HomeMy WebLinkAbout2004-054 CCRMember Kathleen Carmody introduced the following resolution and moved its adoption: RESOLUTION NO. 2004-54 RESOLUTION ORDERING IMPROVEMENTS AND AUTHORIZING DEVELOPMENT OF PLANS AND SPECIFICATIONS FOR IMPROVEMENT PROJECT NO. 2004-06, 73RD AVENUE STREET, STORM DRAINAGE, AND UTILITY IMPROVEMENTS WHEREAS, the Brooklyn Center City Council on March 8, 2004 authorized consideration of street, storm drainage, and utility improvements in the area generally described as "73rd Avenue North"; more specifically described as follows: 73rd Avenue North between Humboldt and Penn Avenues North; and WHEREAS, the Council has previously received and accepted a feasibility report for said proposed improvements, as prepared by the Director of Public Works and the City of Brooklyn Park Engineering Division; and WHEREAS, said improvements are necessary, cost effective and feasible as detailed in the feasibility report; and WHEREAS, the City Council on March 8, 2004 adopted a resolution setting a date for a public hearing regarding the proposed improvements for the 73rd Avenue North area; and WHEREAS, ten days published notice of the hearing was given and the hearing was held on April 12, 2004, at which time all persons desiring to be heard were given the opportunity to be heard thereon; and WHEREAS, the Council has considered all comments, testimony, evidence and reports offered at or prior to the April 12, 2004 hearing; and WHEREAS, the City reasonably expects to spend monies from the Infrastructure Fund on a temporary basis to pay the expenditures described in this resolution; and WHEREAS, the City reasonably expects to reimburse itself for such expenditures from the proceeds of taxable or tax-exempt bonds, the debt service of which is expected to be paid from property taxes, special assessments, or utility fees. The maximum amount of obligations expected to be issued for such project is $ 73,960.00; and r RESOLUTION NO. 2004-54 WHEREAS, the Director of Public Works and the City of Brooklyn Park Engineering Department is prepared to develop plans and specifications for said project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that: 1. Improvement Project No. 2004-06, 73rd Avenue North Street, Storm Drainage, and Utility Improvements, are hereby ordered and the Director of Public Works is authorized to have plans and specifications prepared for said improvement. 2. This resolution is intended to constitute official intent to issue taxable or tax exempt reimbursement bonds for purposes of Treasury Regulation 1.105-2 and any successor law, regulation, or ruling. This resolution shall be modified to the extent required or permitted by Treasury Regulation 1.105-2 or any success law, regulation, or ruling.
