OF BAD CHECKS AND PROVIDING A PENALTY
THEREFOR
The Village Council of the Village of Brooklyn Center ordains:
Section 1. Sections 19.601 and 19.602 are hereby added to the
Village ordinances and shall read as follows:
Section 19.601. ISSUANCE OF CHECKS WITHOUT SUFFICIENT FUNDS
PROHIBITED. Every person, firm, or corporation who shall issue
any check, draft, or order upon a bank or other depository for
the payment of money in payment of wages to any laborer or
employee without having sufficient funds in, or credit in, such
bank or other depository for the payment of such check, draft,
or order in full upon its presentation, shall be guilty of a
misdemeanor. Every person, firm, or corporation who shall issue
any check, draft, or order upon a bank or other depository for
the payment of money for any purpose other than in payment of
wages to any laborer or employee without having sufficient funds
in, or credit in, such bank or other depository for the payment of
such check, draft or order in full upon its presentation shall be
guilty of a misdemeanor, unless within ten days after the issuer
shall have received written notice of dishonor by the holder in
due course, he shall deposit with the bank or other depository,
or pay or tender to the party in possession of such check,
draft, or order sufficient money to constitute payment in full.
The provisions of this section shall not apply to a check, draft,
or order dated subsequent to the date of issue.
Section 19.602. PENALTY. Any person convicted of a violation
of Section 19.601 may be sentenced to imprisonment not to exceed
90 days or a fine of not to exceed $100.
Section 2. This ordinance shall take effect from and after its
publication.
