HomeMy WebLinkAbout1942-01 03-14 CCO r" qzoi 37 ORDINANCE NO.26 AN ORDINANCE TO PROTECT AND PRESERVE TEE PUBLIC HEALTH BY REGULATING THE KEEPING, COLLECTION AND DISPOSAL OF GARBAGE AND RUBBISH AND PROVIDING A PENALTY FOR VIOLATION THEREOF. The Village Council of Brooklyn Center do ordain as follows: SECTION 1 DEFINITIONS - The word "garbage" as used herein shall include only organic refuse resulting from the preparation of food, and decayed and spoiled food from any source. The word "rubbish" as used herein shall include inorganic refuse matter such as tin cans, glass, paper and sweepings. SECTION 2. THE CARE OF GARBAGE AND RUBBISH - - It shall be the duty of every householder or occupant of any dwelling house, boarding house, restaurant or any place of business to provide for the disposal of all'garbage or rubbish accumulated upon property owned or occupied by him or them in a sanitary manner, approved by the Local Board of Health, by burning, burial, feeding, or provid- ing for its removal. Persons desiring to make use of ti,Ja services of the licensed garbage and rubbish collector for the purposes of removing such garbage and rubbish may do so by notifying such collector, paying the fee provided for herein, and providing himself or themselves with one or more tight metal cans sufficent to receive all garbage which may accumulate between the timesof collection. All persons making use of the services of the licensed garbage and . rubbish accumulated upon property owned or occupied by him or them in said cans, ti each of which shall be provided with a bail or handles and a tight fitting cover. All such cans shall be so placed as to be readily accessible for remov4<_, ing and emptying the garbage and rubbish therefrom by the collectors, and where they will not be a public nuisance or in any manner or degree offensive. Each container shall be kept as clean as is reasonably possible at all times. The Local Board of Health shall be the judge of the sufficiency and location of said garbage and rubbish cans or receptacles. SECTION 3. UNATHORIZED DISPOSAL- - It shall be unlawful for any person, firm or corporation in the Village of Brooklyn Center to throw or dispose of garbage or rubbish or to cause the same to be thrown or disposed of upon any street, alley, gutter, park or other public place, or to throw or dispose of the same in or upon any vacant lot or back yard, or to store or keep the same otherwise than in cans or receptacles as required by Section 2 of this ordinance; and it shall be unlawful to have,store, dispose of or keep garbage and rubbish where rats may have access thereto or may feed thereon. Each day's violation of this section shall be a separate and distinct offense. SECTION 4. LICENSE REQUIRED- - After April 1, 1942, no person, firm or corporation shall, for hire, collectgarbage and rubbish any place in the Village of Brooklyn Center unless license therefore shall first have been obtained as provided in this Ordinance. SECTION 5. APPLICATION AND ISSUANCE OF LICENSE- - Any person, firm or core- ' oration desiring a license to collect garbage and rubbish in the Village of Brooklyn ,Center shall make application .' /'s for the same to the Clerk upon a farm prescribed by the Council. The Application shall set forth (1) the name and address of the applicant; (2) a list of the equipment whieh aro- poses to use in such collection; (3) the place or places to which the garbage is to be hauled; (4) manner in which said garbage is to be disposed of; and (5) the Illation of the Village in which collections are to be made. Said appli- shall be submitted to the Local Board of Health for its investigation and report. After concluding its investigation of the applicant and the equipment listed in the application, the local Board of Health shall report back to the Council and submit its recommendations, The Village Council, then, shall either approve or III reject the application for a license and if the application is approved, the applicant, before any license may be issaed shall deposit with the Clerk . a bond in the penal sum of 4200, or the equivalent thereof, conditioned that he 'will faithfully and continuously provide a garbage and rubbish collection service specified in his application, as approved by the Council, and under the con- ditions imposed by the Ordinances of the Village, and the Lawful orders, rules and regulations CT the.Local Board of Health. If such bond is approved by the Council, the Clerk shall issue and deliver the license upon payment of the required license fee of 41.00, which fee shall accompany the application. Every such license shall expire on December 31, next, after its issuance. Licenses shall not be transferable from one person to another and shall be exhibited to any person upon re,_ SECTION 6. RESTRICTIONS APPLYING TO LICENSED GARBAGE AND RUBBISH COT.T.FCTORS.- Each licensed garbage and rubbish collector shall make collections once each week i in that portion of the Village in which he is licensed to collect. Said collector 1 La.._ 38 Ordinance 26 Cont'd. shall provide a covered tank or truck so constructed that the contents will not leak or spill therefrom, in which all garbage collected by hire shall be conveyed to the place designated in his or its application. The truck or conveyance used shall_.be kept clean and as free from offensive odors as possible, and shall not be allowed to stand in any street, alley, or public place longer than is reasonably necessary to collect garbage and rubbish. SECTION 7. GARBAGE AND RUBBISH COLLECTION FEE.- - The expense of garbage and rubbish collection shall be paid to said collector, monthly, by the owner, agent, occupant or tenant of the premises from which such garbage and rubbish is col- lected at a fee approved by the Council, and such fee shall be full compensation for his services in such collection. SECTION 8. REVOCATION OF LICENSE- - Every such license issued to a garbage and rubbish collector may be revoked by the Council for a violation of any provision of this ordinance if the license has been given a reasonable notice and an opportunity to be heard. SECTION 9. PENALTY - - Any person, firm, or corporation who shall violate any provision of this Ordinance shall be guilty of a misdemeanor and upon con- viction thereof shall be punished by a fine of not to exceed $100.00, or by - imprisonment for not to exceed ninety days. SECTION 10. REPEAL -- - A11 ordinances or parts of Ordinances inconsistent herewith are hereby repealed. SECTION 11. EFFECTIVE DATE. - - This Ordinance shall take effect and be in force from and after its adoption and publication. PASSED THIS 14 DAY OF LARCH, 1942. Attest: Village Clerk President of Council • •
