OF THE VILLAGE ORDINANCES AND SUBSTITUTING IN LIEU
THEREOF NEW SECTIONS 3-50 THROUGH 3-507 INCLUSIVE
RELATING TO REGULATION OF PLUMBING WITHIN THE
VILLAGE OF BROOKLYN CENTER
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDA1flS AS FOLLOWS:
1. Section 3-501 through Section 3-510 of the Village ordinances
are hereby repealed.
2. There is hereby adopted new sections 3-501 through 3-507 to
the Village ordinances which shall read as follows:
Section 3-501, TITLE. Sections 3-501 -- through 3 L- 507
of this ordinance shall be known as "The Village of Brooklyn
Center Plumbing Code."
Section 3-502. SCOPE AND APPLICATION OF ORDINANCE.
From and after the effective date of this ordinance no person
shall construct, extend, alter or repair any plumbing work
within the Village of Brooklyn Center unless in compliance with
the provisions of Sections 3-503 through Section 3-507 of this
ordinance, except in buildings belonging to the United States
or to the State of Minnesota. The regulations in this ordinance
include and govern all work done and materials used (1) in
installing plumbing fixtures which serve a special purpose,
whether connected directly or indirectly to any waste line or
stack; (2) in connecting or repairing any system or drainage
whereby foul, waste or surplus water, sewage or other fluid is
discharged or proposed to be discharged through a pipe or pipes
from any building,, premises, or establishment into any public
or building sewer, drain,, sump cesspool, or other receptacle,
or into any natural or artificial water-course flowing through
public or private property; (3) in ventilating any building sewer,
or any fixture or appurtenance connected therewith.
Section 3-503, ADOPTION OF PLUMBING ORDINANCE 'OF THE CITY
OF MINNEAPOLIS. There is hereby adopted and incorporated into this
ordinance by reference thereto, by marking three copies thereof as
"official copies" and filing them for reference and inspection in
the office of the Village Clerk, all of that certain ordinance of
the City of Minneapolis adopted by the City Council of said City,,
entitled "An Ordinance to regulate the construction, extension,
alteration and repairing of plumbing work and repealing certain
ordinance provisions," as amended, and now in effect, and
containing Sections 1 through 25 inclusive, and designated
in the City of Minneapolis Ordinance Compilation as 1:3
through 1:3-20; provided however, that the following
numbered sections of said ordinance are not hereby adopted
or incorporated into this ordinance: Section 2; Subdivisions
(4), (5) and (6) of Section 2.2; and Sections3 21, 24, and
25; and provided further, that wherever the term "City of
Minneapolis" shall appear in said ordinance it shall be
construed to mean "Village of Brooklyn Center" wherever the
term "Department of Building" appears it shall be construed
to mean the "Department of Building of the Village of Brooklyn
Center". and wherever the term "Plumbing Inspector" is used
it shall be construed to mean the "Plumbing Inspector of the
Village of Brooklyn Center", and the term "Minneapolis Plumbing
Ordinance" as used therein shall be construed to mean "Village
of Brooklyn Center Plumbing Code."
Section 3-504. PLUMBING WATER AND SEWER INSPECTOR.
There is hereby created the office of Plumbing, Sewer and Water
Inspector. The person chosen to fill the office of Plumbing,
Sewer and Water Inspector shall be acquainted with the laws of
Minnesota and the ordinances of the Village of Brooklyn Center
and shall be familiar with the materials and workmanship
requi3NI for the proper installation of plumbing, water and sewage
facilities and shall also hold a State Journeyman or Master
Plumber's License, The Plumbing, Sewer and Water Inspector is
charged with the enforcement of this ordinance and of other
applicable laws and to this end shall inspect all work performed
on plumbing,, sewer and water installations.
Section 3-,05- INSPECTION, The Inspector shall make a thorougi
inspection of the installation in buildings of the piping., traps,
and fixtures of a plumbing system to insure compliance with all the
requirements of this ordinance. When any plumbing installation is
found to be in violation of this ordinance, the Inspector shall
notify the person, firm or corporation owning, using or installing
the same, in writing. Any person, firm, or corporation failing
or refusing to make the necessary repairs or changes and to have
such work completed within 48 hours or any longer period which may
be fixed by the Plumbing, Sewer and Water Inspector in such
written notice after the receipt of such notice shall be deemed in
violation of this ordinance.
Section 3-506. CERTIFICATE OF INSPECTION. Upon the completion
of any plumbing installation it shall be the duty of the person, firm,
or corporation doing the same to notify the Inspector who shall
inspect the installation within a reasonable time after such notice
is given, and if the plumbing installation is found to be fully in
compliance with this ordinance, he shall issue a certificate of
inspection*
Section 3 -�07. LSCEISE MUMED. No person, firm, or
corporation shall engage in the business of installing, altering,
extending, repairing, or maintaining any plumbing work or house
drainage or connecting any plumbing installation within the
Village of Brooklyn Center, unless they shall be licensed by the
Village Council which license shall be granted to any applicant
therefor on compliance with the following;
(a) Licenses shall be issued only to individuals or
contractors licensed as master plumbers by the Minnesota State
Board of Health. Anyone not so licensed may do plumbing work which
complies with the provisions of the minimum standards herein
prescribed on premises or that part of premises owned and actually
oupied by him as his homestead if he shall file with the
Zn pector an affidavit showing that -he performed the actual work
himself in such homestead. No journeyman shall install plumbing
as herein defined unless he is authorized to do so under the
State Plumbing Code.
(b) The applicant shall pay a Twenty -five ($25.00) Dollar
license fee and Fifteen ($15.00) Dollars for renewal /thereafter,
and the license shall run from May 1 to April 30 of the following
year.
(c) The applicant shall furnish a surety bond of $2,000.00
to the Village of Brooklyn Center covering applicant's work in
connection with the Village water system; and a surety bond of
$2,000.00 covering applicant's work in connection with the sewer
system of the Village of Brooklyn Center.
(d) No license shall be issued unless and until the - applicant
shall first file with the Village Clerk a policy or policies of
insurance insuring such applicant against liability imposed by
law on account of damage to or destruction of property in the amount
of $25,000. Any such policy shall provide that it may not be
cancelled by the insurer except upon notice to the Village of
Brooklyn Center. In case of cancellation of such insurance such
license shall be suspended automatically until such insurance has
been replaced,
3. This ordinance shall take effect from and after its publication.
