HALE CONSTRUCTION CO. AND DECOSTER DEVELOPMENT CO. THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section l: PREAMBLE. WHEREAS, Planninct Commission Application No. 70016 reauestina Site and Buildina Plan wporova.l for the construction of a Green Stamp Redemption Center ha been presented to the Cit Council: and WHEREAS, the Applicant and the Citv of Brooklyn Center find it mutually beneficial to place certain restrictive covenants on the real estate covered by the Application; and WHEREAS, the Applicant has conveyed, by Deed in Escrow, the real estate covered by the A pplication for a nomi nal consideration - and WHUXA . the public purpos souaht to be accomplished by the Citv of Brooklyn Center throua the conveyance t it of the real estate covere by thp, Application will bP fizlfille b a sale of t he real estate and the retention b thQ City of Brooklyn Center of restrictive covenants set forth herein, It is therefore determined to proceed. consistent with Section 12.05 of the City Charter, as follows: Section 2: That real estate conveyed to the City of Brooklyn Center by Deed and Escrow and described as: Tract A, Registered Land Survev No. 1261. Files of RPaistrar of Titles. County of Hennepin. State of Minnesota, be conveyed in fee simple to Arthur W. Haste Construction Co, and DeCoster Development Co. for a nominal consideration but reserving to the City of Brooklyn Center and its assians the followina covenants and restrictions. to wit: The said parties of the second part (grantees) take and accept this deed to the above - described premise_ s upon the followinct con- ditions and restrictions whir_h shall run with the title to the above described land and shall be bindina upon them, their successors and assictns: Ordinance No. 70 -17 The use of the premises shall be limited to a gift stamp redemption center, parkina for adiacent landowners, and other uses permitted by Section 35 -320 of the zoning ordinan of Broo Center . Minnesota relatina to 'C -1 Service /Office District' in effect as of Tune 1. 1970. This restriction may be enforced by first party (arantor) by iniunction or action for damaaes . but violation shall not work a forfeiture of t itle . Section 3; This ordinance shall become effective after adoption and thirty days following its legal publication. Adopted this 27th day of July 1970.
