HomeMy WebLinkAbout1974-04 01-21 CCO CITY OF BROOKLYN CENTER ORDINANCE NO. 74 -4 • AN ORDINANCE AMENDING CHAPTER 2 OF THE CITY ORDINANCES THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section l: Chapter 2 of the City Ordinances is hereby amended by the repeal of the following: [Section 2 -201. CUSTODY OF UNCLAIMED MOTOR VEHICLES. The City Manager shall establish administrative provisions for receiving and storing unclaimed motor vehicles coming into the possession of the City of Brooklyn Center in the course of its municipal operations. He shall mail to the registered owner, if any, as shown on the records of the State Registrar of Motor Vehicles, notice of possession of the motor vehicle and the intent of the City of Brooklyn Center to dispose of said motor vehicle.] (Section 2 -202. CLAIMS BY OWNER. At any time within a period of not less than 30 days after the mailing of notice to the registered owner, if any, said owner may claim his vehicle upon furnishing satisfactory proof of ownership to the City Manager.] [Section 2 -203. PUBLIC SALE OF UNCLAIMED MOTOR VEHICLES. Upon • expiration of a period of not less than 30 days after the mailing of notice to the registered owner, if any, an unclaimed motor vehicle shall be sold to the highest bidder at public sale by the City Manager. The City Manager shall cause one week published notice of the public sale in the official newspaper, said notice announc- ing the date, time and place of the public sale.] 'Section 2 -204. DISPOSITION OF PROCEEDS. Upon completion of public sale of unclaimed motor vehicles, the City Manager shall cause the net proceeds thereof to be deposited in the General Fund of the City. The net proceeds shall be the sale price less any costs of handling, storing, or sale of such unclaimed vehicle.] !Section 2 -205. CLAIM BY FORMER OWNER AFTER PUBLIC SALE. The net proceeds of a respective unclaimed motor vehicle which has been sold at public sale shall be paid to the former owner thereof upon application to the City Clerk and upon furnishing satisfactory proof of ownership within 6 months of the date of respective public sale.] Section 2: Chapter 2 of the City Ordinances is hereby amended by the addition of the following: Section 2 -201. CUSTODY OF ABANDONED AND UNCLAIMED MOTOR VEHICLES The City Manager shall establish administrative provisions for receiving and storing . abandoned and unclaimed motor vehicles coming into the possession of the Citv of Brooklyn Center in the course of its municipal operations. Section 2 -202. RIGHT TO RECLAIM. At any time within 15 days after the date of notice to the owner said o wner may claim h is motor vehicle upon furnishinq �atisfactory proof of owners and upon paymen of all handling_ and storaqe charg L� from takina the vehicle into custodv. . Section 2 -203. IMMEDIATE DTSPOSITION. An unclaimed or abandoned motor vehicle which is more tha seven model years of age, not in operating condition, and which does not disulav a cizrrently valid license plate shall immediately be eligible for sale or disposed of by other means and shall not be subiect to the • notification and reclamation provisions of this ordinance. Section 2 -204. PUBLIC SALE. At any time upon e xpiration of 15 days after mailing of notice to the reaiste_red owner. if any. an unclaimed or abandoned motor vehicle shall be sold at public sale by the City Manaaer followinq published notice thereof. Nothing in this shall be construed to impair any lien of a aaraae keeper or the right of a lien holder to foreclose. Section 2 -205. DISPOSITION OF PROCEEDS. Upon completion of public sale of unclaimed or abandoned motor vehicles. the City Manaaer shall cause the net Proceeds thereof to be deposited in the General Fund of the City. The net proceeds shall be the sale price less any costs of handlina , storing, or sellinq such unclaimed or abandoned vehicle. The net proceeds of a sale shall be paid to the former owner of the vehicle or to the entitled lien holder upon application to the City Clerk and r upon furnishing satisfactory proof of ownership within ninety days of the date of sale . Section 2 -206. DISPOSAL OF VEHICLES NOT SOLD. In the event an unclaimed or abandoned motor vehicle proves unsalable, the City Manaaer may dispose of it pursuant to Section 168B.10 of the Minnesota Statutes. Section 3: This ordinance shall become effective after adoption and thirty (30) days following its legal publication.
