HENNEPIN AND THE STATE OF MINNESOTA
STUDY SESSION
AUGUST 25, 2005
CALL TO ORDER
The Planning Commission meeting was called to order by Chair Willson at 7:30 p.m.
ROLL CALL
Chair Tim Willson, Commissioners Graydon Boeck, Rex Newman, Sean Rahn, and Tim Roche
were present. Also present were Secretary to the Planning Commission/Planning and Zoning
Specialist Ronald Warren, and Planning Commission Recording Secretary Rebecca Crass. Eric
Berns and Rachel Lund were absent and excused.
APPROVAL OF MINUTES — AUGUST 11. 2005
There was a motion by Commissioner Roche, seconded by Commissioner Newman,
to approve the minutes of the August 25, 2005 meeting as submitted. The motion passed. Chair
Willson and Boeck abstained as they were not present at the meeting.
CHAIR' S -EXPLANATION
Chair Willson explained the Planning Commission's role as an advisory body. One of the
Commission's functions is to hold public hearings. In the matters concerned in these hearings,
the Commission makes recommendations to the City Council. The City Council makes all final
decisions in these matters.
APPLICATION NO. 2005 -011 — APPLE AMERICAN LIMITED PARTNERSHIP OF
MINNESOTA
Chair Willson introduced Application No. 2005 -011, a request for preliminary registered land
survey approval to create a separate tract of land for the Applebee's restaurant site at Brookdale
Shopping Center.
Mr. Warren presented the staff report describing the location of the property and the proposal.
(See Planning Commission Information Sheet dated 8 -25 -05 for Application No. 205 -011,
attached.) The property under consideration is Tract A, RLS No. 1710, which is a portion of the
Brookdale Shopping Center that contains what is known as the Brookdale Center common area.
The new tract of land would be carved out of Tract A, RLS 1710, to create a parcel that would
reflect the building location for the Applebee s Restaurant. The property is zoned PUD /C -2
(Planned Unit Development/Commerce) and is also located in the Central Commerce (CC)
Overlay District. The Brookdale Shopping Center is subject to the PUD agreement
comprehended and approved under City Council Resolution No. 99 -37 on March 8, 1999.
PUBLIC HEARING — APPLICATION NO. 2005 -011
There was a motion by Commissioner Boeck, seconded by Commissioner Roche, to open the
public hearing on Application No. 2005 -011, at 7:47 p.m.. The motion passed unanimously.
Chair Willson called for comments from the public.
Mr. J J Quam and Ms. Bonnie O'Malley, Fredrickson & Byron Law Firm, 200 South 6 ffi Street,
Minneapolis, introduced themselves as representing the applicant.
Ms. O'Malley responded to questions raised by the Commission regarding parking spaces on the
parcel being created under the RLS. She explained that the new RLS created a rectangular
shaped parcel that encompasses some parking spaces at the northwest and southwest sides of the
building. Other spaces are gained by a cross access parking agreement. No new parking spaces
will be created with this application. The new parcel would still be owned by Brookdale and
leased by Applebee's.
No other persons from the public appeared before the Commission during the public hearing on
Application No. 2005 -011.
CLOSE PUBLIC HEARING
There was a motion by Commissioner Newman, seconded by Commissioner Rahn, to close the
public hearing on Application No. 2005 -011, at 7:52 p.m. The motion passed unanimously.
The Chair called for further discussion or questions from the Commissioners. The
Commissioners interposed no objections to approval of the Application.
ACTION TO RECOMMEND APPROVAL OF APPLICATION NO. 2005-011 APPLE
AMERICAN LIMITED PARTNERSHIP OF MINNESOTA
There was a motion by Commissioner Boeck, seconded by Commissioner Newman, to
recommend to the City Council that it approve Application No. 2005 -011, submitted by Apple
American Limited Partnership of Minnesota a request for preliminary registered land survey
approval to create a separate tract of land for the Applebee's restaurant site at Brookdale
Shopping Center subject to the following conditions:
1. The final RLS is subject to review and approval by the City Engineer.
2. The final RLS is subject to the provisions of Chapter 15 of the city ordinances.
3. Approval of the RLS does not create separate development rights for the newly
created tract of land other than that authorized for Brookdale in its entirety.
Voting in favor: Chair Willson, Commissioners Boeck, , Newman, Rahn, and Roche. The
motion passed unanimously.
The Council will consider the application at its September 12, 2005 meeting. The applicant must
be present. Major changes to the application as reviewed by the Planning Commission will
require that the application be returned to the Commission for reconsideration.
OTHER BUSINESS
Ron Warren announced that the September 15, 2005 Planning Commission was canceled.
There was no other business.
ADJOURNMENT
There was a motion by Commissioner Boeck, seconded by Commissioner Newman, to adjourn
the Planning Commission meeting. The motion passed unanimously. The meeting adjourned at
7:59 p.m.
