HomeMy WebLinkAbout1972-14 08-14 CCO CITY OF BROOKLYN CENTER ORDINANCE NO. 72-14 AN ORDINANCE REQUIRING FENCING AROUND ALL OUTDOOR SWIMMING POOLS AND PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 19 -1401. SWIMMING POOL DEFINED. For purposes of this ordinance a swimming pool is defined as anv structure, basin, chamber, or tank containing an artificial bodv of water for swimming, diving or recreational bathing and having a depth of more than 24 inches at anv point and a surface area exceeding 150 sa. ft. Section 19 -1402. FENCING REQUIRED AROUND OUTDOOR SWIMMING POOLS. All outdoor swimming pools existing and hereafter constructed shall be completely enclosed by a securitv fence or wall at least 4 ft. high and located at least 4 ft. from the edge of the swimming_ pool on at least 1/2 of the perimeter. All fence openings or Points of entry into the pool area shall be eauiDDed with gates. • All gates shall be eauiooed with self - closinq and self - latchinq devices placed at the too of the gate or in a manner otherwise inaccessible to small children. Anv openings between the fence bottom and the around or other surface shall not exceed 4 inches. EXCEPTION: All above - around outdoor swimming pools that have minimum 4 foot high, vertical or outward- inclined sidewalls; provided sole access is by means of removeable ladder, ramp, or stairs which must be removed when pool is not attended. Section 19 -1403. PENALTY. Anv Person, firm, or corporation violating the Provisions of this ordinance mav, upon conviction thereof, be Punished by a fine of not more than three hundred dollars ($300.00) and by imori.sonment not to exceed ninetv (90) days. Section 2: This ordinance shall become effective and after adoption and thirty days following its legal publication.
