OF LIQUOR ORDINANCE LICENSING _AND REGULATING THE SALE OF NON-
11.T LItYeRS,REPEALING INCOI.=SIST.,{,NT ORDINANCES," AND PROVIDING A '
PENALTY FOR THE VIOLATION THEREOF.-
THE VILLAGE COUNCIL OF BROOKLYN CENTER DO ORDAIN:
That the so- called liquor ordiance No. 19 licensing and regu-
lating the sale of non - intoxicating malt liquors, repealing incon-
sistent ordinances, and providing a penalty for the violation thereof,
is hereby amended as follows:
SECTION 4, License Fees, is hereby amended to read as follows:
All Applications for licenses shall be accompanied by a receipt from
the Village Clerk for the required annual fee of the license and a
semi - annual tee if a license is applied for for six months for an on -sale
license: otherwise, an annual fee for a sale for the respective license.
The fee for said on -sale license for one year shall be one Hundred (#100)
Dollars. The fee for said on -sale license for six months shall be Fifty
(45 Dollars. The annual fee for an off -sale license shall be Five( #5.00)
Dollars. All on -sale licenses shall expire, except as is hereinafter provid
ed for, on the last day of June in each year, provided, that any semi -
a.nnuallicense issued by the Council within ninety (99) days prior to the
last day of June of any year shall expire on the last day of October of
the same ye -r. All off -sale licenses shall expire on the last day of
June in each year.
SECTION 6, Licensing Requirements, is hereby amended as to para-
gr -phs four and five so that the same shall read as follows:
On-sale licenses shall be granted only to drug stores, restaurants,
andhotels, and bonifide clubs, but no on -sale licenses shall be granted
for sales in connection with any business or club has not been in opera-
tion at that place for at least six months immediately preceding such appli-
catioh. A bona fide club by this ordinance is an organization for social
or business purposes or for intellectual improvement or for the promotion
of sports where the serving of such non - intoxicating malt liquor is
incidental and not the major purpose of the club.
The following additional paragraph shall be inserted under SECTION 6:
No license shall be issued to any person who has a Twenty -five (425)
Dollar Federal Occupational Tax receipt, unless such person has a license
to sell intoxicating liquors in accordance with uhapter 46, Extra Session
Laws of 1933 and 1934 and acts amendatory thereof.

OJtrilur; 8, License Automatically rtevoked, is hereby amended to read
as follows:
The presence of intoxicating liquors on the premises of the licensee
hereunder, unless said licensee has an intoxicating liquor license
issued under provisions of uhapter 46, Extra Session Laws of 1933 and 1934
^nd acts amendatory thereof, shall be prima facie evidence of possession
of intoxicating liquors for the purpose of sale, and the license granted
. to said licensee shall be automatically forfeited without the necessity
of formal act by the council.
SECTION 10, Hours of Sales, is hereby amended to read as follows:
I;o on -sale licensee shall sell or consume any malt liquor on any
primary, special or general election day during the hours the polls are
open, or on any Dunday between the hours of 2 :00 A. M. and 12;00 noon, or
on any other day between the hours of 1.QO A. a. and 6:00 A. M.,
That these amendments shall take effect and be in force from and
after their publication. gnat as to all other parts of said ordinance, the
same is to remain in full force and effect, and all ordinances or parts
of ordinances inconsistent with these amendments are hereby repealed.
