HomeMy WebLinkAbout1943-01 04-10 CCO ORDINANCE No. 29 1 qq3-oI AN ORDINANCE RELATING TO DOGS, RESTRAINT OF DOGS, PROVIDING A TAX THEREON FOR VIOLATION THEREOF The Village Council of Brooklyn Center do ordain as follows: . SECTION 1. Dog Tax An annual tax of Two dollars ($2.00) for each male dog and three dollars ($3.00) for each female or spayed female dog irrespective of age is hereby levied upon all persons, firms, or corporations, owning, keeping or harboring a dog or dogs within the limits of this village. SECTION 2. PAYMENT OF TAX. It shall be the duty of each owner, keeper or harborer of dog or dogs to pay the tax imposed in Section 1 hereof to the village recorder for the general revenue fund of the village on or before the first day .of January in each and every year thereafter, or upon acquiring ownership or possession of any dog or upon establishing residence in the village. The recorder shall cause a notice of the necessity of paying such a tax to be printed in an official newspaper once within thirty (30) days after passage of this ordinance. SECTION 3. TAGS: Receipt. Upon payment of said tax, the recorder shall execute a duplicate receipt, the original to be given to the taxpayer and retain the duplica *e. He shall also procure a sufficient number of suitable numbered tags and lettered substantially and deliver one appropriate tag to such taxpayer for each dog upon which a tax is paid. SECTION 4. DUTY OF OWNER. It shall be the duty of the person receiving a tag or tags as provided in Section 3 hereof to cause said tag or tags to be affixed by a permanent metal fastener to the collar of the dog upon which the tax is paid in such a manner that said tag may be easily seen by the officers of the village and it shall be the further duty of such taxpayer to see that said tag is constantly worn by such dog. SECTION 5. DUTY OF MARSHAL. Thirty days after the taking effect of this ordinance and on and after the first day of February of each year thereafter, it shall be the duty of the village marshal and each regular and special deputy marshal to take up and impound any dogs found at large in the village without tags provided for in Section 3 hereof. SECTION 6. NOTICE OF IMPOUNDING. Upon taking up and impounding any dog as pro- vided in Section 5, the village marshal shall immediately post in three or more conspicuous places in the village a notice of impounding in substantially the following form: NOTICE OF IMPOUNDED DOGS Dated 19 To Whom It May Concern: I have this day taken up and impounded in the pound of the village at St. a dog answering to the following description: Sex color Breed Approximate Age Name of owner Notice is hereby given that unless the dog is claimed and redeemed on or before o'clock M , on th day of 194..., the same will be killed or sold as prowided by ordinance. Signed Village Marshal I The data of sale or killing of said dog shall be the fifth day after the posting of said notice unless said date falls on a Sunday or holiday, in which case it shall be the following day. SECTION 7. REDEEMING DOGS. Any dog may be redeemed from the pound by the owner of keeper within the time stated in the notice by the payment to the recorder of the tax for the current year with a poundage fee of $1.00 dollar, and 2581 per day for each day said dog is confined in said pound as the cost of feeding. SECTION 8. RETRASE FROM POUND. for dog tax for the current year and upon presenta- t t ion of a receipt for the fees ed La Section 7 thereof, and a current P rovi � license tag, the marshal shall release to any owner or keeper presenting the same dog or dogs claimed by him. SECTION 9. DUPLICATE tags. In case any dog tag is lost, one duplicate may be ' :. issued by the recorder upon presentation of a receipt showing the payment of the tax for the current year. A charge of one dollar ($1.00) shall be made for each duplicate tag. . SECTION 10. COMPENSATION TO ruurculusrrrn. The impounding fee $1.00 dollar for each dog and the 25V per day for feeding that same shall be paid to the pounkeeper monthly as compensation for his services under this ordinance upon presentation L ._ of a proper claim by him audited by the recorder and allowed by the council. Pr 54 SECTION 11. KILLING DOGS: SALE, Any dog which is not claimed aaiPrAvidsd in Section 7 within five days after impounding shall be disposed of by' the pound- keeper, who shall be allowed from the gereral fund 504 for each dog ki led and buried as compensation for his services upon presentation of a proper, aim audit- ed by the recorder and allowed by the council, or if any person othbri the owner desires to purchase such dog the poundkeeper may sell him for ' -less than the amount provided in Section 7 thereof, and all sums received above the costa and tax shall be held by the recorder for the benefit of the owner and if not claimed in one year such funds shall be placed in the general fund of the village. SECTION 12. POUND ESTABLISHED. A village pound is hereby established for the purpose of placing this ordinance in effect. The marshal shall be the poundkeeper and shall attend to the construction and maintenance of such pound, presenting a proper claim to the council monthly for the necessary expenses which he may incur in so doing, which claim shall be audited by the recorder and, if allowed by the council, paid by the treasurer. SECTION 13. FEMALE DOGS. It shall be unlawful for any person, firm, or corporation owning, keeping or harboring any female dogs to allow the same to run at large within the village while in heat and the marshal and his deputies are hereby authorized and directed to take up and impound such female dogs, whereever found, whether licensed or not, and to release said dogs when licensed only upon the order of the village council. SECTION 14, WBEN UNLAWFUL TO HARBOR DOGS. It shall be unlawful to harbor any dog - within the limits of the village upon which the tax for the current year has not been paid, provided, that this section shall not apply to dogs owned by non- residents of the village provided they are not allowed to remain in the village longerthan twenty -four hours, SECTION 15. BrEAKING POUND, It shall be unlawful for any unauthorized person to break open the pound or attempt to do so, or to take or let out any dogs there- from, or to take or attempt to take from any officer any dog taken by him in compliance with this ordinance or in any manner to interfere with or hinder such officer in the discharge of his duty under this ordinance. , SECTION 16, COuslaxi slTING TAGS, It shall be unlawful to counterfeit or attempt to counterfeit the tags provided for in Ssotion 3 of this ordinance or take from any dog a tag legally placed upon it by its owner with the intent to place it on another dog. - SECTION 17. TAGS NOT TRANSFERABLE. Dog tags bhs11 not be transferable and no refunds shall be made on any dog tax paid bssause of leaving the village or death of the dog before the expiration of license period. SECTION 18. MUZZLING PROCLAMATION. The president of the Council is hereby author - ized, and it is hereby made his duty, whenever in his opinion the danger to the public from rabid dogs is imminent, to issue a proclamation ordering all persons, firms, or corporations owning, keeping, or harboring a dog or doge within the Village of Brooklyn Center to Confine the same securely on their premises unless a wire muzzle completely enclosing the.bead of such dog is placed on said dog and kept upon it all the time it is at large, It le hereby made unlawful to violate such proclamation and the marshal is hereby authorized and inatruotsd to ion kill any dog running at large during the time fixed in said proclamation without muzzle, without notice to the owner. SECTION 19. RESTRAINT OF DOGS. The poundkeeper or marshal is hereby authorized and it is hereby made his duty to order the owner of a dog whioh has betten any human being or domestic animal to keep said dog tied up securely for a period of fourteen (14) days after said biting of a human being or domestic animal, when in the opinion of said poundkeeper or marshal the dog may be afflicted with rabies and that for the protection of the public such tying up of said dog is necessary. SECTION 20. PENALTY. Any person. firm or corporation convicted of violating any of the provisions of Ssotion 2, 4, 13, 14, 15, 16, 18, Or 19 of this ordinance shall be deemed guilty of a misdemeanor and shall be punished by fine of not less than five dollars ($5.00) and not more than fifty dollare ($50.00) and'ooats of proslmation and in default of payment of fine and coats he shall be confined in the village or County jail until said fine and costs are satisfied as provided by law. SECTION 21. EFFECTIVE. This ordinance shall be in full force and effect from and after its passage and publication according to law.
