AN ORDINANCE TO PROVIDE FOR THE LICENSING AND
REGISTRATION OF BICYCLES AND TO REGULATE THE
OPERATION THEREOF
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS:
Section 23-501. LICENSES REQUIRED. No person shall ride or use a
bicycle upon any public street, highway, boulevard or alley in the Village
of Brooklyn Center unless the bicycle shall be registered and licensed in
the name of the actual owner as herein provided.
Section 23-502. INFORMATION REQUIRED. Every owner of a bicycle
shall register with the Village Clerk his name and address, the name of the
manufacturer of his bicycle, its number, style and general description. The
Village Council can deputize other persons to issue licenses in receipt for
payment of the license fees on behalf of the Clerk.
Section 23-503- FORM OF LICENSE. (a) The Village Clerk shall
maintain at the Village Hall suitable records of registrations under this
• ordinance. on receipt of the license fee herein provided for, he shall
provide a suitable metallic identification plate upon which shall be stamped
suitable distinguishing letters or numbers. The owner shall affix and keep
affixed to the rear of the seat of the bicycle for which the plate is issued,
the original metallic plate, and shall keep such plate clean and visible at
all times. The Village Clerk may in addition,, cause to be imprinted or
stamped on the bicycle a suitable registration number, and it shall be un-
lawful to remove or deface such number.
(b) No bicycle shall be registered which is in unsafe mechanical
condition. The Village Clerk shall have authority., upon the recommendation
of the Juvenile Court of Hennepin County,, to suspend the registration of, and
remove the identification tag from, any bicycle operated contrary to any
state law or village ordinance or operated while in unsafe mechanical condi-
tion, such suspension and removal to continue for a period not to exceed ten
(10) days, provided that such registration shall not be reinstated or such
identification tag be replaced while such bicycle is in unsafe condition.
Such suspension and removal shall be in addition to other penalties provided
hereunder.
Section 23-504. FEE. The biennial license fee is seventy-five (750)
cents,, and shall be,paid on or before the lst day of July in each even numbered
year. Upon change of ownership, the license plate shall be registered in the
name of the new owner upon payment by the new owner of a fee of twenty-five
(250) cents. All receipts from license and transfer applications shall be
remitted by the Village Clerk to the Village Treasurer.
Section 23-505- LOSS OF LICENSE PLATES. Plates shall not be trans-
ferred from one bicycle to another and no person shall attach to any bicycle
a plate which was not issued for such bicycle. Upon the loss of a license
plate, the Village Clerk upon satisfactory evidence of such loss and pay-
ment of a fee of twenty-five (250) cents shall issue an appropriate new
plate. It shall be unlawful for any unauthorized person to remove or de-
stroy a license Plate on a bicycle.
Section 23-506. OPERATION OF BICYCLES. (a) No person shall ride
or propel a bicycle upon any public street, highway, boulevard., sidewalk or
alley except in a careful and prudent manner. A person propelling a bicy-
cle shall not ride other than astride a permanent or regular seat attached
thereto. No bicycle shall be used to carry more persons at one time than
the number for which it is designed or equipped. No person riding upon any
bicycle shall attach the same or himself to any vehicle upon a roadway.
(b) No bicycle shall be ridden upon any public street, highway,
boulevard., sidewalk or alley at a speed faster than is reasonable and proper
under traffic conditions at the time,, and every bicycle shall be operated
with due regard to the safety of the operator and other persons upon the
streets., highways., boulevards, sidewalks, and alleys of the village.
(c) No bicycle shall be operated on any street, highway, boulevard,
sidewalk or alley during any period of time from one-half hour after sunset
to one-half hour before sunrise without a headlight in good working condition.
Such headlight shall display a white light of sufficient illuminating power
under normal atmospheric conditions to reveal any persons vehicles or sub-
stantial objects fifty (50) feet ahead of headlight which headlight shall
• be firmly attached to said bicycle and properly lighted.. nor shall any bicy-
cle be so operated or parked without an adequate lighted red tail light or
in lieu thereof an adequate reflector attached to and visible from the rear
of such bicycle from a distance of not less than two hundred (200) feet.
(d) No person shall operate a bicycle unless it is equipped with a
bell or other device capable of giving a signal audible for a distance of at
least one hundred (100) feet, except that a bicycle shall not be equipped
with nor shall any persons use upon a bicycle any siren or whistle.
(e) No person shall operate a bicycle upon any public street., high-
way, boulevard,, sidewalk or alley unless the bicycle is in good mechanical
condition and equipped with adequate brakes.
Section 23-507. BICYCLE RENTALS. A rental agency shall not rent or
offer any bicycle for rent unless the bicycle is licensed and a license plate
is attached thereto as provided herein and such bicycle is equipped with the
lamps and other equipment required in this ordinance.
Section 23-508. PENALTY. Any persons who shall violate the provisions
of this ordinance shall, upon conviction thereof, be punished by a fine not to
exceed One Hundred ($100.00) Dollars or ninety (90) days.in the County Jail of
Hennepin County. The Court may also after conviction remove and detain the
license plate from the bicycle owned by the person convicted for a period not
to exceed thirty (30) days or may both remove and detain said plate for a per-
iod not to exceed thirty (30) days and impound said bicycle for a period not
to exceed thirty (30) days.

I Section 23 -509. EFFECTIVE DATE. This ordinance shall take effect
and be in force from and after its publication.
