AN ORTIVINANCE AMENDING ORDINANCE No. 29 WHICH IS ORDINANCE
RELATING TO DOGc'., REsTRAINT OF DOGS, PROVIDING A TAX THEREON
AND PPEsCRIBING A PENALTY FOR VIOLATION THEREOF."
The Village Council of T'rooklyr Center do ordain as follows:
Section 1. Ordinance Amended. The ordinance No. 29 of the
Village of prooklyn Center, entitled "An Ordinance Relating to
Dogs, Restraint of Dogs, Providing a Tax Thereon and Prescrib-
ing a penalty for violation thereof," passed and adopted on the
10th. day of April, 1943, is hereby amended. with respect to sec..!
tion 1 and 2 only so said sections may read as follows:
"ection la Dog Tax. An annual tax of two Dollars
(82.00) for each dog, male or female, irrespective of age, is
hereby levied upon all persons, firms, or corporations owning,
keeping or 'harboring a dog within the limits of this village
except owners or keepers of dog kennels and as provided below.
The above tax shall not he imposed. on the owner of any dog,
except the owner or keeper of a dog kennel, with respect to any
dog which is restrained by its owner upon said owner's premises
by keeping said dog within an enclosure upon the owner's prem.

”,7.eotion lb. Dog Kennels. It shall be unlawful for
any person, any firm, corporation, or other legal entity to
own or operate any kennel unless a license is secured therefor
and an annual license tax is hereby levied in the amount of
fifteen dollars (15.00) for each kennel, plus two dollars
(82.00) for each dog kept or confined therein in excess of
fifteen. All dogs of whatever age shall be included in such
count.
III Kennel, as used in this ordinance, shall mean any contiguous
place where any person shall keep four or more dogs for a longer
period than twenty-four hours, except as a longer time is here-
inafter provided. Fvery kennel shall be enclosed or fenced in
such manner as to prevent the running at large or escape of dogs
confined therein.
Every kennel shall be operated in a clean, healthful, sani.
tary, safe condition and in a humane manner, and so as not to
create a public nuisance, and failure to do so shall_ constitute
grounds for a revocation of the license of such. kennel, The
decision of the Village Council as to the manner of operation
of any kennel in relation to any of said matters shall be pre.
. sumptive proof thereof.

Any person holding a license to operate a kennel may keep
any dog, for the purpose of training, breeding, treating, or
boarding, for a period of not to exceed seven days without
being subject to the penalty of this ordinance; provided, how-
ever, that the total number of dogs kept at any one time shall
not exceed bY five the number upon which the license tax paid
was computed, included those so kept temporarily.
"Section 2. Payment of Tax. It shall be the duty of each
owner, keeper or harborer of dogs or dog to pay the tax imposed
in Sections la and lb hereof to the Village Recorder for the
general revenue fund of the Village on or before the first day
of January in each and every year thereafter, or upon acquiring
ownership or possession of any dog or upon establishing residence
in the village. The recorder shall cause a notice of the neces-
sity of paying such tax to be printed in an official newspaper
once within thirty (30) days after passage of this ordinance.
"It is further provided that the payment of the tax due within

thirty (30) days after the passage of this ordinance as provided
above, will constitute payment in full of the tax for the calen-
dar years 1943 and 1944, providing that said 1944 dog tag is
secured from the Village Recorder before Feb. 1, 1944, and that
thereafter the above tax due on the 1st day of January of each
and every year commencing the 1st day of January, 1945, will
be a tax for the calendar year commencing on said day."

Section 2. Fffective. This ordinance shall be in
full force and effect from and after, its passage and
publication according to law.
