HomeMy WebLinkAbout1957-16 04-23 CCO CHAPTER 33 - WATERS AND WATERWAYS AN ORDINANCE REGULATING THE OPERATION OF BOATS AND WATERCRAFT The Village Council of the Village of Brooklyn Center do ordain: Section 33 -101. PURPOSE. No person shall navigate, operate, dock or anchor any boat, motorboat, or watercraft upon Twin Lakes, Ryan Lake and Palmer Lake, except in accordance with the provisions of this ordinance, which shall apply only to the operation of boats, motorboats, or watercraft in the above stated lakes. Section 33 -102. LICENSE REQUIRED, No boat, motorboat, or watercraft shall be operated on Twiri Lakes, Ryan Lake or Palmer Lake unless registered and licensed in the name of the actual owner excepting boats used for weed control or other lake improveWR4 ( activities. The license shall carry a description of the boat. Said license/ a obtained at Robbinsdale, Crystal, or Brooklyn Center, or at a central registry so designated by the three villages. Section 33 -103. LICENSE NU'+SER. All licenses issued shall have a number. The license number must be painted, stenciled, or permanently attached on both port side and starboard side of watercraft in letters having a minimum height of 2z" and in a distinguishable color. Section 33 -104. FEE. The license fee shall be $1.00 for a period of one year. The same number shall be issued if license is taken out for the same boat in consecutive years. A copy of the ordinance shall be furnished each applicant at time the license is obtained. Section 33 -105. LENGTH. The overall length of boats, navigating, docked, anchored, or operated on the above stated lakes is not to exceed sixteen feet in length. A special permit is required for any watercraft longer than sixteen feet. Section 33 -106. MUFFLERS REQUIRED. It is unlawful to use a boat propelled in whole or in part by gas, gasoline, or naptha unless the same is provided with a stock factory muffler, unddrwater exhaust or other modern devise capable of adequately muffling the sound of the exhaust of the engine. The phrase "Adequately muffling" shall mean that the motor's exhaust at all times shall be so muffled or suppressed as not to create excessive or unusual noise. The discharge of cooling water through the exhaust of any inboard engine shall be considered an adequate muffling device. Motorboats may be operated with cut- outs or mufflers open while actually competing in any race licensed to be held by the Village Council. Sect ion_.�lZ. SPEED AND OPERATION OF MOTORBOATS. Every operator of a motorboat shall at all times &ivigate the same in a cPr?f'ul. and prudent r manner and at such rate of speed and along a course as not to endanger the life, limb or property of any person. No person shall operate any motorboat at a rate of speed greater than will permit him in the exercise of reasonable care to bring the motorboat to a stop within the assured clear distance ahead. It is unlawful to operate a motorboat in a careless or reckless manner. Reckless navigation of a motorboat shall include operating the same in a manner which unnecessarily interferes with the free and proper use of the navigable waters of the state or unnecessarily endangers other boats therein, or the life and limb of any person. It is unlawful to exceed the speed limit of five miles per hour in going under bridges or through channels. Section 33 -108. OPERATING DISTANCES. No person shall run, operate, navigate or direct any motorboat, boat, or watercraft within seventy -five feet of an area being used by persons fishing, 100 feet of an area being used by persons swimming, 200 feet of an area designated as a public swimming beach, and 150 feet of shoreline except when entering and leaving the la74e. Any areas designated as public swimming beaches shall be clearly marked with buoys. Se tion -10 . TIME No mechanical) powered boat motorboat c 33 9 Y p > > or watercraft shall be operated before sunrise or later than one hour after sunset. Section 33 -110. CHANNEIS. No person shall obstruct any channel and it is unlawful for any person to swim or dive from any bridge which crosses a channel. Section 33 -111. WATER SKIING AND SURFBOARDING. Water skiing is pro- hibited in the primary harbor, which is defined as 150 feet from the shoreline. Water skiing is permitted from the hours of 10 o'clock a.m. to 7:30 p.m. Section 33 -112. OPERATION BY CERTAIN PERSONS PROHIBITED. It shall be unlawful for any person who is under the influence of intoxicating liquor, narcotic drugs or barbituates or any person who is a habitual user of the same to operate, propel or be in actual physical control of any boat. It shall be unlawful for the owner or person having charge of or control of any boat to authorize or knowingly permit the same to be propelled or operated by any person who is under the influence of intoxicating liquor, narcotic drugs or barbituates or any person who is a habitual user of the same. i Section 33 -113. DUTIES OF OPERATOR IN CASE OF ACCIDENT. The operator of any boat involved in an accident resulting in injury or death to any person or damage to property shall immediately stop such boat at the scene of such accident and shall give his name, address, full identification of his boat and the name and address of the owner, to the person struck or the operator or occu- pants of the boat collided with, and shall render to any person injured in such an accident reasonable assistance and shall report such accident to the nearest or most convenient law enforeement agency or office. L r Section 33 -114. OPERATING RULES. When two boats are approaching each other "head on" or nearly so, so as to involve risk of collision, it shall be the duty of each boat to bear to the right and pass the other boat on its left side. When boats approach each other obliquely or at right angles, the boat approaching on the right side has the right of way. One boat may overtake another on either side but must grant right of way to the overtaken boat. Section 33 -115. DEPOSITING REFUSE. It is unlawful for any person to deposit any refuse or waste from any boat or from shore into the lake. Section 33 -116. DOCKS. It is unlawful to have floating docks away from shore before and after the boating hours set forth in Section 33-109.1" is unlawful to have docks on public or private easements. It is unlawful to have docks extending more than 30 feet from shore unless water is less than 2 feet deep at the 30 foot distance. In such case the dock may be extended until water is 2 feet deep at its extremity. Section 33 -117. PENALTIES. Any person who shall violate any provi- sion of this ordinance will upon conviction thereof be fined not more than One Hundred ($100.00) Dollars or imprisoned for not to exceed ninety (90) days for each offense. Section 33 -118. AEFEAL.. The provisions of Chatter 33 of the- - Village Ordinances are hereby repec -led and the provision. -1 of this ordinance shall be hereafter designated as Chapter 33 and the sect - ions hereof numbered as designated. Section 33 -119, EFFECTIVE DATE. This ordinance shall have effect from and after its passage and legal publication.
