Adjournment - Adjourn to City Council Executive Session in Conference Room B with Legal Counsel in Barlow appeal following EDA meeting. • EDA Agenda Item No. 3a MINUTES OF THE PROCEEDINGS OF THE ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA REGULAR SESSION AUGUST 14, 2000 CITY HALL 1. CALL TO ORDER The Brooklyn Center Economic Development Authority (EDA) met in regular session and was called to order by President Myrna Kragness at 7:45 p.m. 2. ROLL CALL . President Myrna Kragness, Commissioners Debra Hilstrom, Kay Lasman, Ed Nelson, and Robert Peppe. Also present: Executive Director Michael J. McCauley, Assistant City Manager Jane Chambers, Public Works Director Diane Spector, City Attorney Charlie LeFevere, and Deputy City Clerk Maria Rosenbaum. • 3. APPROVAL OF AGENDA AND CONSENT AGENDA A motion by Commissioner Lasman, seconded by Commissioner Hilstrom to approve the agenda and consent agenda. Motion passed unanimously. 3a. APPROVAL OF MINUTES A motion by Commissioner Lasman, seconded by Commissioner Hilstrom to approve the July 24, 2000, regular session minutes. Motion passed unanimously. 3b. RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF A DEVELOPMENT AGREEMENT A motion by Commissioner Lasman, seconded by Commissioner Hilstrom to table a resolution approving and authorizing execution of a development agreement with real estate recycling for additional redevelopment to the September 25, 2000, EDA meeting. Motion passed unanimously. 4. COMMISSION CONSIDERATION ITEMS • 08/14/00 -1- DRAFT 4a. RESOLUTION CALLING FOR A PUBLIC HEARING REGARDING THE SALE OF CERTAIN EDA OWNED PROPERTY LOCATED AT 5900 EMERSON AVENUE NORTH IN BROOKLYN CENTER MINNESOTA, PURSUANT TO MINNESOTA STATUTES, SECTION 469.012 SUBDIVISION 7 AND SECTION 469.029 Executive Director Michael McCauley discussed this resolution would authorize a public hearing regarding the sale of the lot as required by State Statute. The EDA would review the builder proposals at its August 28, 2000, meeting and if the EDA selects a proposal at that meeting, staff would prepare a purchase agreement for consideration at the September 11, 2000, EDA meeting. The purpose of the public hearing on September 11, 2000, would be to review the terms and conditions of the sale as contained in the proposed purchase agreement and to invite any public comment. RESOLUTION NO. 2000-13. Commissioner Lasman introduced the following resolution and moved its adoption: RESOLUTION CALLING FOR A PUBLIC HEARING REGARDING THE SALE OF CERTAIN EDA OWNED PROPERTY LOCATED AT 5900 EMERSON AVENUE NORTH IN BROOKLYN CENTER MINNESOTA, PURSUANT TO MINNESOTA STATUTES, SECTION 469.012 SUBDIVISION 7 AND SECTION 469.029 The motion for the adoption of the foregoing resolution was duly seconded by Commissioner Nelson. Motion passed unanimously. 4b. REPORT ON STATUS OF AMERICAN LEGION ACQUISITION Mr. McCauley reported that at a previous meeting the EDA authorized the acquisition for the American Legion and that on Tuesday, August 8, 2000, American Legion personnel met with the relocation specialist to discuss relocating. 5• ADJOURNMENT A motion by Commissioner Hilstrom, seconded by Commissioner Nelson to adjourn the meeting at 7:47 p.m. Motion passed unanimously. McCauley, City Manager FROM: Tom Bublitz, Community Development Specialist /43 J DATE: August 23, 2000 SUBJECT: Resolution Regarding the Sale of Land Located at 5900 Emerson Avenue North by the Economic Development Authority in and for the City of Brooklyn Center and Authorizing the EDA Executive Director to Negotiate a Purchase Agreement for the Sale of Such Land At its August 14, 2000 meeting, the Brooklyn Center Economic Development Authority (EDA) reviewed the specifications for construction of new single family house at 5900 Emerson Avenue North and approved Resolution No. 2000 -13 calling for a public hearing regarding the sale of certain EDA owned property located at 5900 Emerson Avenue North in Brooklyn Center Minnesota pursuant to Minnesota Statutes, Section 469.012, Subdivision 7 and section 469.029. A copy of Resolution No. 2000 -13 and accompanying staff memorandum is included with this memo. • Based on response to the attached advertisement for sale of the lot at 5900 Emerson Avenue North, and general inquiries received from builders, staff mailed out 17 sets of specifications for construction of new single family house at 5900 Emerson Avenue North. Out of the 17 specifications mailed, four proposals were received. Copies of the building elevations, floor plans and site plans from the four proposals received are included with this memorandum. Additional information from staff review of the proposals is included below. The proposals are listed in the order by which they were received. PROPOSAL FROM TJP CONSTRUCTION INC. • House is a rambler facing Emerson Avenue North showing a stucco exterior with partial brick on the front of the house and partial brick on the front of the attached garage which faces 59th Avenue North. • The footprint dimension of the first floor living space is 40' x 34' or 1360 square feet. The garage is a two car garage with a dimension of 24' x 24' or 576 square feet. • The floor plan shows two bedrooms on the upper level, a living room, kitchen, two full bathrooms and a utility room. • The basement level shows a family room, full bathroom and two additional rooms, one with an egress window. • The site plan also shows a deck off the rear of the house. MEMORANDUM August 23, 2000 Page 2 PROPOSAL FROM SHIVERS - MILLER • House is a split level facing 59th Avenue North showing a vinyl exterior. The plan shows a two car attached garage with an option for a third stall. • The main level is floor plan shows 1169 square feet. The dimension of the lower level area is shown as 42' x 24' or 1008 square feet. • The main level floor plan shows a living room, kitchen, three bedrooms including a master bedroom with one full bath on the main level. • The floor plan on the lower level shows a future family room, two future bedrooms, a utility area and bath. PROPOSAL FROM DENMARK BUILDING AND DEVELOPMENT CORPORATION • House is a rambler facing Emerson Avenue North, showing a vinyl exterior with vinyl shakes on the gable ends. The plan shows a two car attached garage with additional storage area. The design of the house is essentially identical to the rambler unit built in the Bellvue Lane project, by the EDA, using Denmark Building and Development Corporation for design assistance and construction management. • The total square footage of the main floor living area is 1,419 square feet with a corresponding • amount of square footage in the basement. • The floor plan shows two bedrooms on the main level with a walk in closet and full bath. The plan shows a foyer area at the front entrance with a kitchen opening to a dining area and living room. The plan also shows a utility room coming off the on the main level with a 3/4 bath. • The floor plan in the basement shows an egress window in the northwest corner of the basement. PROPOSAL FROM STEVEN MARLIN GRANT HOMES INC. • House is a two story facing Emerson Avenue North showing a vinyl exterior. The footprint dimensions of the house are 25.10' x 22.2'. The total square footage of the house is shown on the plans as 1,125 square feet. • The first floor plan shows a foyer, living room and kitchen and half bath. The second floor plan shows three bedrooms and a full bath. The plans also shows a full basement with an egress window. • The plan shows a two car detached garage with dimensions of 22' x 22' or 484 square feet. STAFF REVIEW OF HOME PLANS SUBMITTED Community Development staff reviewed all four home plans submitted. A summary of the review comments follows. • Staff believes the style of home that blends in best with the surrounding neighborhood is the rambler. The neighborhood surrounding 5900 Emerson Avenue North is predominately ramblers • and 1' /z story homes. MEMORANDUM August 23, 2000 Page 3 • Of the two rambler designs submitted, staff believes the plans submitted by Denmark Building and Development Corporation best meet the criteria. set forth in the specifications for construction of new single family house at 5900 Emerson Avenue North including the following: ► The exterior design, height, mass and materials of the proposed home will produce a home that blends in with the surrounding neighborhood. ► Facing the front of the house towards Emerson Avenue North provides the most desirable site plan orientation. ► The interior floor plan is a well thought out and functional floor plan. ► The plan submitted by Denmark Building and Development Corporation provides a significant amount of usable yard area to the rear of the home. SUMMARY If the EDA agrees with the staff review, the resolution Regarding the Sale of Land Located at 5900 Emerson Avenue North by the Economic Development Authority in and for the City of Brooklyn Center and Authorizing the EDA Executive Director to Negotiate a Purchase Agreement for the Sale of Such Land should be completed by inserting the name of Denmark Building and Development Corporation in the paragraphs numbered 2 and 3 in the resolution. The resolution would direct the EDA Executive Director to prepare a purchase agreement which would be reviewed by the EDA at a public hearing scheduled September 11, 2000. Staff also recommends that copies of the hearing notice, along with the site and building plan of the home selected by the EDA should be mailed to properties in the immediate area of 5900 Emerson Avenue North in advance of the public hearing. • • Commissioner introduced the following resolution and moved its adoption: EDA RESOLUTION NO. RESOLUTION REGARDING THE SALE OF LAND LOCATED AT 5900 EMERSON AVENUE NORTH BY THE ECONOMIC DEVELOPMENT AUTHORITY IN AND FOR THE CITY OF BROOKLYN CENTER AND AUTHORIZING THE EDA EXECUTIVE DIRECTOR TO NEGOTIATE A PURCHASE AGREEMENT FOR THE SALE OF SUCH LAND WHEREAS, the Economic Development Authority in and for the City of Brooklyn Center (EDA) has authorized pursuant to Minnesota Statutes, Section 469.012, Subdivision 7 within its area of operation, and without the adoption of an urban renewal plan, to acquire real property, demolish the buildings and improvements thereon and sell such property in accordance with Minnesota Statutes Section 469.029, as long as the buildings on such real property are substandard; and WHEREAS, the EDA has determined that the building located on the property described below was dilapidated and obsolescent and the clearance thereof was in the best interests of the public health and welfare of the City of Brooklyn Center; and . WHEREAS, the EDA purchased and acquired that tract of land legally described as Lot 9 Block 1, Andrew Rocks Addition, PID 02- 118 -21 -22 -0009 (5900 Emerson Avenue North) (the Property); and WHEREAS, the EDA solicited proposals for the development of the property pursuant to an advertisement for sale of the property in the official newspaper of the City and specifications for construction of new single family house at 5900 Emerson Avenue North; and WHEREAS, the EDA has reviewed all proposals received for the development of the property. NOW, THEREFORE, BE IT RESOLVED by the Economic Development Authority in and for the City of Brooklyn Center, Minnesota as follows: 1. The EDA hereby finds and determines that it is in the best interests of the EDA and the public health, safety and welfare of the community that the EDA sell the property in accordance with Minnesota Statutes, Section 469.012, Subdivision 7, and 469.029. 2. The EDA hereby finds and determines that the proposal for development of the property received from best meets the criteria set forth in the specifications for construction of new single family house at 5900 Emerson i s Avenue North. RESOLUTION NO. • 3. The EDA Executive Director is hereby authorized to negotiate a purchase agreement for the sale of the property to for $25,000 with the additional terms of such purchase agreement to be subject to the further review and acceptance by the EDA. 4. The EDA will hold a public hearing on the sale of the property in accordance with Minnesota Statutes, Section 469.029, on September 11, 2000 at its regular scheduled meeting. Date President • The motion for the adoption of the foregoing resolution was duly seconded by commissioner and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: whereupon said resolution was declared duly passed and adopted. • • MEMORANDUM TO: Michael I McCauley, City Manager FROM: Tom Bublitz, Community Development Specialist DATE: August 9, 2000 ,SUBJECT: Resolution Calling for a Public Hearing Regarding the Sale of Certain EDA Owned Property Located at 5900 Emerson Avenue North in Brooklyn Center Minnesota, Pursuant to Minnesota Statutes, Section 469.012 Subdivision 7 and Section 469.029 Recently, EDA staff has received several inquiries from builders regarding the development of the EDA owned lot at 5900 Emerson Avenue North. This lot was initially advertised and marketed in 1995 but there was no interest in developing the lot at that time. The Bellvue Lane project began in 1996 and the lot at 5900 Emerson Avenue was offered as an option for persons interested in the Bellvue Lane homes but for financial reasons did not qualify to purchase one of the Bellvue Lane homes. No interest in the lot at 5900 Emerson was generated from the Bellvue Lane project. The market for scattered site lots has changed and there is now a renewed interest in these types of lots. • Staff has prepared the attached Specifications for Construction of a New Single Family House at 5900 Emerson Avenue North and has submitted it to builders interested in the lot. Builders are directed to submit proposals (building and site plan) by August 21, 2000 for review by the EDA at its August 28, 2000 meeting. The goal of the specifications is to assure that a quality home that blends in with the existing neighborhood, is built on the lot. -- EDA staff worked with the City's assessing department to establish a market value for the lot. Staff is recommending a firm price of $25,000 be placed on the lot. This price represents a reasonable market value for the land and eliminates the situation where one builder with a less desirable home plan submits a higher offer on the lot than another builder with a superior house plan. The resolution included with this memorandum would authorize a public hearing regarding the sale of the lot as required by State Statute. The EDA would review the builder proposals at its August 28, 2000 meeting and if the EDA selects a proposal at that meeting, staff would prepare a purchase agreement for consideration at the September 11, 2000 EDA meeting. The purpose of the public hearing at the September 11 meeting would be to review the terms and conditions of the sale as contained in the proposed purchase agreement and to invite any public comment at the public hearing. Staff recommends approval of the resolution. City of Brooklyn Center Economic Development Authority SPECIFICATIONS FOR CONSTRUCTION OF NEW SINGLE FAMILY HOUSE AT 5900 EMERSON AVENUE- NORTH A. PROPERTY INFORMATION. The lot is located at 5900 Emerson Avenue North, Brooklyn Center, Minnesota. There is no lot survey information available for the lot. Based on available information obtained from City Assessing records the lot is a level, single family lot with R1 (single family) zoning. The lot size is approximately 9,782 square feet with dimensions of 73 feet by 134 feet (average). A copy of the portion of the plat showing the lot and on file with the City is included with these specifications. Setback information on the lot is as follows: • 35' front yard set back from Emerson Avenue North (measured from property line) • 15' setback from 59th Avenue North (measured from property line) • 10' setback on the principal building from north property line and 10' setback on the principal building from east property line with the following exceptions. NOTE: Since 5900 Emerson Avenue North is a corner lot, the north and east setbacks are considered side yard setbacks. The side yard setbacks of 10' may be reduced to 5' for the principal building (living space) along one side yard if there are no openings (window or door) on the house at these points. The side yard setbacks for a garage may be reduced to 5'. A copy of the plat showing 5900 Emerson is included with these specifications. The City/EDA does not possess a survey for this property. B. DEADLINE FOR, CONSTRUCTION.. Construction of the dwelling on the property must be completed by September 30, 2001. C. PRICE OF LOT. The sale price of the lot is $25,000, subject to approval by the EDA Board of Commissioners. Offers less than $25,000 will not be considered. D. HOUSING D, ES,1 ,,N .A ., 8ITE. DF,.,VELOPMENT CRITERIA, The home shall be a single family, owner occupied house. • Siding materials; exterior facade presentation; roof, window, siding and building line variability; landscape; interior space function and use are all important criteria in evaluating proposals so the finished home blends in with the surrounding neighborhood. • Utility meters shall be screened from street view; locations must be specified on plans. • Site drainage shall be accommodated on the site so that water is directed away from the new home and the neighboring properties. Neighboring properties should not be disturbed to create drainage swales. • Exterior materials (siding, soffit, doors and windows), should be low maintenance. The use of brick or stucco is encouraged. Natural cedar lap siding is acceptable if properly stained or painted. Hardboard panels or hardboard lap siding are not acceptable. • Unit height and mass of the new home shall be as compatible as possible with the scale of the surrounding neighborhood. • Plans must present a balanced and pleasing distribution of wall and window areas from all views. Garage door dominance in design should be minimized. • A full basement shall be provided in the house unless the selected design results in a split level, garden level type of basement. E. Building Selection Criteria.. Builders must meet the following requirements: . Provide preliminary plans of the proposed house. Preliminary plans shall include a site plan, floor plan and building elevations of all four sides. • Builder shall be licensed as such by the State of Minnesota. • If requested by EDA staff, provide proof of builder's risk, comprehensive general liability, and worker's compensation insurance coverage. • If requested by EDA staff, provide references from previous customers, suppliers and/or building inspectors. • Agree to complete construction within the frame specified in Section B above. The purchase agreement will include a provision which returns the ownership of the site to the EDA if the Builder does not perform as specified. F. Builder Selection Procedures. • Builder's proposals are due at Brooklyn Center City Hall no later than 1:00 p.m. August 21, 2000. Proposals may be submitted in person, by mail or by fax and should be addressed to Tom Bublitz. The Brooklyn Center City Hall address is 6301 Shingle Creek Parkway, Brooklyn Center, MN 55430. The fax number is (763)569 -3494. • Upon receipt of Builder proposals, EDA staff will evaluate the proposals and make a recommendation to the EDA for consideration at its meeting on August 28, 2000. Proposals that do not include the required site plans, floor plan and building elevations, may be eliminated by staff from consideration by the EDA. • Upon selection of a particular Builder proposal, Builder will be required to enter into a Purchase and Redevelopment Agreement and provide $1,000 earnest money. • The EDA reserves the right to reject any and all offers. • Prior to final acceptance of Builder Proposal and sale of lot, the EDA will conduct a public hearing pursuant to Minnesota Statutes Section 469.029. G. Commissioner Kay Tasman introduced the following resolution and moved its adoption: t EDA RESOLUTION.NO. 2000 -13 RESOLUTION CALLING FOR A PUBLIC HEARING REGARDING THE SALE OF CERTAIN EDA OWNED PROPERTY LOCATED AT 5900 EMERSON AVENUE NORTH IN BROOKLYN CENTER MINNESOTA PURSUANT TO MINNESOTA STATUTES, SECTION 469.012 SUBDIVISION 7 AND SECTION 469.029 WHEREAS, the Economic Development Authority for the City of Brooklyn Center Resolution No. 95 -16 authorized the sale of the EDA owned property at 5900 Emerson Avenue North, legally described as Lot 9 Block 1, Andrew Rocks Addition, PID 02- 118 -21 -22 -0009 (the Property); and WHEREAS, the EDA is authorized, pursuant to Minnesota Statutes Section 469.012 Subdivision 7, within its area of operation and without the adoption of an urban renewal plan, to acquire real property, demolish the buildings and improvements thereon, and sell such property in accordance with'Minnesota Statutes Section 469.029, as long as the buildings on such real property are substandard; and WHEREAS, the EDA has determined that the building located on the property described above was dilapidated and obsolescent and the clearance thereof was in the best interest of the public health and welfare of the City of Brooklyn Center; and WHEREAS, the property was purchased by the EDA using EDA funds as part of the scattered site acquisition program for removal of blighted single family properties; and WHEREAS, proposals for development of the property have been solicited from builders pursuant to Specifications for Construction of a New Single Family House at 5900 Emerson Avenue North and the sale of the property has been advertised in the City's official newspaper; and WHEREAS, it is anticipated that proposals for the development of the property will be reviewed by the EDA at its August 28, 2000 meeting and that a specific proposal will be selected by the EDA at that time; and WHEREAS, Minnesota Statute Section 469.029 requires that a public hearing be held regarding the terms and conditions relative to the sale of the . g g property. NOW, THEREFORE, BE IT RESOLVED by the Economic Development Authority in and for the City of Brooklyn Center, Minnesota that a public hearing is hereby authorized to be held on September 11, 2000 at 7 p.m. or as soon thereafter as the matter may be heard in the Brooklyn Center City Hall Council Chambers regarding the proposed sale of property described herein.
