RESOLUTION NO. 2002-106
RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
EASEMENT AGREEMENT WITH PROPERTY OWNER AT 5700 CAMDEN
AVENUE
WHEREAS, the City of Brooklyn Center undertook a neighborhood street
improvement project in 1999 on Camden Avenue for the purpose of replacing the street and
improving storm water drainage in the area; and
WHEREAS, the storm water drainage improvements were designed in anticipation of
future street improvements and storm water piping enlargement in the neighborhood area
immediately north of 57th Avenue, and extending on Camden Avenue beyond 57th Avenue; and
WHEREAS, the neighborhood street improvement project for future extension of the
storm drainage pipe will be delayed for the near future due to the need to address more urgently
needed improvements in other street projects; and
WHEREAS, since the completion of the storm drainage improvements on Camden
Avenue, the property owner at 5700 Camden Avenue has experienced flooding of a portion of the
privately owned property during larger storm events. This flooding reduces the owner's use and
enjoyment of that portion of property which is periodically flooded; and
WHEREAS, it is a regular practice of the City of Brooklyn Center to obtain
easements when requiring a right-of-way on private property in order to make a public use of private
property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center that the City Manager is authorized to sign easement documents as prepared by the
City Attorney to obtain a 10 year easement to the property at 5700 Camden Avenue, and is further
authorized to pay to the owner of record the sum of $8,500 for the acquisition of this temporary
easement. The easement shall be duly recorded on the title to the property and can be removed at
the request of the owner of record upon termination of the 10 year period or upon completion by the
City of the storm drainage improvements necessary to ease the periodic flooding, whichever occurs
first.

The motion for the adoption of the foregoing resolution was duly seconded by member
Tim Ricker
and upon vote being taken thereon, the following voted in favor thereof:
-Myrna Kragness, Kay Lasman, Ed Nelson, Bob Peppe, and Tim Ricker;
and the following voted against the same: none;
whereupon said resolution was declared duly passed and adopted.
