HomeMy WebLinkAbout1956-03 01-25 CCO 3 • AN ORDINANCE PROVIDING FOR THE INSPECTION AND REMOVAL OF HAZ- ARDOUS FIRE CONDITIONS AND PROVIDING A PENALTY FOR VIOLATION THEREOF. THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS: Section 5-201* ADOPTION OF FIRE PREVENTION CODE. There is hereby adopted by the Village of Brooklyn Center for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code known as the Fire Prevention Code recommended by the National Board of Fire Underwriters, being particularly the 1953 edi- tion thereof and the whole thereof together with the 1954 amendments thereto, save and except such portions as are inconsistent with other Village ordi- nances, of which code not less than three (3) copies have been and now are filed in the office of the Clerk of the Village of Brooklyn Center and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the Village of • Brooklyn Center. Section 5-202. ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE PRE- VENTION. 1. The Fire Prevention Code shall be enforced by the Bureau of Fire Prevention in the Fire Department of the Village of Brooklyn Center which is hereby established and which shall be operated under the super- vision of the Chief of the Fire Department. 2. The Fire Marshal shall be in charge of the Bureau of Fire Pre- vention. 3. The Chief of the Fire Department may detail such members of the fire department as inspectors as shall from time to time be necessary. The Chief of the Fire Department shall recommend to the Village Council the • employment of technical inspectors, who., when such authorization is made., shall be selected through an examination to determine their fitness for the position. The examination shall be open to members and non-members of the fire department., and appointments made after examination shall be for an indefinite term with removal only for cause. Section 5-203- MODIFICATIONS. The Fire Marshal shall have power to modify any of the provisions of the Fire Prevention Code upon application in writing by the owner or lessee or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code., provided that the spirit of the code shall be observed, public safety secured, and substantial justice done. The particulars of such modi- fication when granted or allowed and the decision of the Fire Marshal there- on shall be entered upon the records of the department and a signed copy shall be furnished the applicant. I • Section 5-204. NEW MATERIALS., PROCESSES OR OCCUPANCIES WHICH MAY 4 REQUIRE PERMITS. The Village Council, the Chief of the Fire Department and the Fire Marshal shall act as a committee to determine and specify., after giving affected persons an opportunity to be heard, any new materials., pro- cesses or occupancies., which shall require permits, in addition to those now enumerated in said code. The Fire Marshal shall post such list in a con- spicuous place in his office, and distribute copies thereof to interested persons. Section 5-205- RIOT OF INSPECTION, The Chief of the Brooklyn Center Fire Department or any member of the Fire Department designated by him as an inspector, or the Fire Marshal,, may at reasonable hours, enter any building or premises for the purpose of making any inspection which he deems necessary to be made. Section 5-206. INSPECTOR'S DUTIES, Whenever any such officer or inspector shall find in any building or upon any premises or other place (a) combustible or explosive matter or dangerous accumulation of rubbish or unnecessary accumulation of waste paper., boxes, shavings or any • highly flammable mate3tals, and so situated as to endanger property or (b) shall find obstructions from any source whatsoever, including materials, articles or merchandise,, to or on fire escapes,, stairs, corridors or doors, liable to interfere with the operation of the Fire Department, or egress of occupants, in case of fire, or (c) shall find any condition on said premises which is so likely • to cause fire as thereby to seriously endanger property or human life, or (d) shall find at any premises a violation of any ordinance of this Village or law of the State of Minnesota the continuing violation of which creates a fire hazard, then such officer or inspector shall order the same to be removed or the conditions remedied. Section 5-207. DUTY TO CORRECT HAZARDOUS CONDITIONS. Such order shall forthwith be complied with by the owner or occupant of such premises or buildings, subject to appeal within twenty-four hours to the Village Council of the Village of Brooklyn Center, who shall within fifteen days review such order and file its decision thereon, and unless the order is revoked or modi- fied it shall remain in full force and be obeyed by such owner or occupant. Any owner or occupant failing to comply with such order within ten days after said appeal shall have been determined, or if no appeal is taken, then with- in ten days after the service of the said order, shall be liable to a penalty as hereinafter provided. Section 5-208. SERVICE OF INSPECTOR'S ORDER. The service of any such order shall be made upon the occupant of the premises to whom it is directed by either delivering a true copy of same to such occupant personally or by delivering the same to and leaving it with any person in charge of the premises, or in case no such person is found upon the premises by affixing a copy thereof in a conspicuous place on the door to the entrance of the said premises. Whenever it may be necessary to serve such an order upon the owner of the premises, such order may be served either by delivering to and leav- ing with the said person a true copy of said order or, if such owner is absent from the jurisdiction of the officer making the order, by mailing -2- such copy to-the owner's last known post-office address. Section 5-209. NOTICE OF HAZARDOUS CONDITION POSTED ON BUILDINGS. Whenever any building of a public nature,, or which is used for commercial purposes, or for any other purpose other than a private or two family dwell- ing., is found to be unsafe for any reason set out in Section 5-2C4, and the hazard therefrom is so imminent as to place human life in immediate jeopardy,, the inspecting officer shall post or place at the principal entrance of such structure a notice stating that it is in a dangerous condition; and it shall be unlawful for any person to remove such notice without his written per- mission. If the owner or person in charge of such building or structure., when notified, shall fail to place the same in a safe condition or to adopt such emergency measures as shall have been directed within the time speci- fied it shall be unlawful for any person, firm or corporation to occupy or use said building or structure until it has been rendered safe. • Section 5-210. WATER OUTLETS REQUIRED. On all commercial, industrial and other non-residential construction which is supplied with an adequate well there shall be provided a 4-inch outside water fitting with frost-free valves so located as to be easily accessible for connection to fire fighting equipment near to an alley or road. It shall be so constructed that it can be easily operated from the outside at all times. Section 5-211. VIOLATIONS AND PENALTIES, Any person who shall violate this ordinance or the Fire Prevention Code or who shall fail to cm- ply with any order made hereunder shall forfeit and pay a penalty to the Village of Brooklyn Center not to exceed the sum of $50-0 The imposition of a penalty for violation of such order shall not excuse the violation or permit it to continue; such violation shall be remedied within a reasonable time, but each ten days that such violation is permitted to exist shall con- stitute a separate offense. Orders made hereunder may also be enforced by appropriate action • in the District Court.
