ORDINANCE NO. 67-12
AN ORDINANCE AMENDING CHAPTER 29 OF THE CITY
ORDINANCES AND ESTABLISHING RULES AND REGULATIONS
FOR THE CONDUCT OF CITY ELECTIONS
THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS:
Section l: Chapter 29, Section 29 -401 DATE OF ELECTION CHANGED
of the Ordinances of the City of Brooklyn Center are hereby amended
by the deletion of the following:
(Section 29 -401. DATE OF ELECTION CHANGED. Pursuant to the
provisions of Minnesota Statutes Section 205.07 the regular Village
election of the Village of Brooklyn Center shall-hereafter be held
on the first Tuesday after the first Monday in November rather than
on the first Tuesday after the first Monday in December.)
Section 2: Chapter 29 of the City Ordinances is hereby amended
by the addition of the following:
Section 29 -401. FILING FOR MUNICIPAL OFFICE. At least sixteen
(1 6) weeks before the regular election. the Citv Clerk shall cause to
be published in the official newspaper a notice of filing for
municipal office. The notice of filing shall designate the officer
to be elected, the period during which affidavits of candidacy may be
filed, and the time and place for filing such affidavits. Not more than
fourteen (14) weeks nor less than twelve (12) weeks before the regular
municipal election anv person eligible and.desirina to have his name
placed on the official ballot as a candidate for a municipal office
shall file his affidavit of candidacy with the Citv Clerk. The
affidavit shall be substantially the same form as reauired of candidates
for state offices. Upon Davment of a 55.00 filing fee to the Citv
Clerk, the Clerk shall place the name of the candidate on the official
ballot without partisan designation.
Section 29 -402. PRIMARY MUNICIPAL ELECTION. In the event more
than twice the number of persons to be elected to a municipal office
file for the nomination thereof, there shall be a primary election
which shall be held on the first Tuesdav after the second Monday in
September. The number of candidates eaual to twice the number of
Persons to be elected to the municipal office, who receive the highest
number of votes, shall be the nominees for the office named. The City

Clerk shall give at least, fwn ( ?) weeks previous notice of the time
and place of holding such primary election and of the officers to be
elected by posting in at least one (1) public place in each voting
precinct and by one (1) piiblicatinn in the official newspaper, but failure
to give such notice shall not invalidate the election. At least one (1)
week before the election the Citv Clerk shall publish a sample municipal
primary ballot in the official newspaper and he shall post a sample
ballot in his office for public inspection.
Section 29 -403. REGULAR MUNTCIPAL ELECTION. The regular municipal
election shall be held on the first Tuesdav after the first Monday in
November. The City Clerk shall give at least two (2) weeks previous
notice of the time and place of holding such regular election and of
the officers to be elected by posting in at least one (1) public place
in each voting precinct and by one (1) publication in the official
newspaper, but failure to give such notice shall not invalidate the
election. At least one (1..) wPPk before any municipal election, the City
Clerk shall publish a sample ballot in the official newspaper and he
shall post a sample ballot in his office for public inspection.
Section 29 -404. POLLING TIMES. The polls at all municipal
elections shall be open from 7:00 A.M. to 8:00 P.M. on the respective
election day.
Section 3: This ordinance shall become effective after adoption
and thirty days following its legal publication.
