THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN:
1, Section 11 -107 of the Village ordinances is hereby amended
to read as follows:
"Section 11 -107. LICENSING REQUIREMENTS. All licenses
granted hereunder shall be issued subject to the following
conditions, and all other conditions of this ordinance, and
subject to all other ordinances of the Village applicable
thereto;
(a) No license shall be granted to any person under
twenty -one years of age.
(b) No license shall be granted to any person who has
been convicted of a felony, or of violating the national or
state liquor laws e� local ordinance relating to manufacture
or transportation of intoxicating liquors.
(c) No such malt liquor shall be sold, served, or
consumed at or in any theater, picture show or any other
place of public gathering for the purpose of entertainment
or amusement, or at, in or upon any public highway or in any
vehicle upon any public highway, except that such malt liquor
may be sold, served, or consumed in any dance hall or in any
building in which public dancing is carried on or permitted
only after first having obtained written permission from the
Village Council of the Village of Brooklyn Center, State of
Minnesota, to sell, serve or consume such malt liquor in such
dance halls or building in which public dancing is carried on
or permitted.
(d) No "on- sale" license shall be granted for sales in
connection with any business or club where such business or
club has not been in operation at that place for at least six
months immediately preceding such application.
(e) No license shall be granted for sale on any premises
where a licensee has been convicted of a violation of this
ordinance or where any license hereunder has been revoked for
cause for at least one year after the said conviction or
revocation.
(f) No sale of any non - intoxicating malt liquor shall
be made to any person under guardianship, nor to any person
under twenty -one years of age.
(g) No gambling, nor any gambling device prohibited by
law, shall be permitted in any licensed premises.
(h) All licenses granted under this ordinance shall be
issued to the applicant only and shall be issued for the
premises described in the application. Such license shall
not be transferred to another place without the approval
of the licensing authority.
(i) No license shall be granted to any manufacturer of
non - intoxicating malt liquor nor to any one interested in
the control of any such place, and no equipment or fixture
in any licensed place shall be owned in whole or in part by
any such manufacturer.
(j) No "on- sale" license shall be granted within 600 feet
of any public school nor within 600 feet of any church.
(k) Licenses shall be granted only to persons who are
citizens of the United States and to persons of good moral
character.
(1) No license shall be issued to any person who has
a twenty- dollar federal occupational tax receipt unless
such person has a license to sell intoxicating liquor in
accordance with the provisions of Chapter 46, Extra Session
Laws of 1933 -34, and acts amendatory thereof."
2. This ordinance shall be effective from and after its
publication.
