions set forth in this letter. The MPCA Commissioner also reserves the authority to take such actions if the voluntary party does not proceed in the manner described in this letter or if actions taken or omitted by the voluntary party with respect to the Site contribute to any release or threatened release, or create an imminent and substantial danger to public health and welfare. 2. No MPCA Assumption of Liability The MPCA, its Commissioner and staff do not assume any liability for any release, threatened release or other conditions at the Site or for any actions taken or omitted by the voluntary party with regard to the release, threatened release, or other conditions at the Site, whether the actions taken or omitted are in accordance with this letter or otherwise. 3. Letter Based on Current Information All statements, conclusions and representations in this letter are based upon information known to the N2CA Commissioner and staff at the time this letter was issued. The MPCA Commissioner and staff reserve the authority to modify or rescind any such statement, conclusion or representation and to take any appropriate action under his authority if the MPCA Commissioner or staff acquires information after issuance of this letter that provides a basis for such modification or action. i 4. Resident Engineer Minnesota Department of Transportation 2055 North Lilac Drive Golden Valley, MN 55422 RE: Utility Construction De-Watering Dear Ms. Benjamin: As we discussed today, Mn/DOT's request to have an additional discharge of pumping from additional wells to be temporarily located in the Joslyn site vicinity will be placed on a special City Council meeting. That special City Council meeting would occur on Monday, August 18th at 6:00 p.m. in the City Hall Council Chambers. It would greatly assist the City Council in being able to evaluate and understand this proposal to have written materials prepared and supplied to me by Thursday morning, August 14th. This will allow those materials to be included in an agenda packet delivered to the City Council on August 14th. I would suggest that a rough schematic showing where facilities would be located and discharged into the sanitary sewer system/interceptor be prepared to assist in visualizing what would occur. My understanding of the specific proposal is that additional wells would be placed on or near the Joslyn site, under the direction of Barr Engineering. These additional wells would pump a modest amount of additional water from the Joslyn site to ensure that the plume did not migrate as a result of de-watering activities that would be required along Lakebreeze to relocate City utilities that are being relocated by the Minnesota Department of Transportation's contractor as part of the overall Highway 100 project. Other than an additional quantity of water, there would be no change in the nature or type of water discharge that would be entering the City sewer system from the Joslyn site. The amount of water proposed to be pumped should not impact the carrying capacity of the sanitary sewer system. The duration of this activity would be approximately 10 days to two weeks and would be overseen by Barr Engineering to ensure that the de-watering proposed would not impact the plume on the Joslyn site. It would be helpful in evaluating the proposal for Barr Engineering to provide a written explanation of the proposed placement of wells and the hydrology involved to maintain the plume. That is, the de-watering for the actual highway project construction would not be involved in this proposal and is the subject of the proposed PCA permit for discharge into the highway detention ponds.
