This flooding reduces the owner's use and enjoyment of that portion of property which is periodically flooded; and WHEREAS, it is a regular practice of the City of Brooklyn Center to obtain easements when requiring a right-of-way on private property in order to make a public use of private property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the City Manager is authorized to sign easement documents as prepared by the City Attorney to obtain a 10 year easement to the property at 5700 Camden Avenue, and is further authorized to pay to the owner of record the sum of $8,500 for the acquisition of this temporary easement. The easement shall be duly recorded on the title to the property and can be removed at the request of the owner of record upon termination of the 10 year period or upon completion by the City of the storm drainage improvements necessary to ease the periodic flooding, whichever occurs first.
