As you know, Twin Lakes Business Park, LLC has been working to restore this property since April of 1997. Completing the environmental remediation, site preparation and redevelopment has been an open and coordinated effort involving the City, the Minnesota Pollution Control Agency ( "MPCXj, the Metropolitan Council, the State of Minnesota Department of Trade and Economic Development, the Shingle Creek Watershed District, the Board of Soil and Water Conservation, the Minnesota Department of Natural Resources and others. The communication and coordination necessary to restore this site has been consistent and effective and has been recognized by the Partnership 2000 Minnesota Awards as a semi - finalist in the Government and Environment Category this past April. Yesterday I received a copy of a July 12 letter (a copy of which is .attached for accuracy of reference) raising several issues regarding the environmental status of the Site as relates to an alignment of France Avenue North being considered by the Department of Transportation, My partner Paul Hyde will attend the meeting on the 19 of July to provide information which you, members of the Council or members of the public may request. In the following paragraphs, I would like to address several of the issues raised in the . . attached letter. Environmental Status Joslyn Company began cleanup over 20 years ago and, with the expenditure of $17 million cleaned the property up to levels set in a 1985 Consent Order. Joslyn also installed and continues to operate a groundwater remediation system, as required by the 3060 Metropolitan Centre 333 South Seventh Street, Minneapolis, MN 55402 Phone: 612 9041513 Fax: 612 9041590 1985 Consent Order. Having met the requirements of the Consent Order, Joslyn planned :. not to redevelop the Site. Twin Lakes undertook to redevelop the Site under an MPCA approved Response Action p sPo Plan. Twin Lakes commitment to do additional environmental reme ' diction, sufficient to meet the MPCA's generic industrial standards, as well as the MPCA's agreement to issue a Certificate of Completion and initiate the delisting of the property, were incorporated in a Response Action Agreement dated June 23, 1999. Response actions were completed first on Lot. 1, Joslyn Addition, in coordination with the redevelopment of the property for the Wickes Distribution Center. Twin Lakes did the work required by the RAP and submitted a RAP Completion Reportfor Lot 1. On May 19, 2000 the MPCA Commissioner issued a Certificate of Completion providing among other things that: "[T]he Commissioner or the Commissioner's delegate has determined that the response actions taken by RER [including Twin Lakes] will not aggravate or contribute to any remaining releases or threatened releases at the Site and will not interfere with or substantially increase the cost of response actions to address such remaining releases or threatened releases...." The Commissioner's decision to issue the Certificate was based on a record of thirty-nine (39) reports and documents. The Certificate.and exhibits state that remedial measures have been implemented under the RAP to make any residual contamination inaccessible. A copy of the Certificate and exhibits is attached for completeness of reference. The Response Action Plan ("RAP ") for Lots 2 and 3 (the portion of the Site where the access road is proposed by the DOT) was dated January 14, 2000. Figure 5 of the RAP, entitled `PLANNED DEVELOPMENT LOT 2 AND LOT 3, Joslyn Site" clearly shows the proposed future access road in the alignment proposed by the DOT, extending North from Azelia Avenue. A copy of this Figure is attached. On February 18 the MPCA approved the RAP for Lots 2 and 3. The Response Action Agreement of June 23, 1999 required Joslyn to file a title document, called a Declaration of Restrictions and Covenants ("Restrictive Covenant") on the title of Lots 1, 2 and 3, Joslyn Addition. The Restrictive Covenant appears on the title of the property in the County Recorder's office and describes the remedial actions for the soil and groundwater and states: "[T]he Response Actions either have been implemented or are being implemented at the Property in a manner that the MPCA has determined is protective of the environment and human health based on use of the Property for commercial or industrial purposes...." 2 The restrictions in the Covenant require the property to be used for commercial and industrial purposes, forbid use of groundwater on the property, forbid disturbance of the groundwater remediation systems and require written approval from the MPCA to engage in any activity subject to the restrictions. Other uses are not in any way limited. Since 1983 the Site has been listed on the State of Minnesota Permanent List of Priorities ("PIP). In May of this year the MPCA published notice of its intent to delist the Site, except for the West Area (also known as Outlot A, Joslyn A#dition), when all of the cleanup conditions were completed and no further action was needed to assure that the remedy was fully protective of the environment and public health. The notice period was completed without any public comment. All of the cleanup conditions have been met. Delisting of a property is intended, under the Minnesota Environmental Response Compensation and Liability Act, as a determination that all remedial action has been completed or provided for to remove the risk of harm to the environment or public health. That determination has now been made for -the Joslyn site, except for the West Area (Outlot A), after 20 years of extensive remediation under careful scrutiny by the MPCA in a public and open process. The West Area The West Area (Outlot A) is an area of approximately 11 acres lying west of the Wickes Distribution Center property. The area is comprised of wetland and upland and is almost totally within the floodplain of Twin Lake. The area has been studied extensively as indicated by a number reports submitted to the MPCA by Joslyn's highly respected environmental engineering consultant, Barr Engineering Company. Contaminated surface soils found to exceed the Consent Order cleanup standards have been removed and treated on -site or disposed of at an off -site licensed disposal facility. Studies are on -going to identify the extent of any remaining contamination in the West Area. This information will be used to complete risk evaluations to guide the extent of any additional response actions in the area. No development is planned for the West Area, in fact, Joslyn's lease to Twin Lakes prohibits any development in the West Area. Groundwater Contamination The groundwater at the Site is contaminated with wood treating fluids from the former Joslyn Site. This has been a matter of public discussion and highly visible cooperative efforts to meet environmental cleanup standards between the Site owner and the MPCA for over twenty years. The MPCA has approved the groundwater remediation system. Joslyn has agreed to continue the operation of the system until drinking water standards are met. Because this remedial action is approved and is operating effectively, the MPCA has delisted the Site, except for the West Area. 3 The Restrictive Covenant prevents any exposure to the contaminated groundwater while residual contaminants exceed drinking water standards. No activity on the property, such as excavation, which would encounter groundwater may be initiated without written approval of the MPCA. The P gnment works well for the of the Site. We do recognize the design concerns of the DOT and their ability to implement any design the Department finally selects. Should the design along Azelia be selected, MPCA approval will be required under the Restrictive Covenant.
