Human Rights Commission of the
City of Brooklyn Center In the County
of Hennepin and State of Minnesota
February 25, 1969
The Human Rights Commission met in regular session and was calf
to order by Chairman Leon Binger at 8:03 P.M.
Roll Call: Floyd Anderson, Mrs. Majel Berg, Leon Binger, Adrian
Dorenfeld, Arthur Gustafson, James Knight, Rev. Roy Lindquist, Mrs.
Leon Rankin, Jesse Sandoval, Mark 6azama, Neil Smeaton, Marvin
Stavig, and John Winkelman. Also present was: B.E. Peterson.
Motion by Neil Smeaton and seconded by Mrs. Leon Rankin to
approve the minutes of the February 11, 1969 meeting as amended.
Chairman Leon Binger made the following announcements:
a. that Commissioner John Winkelman will be the 1969 Vice
Chairman for the Brooklyn Center Human Rights Commission.
b. that the North Suburban Community Theater and the
Metropolitan Culture Arts Center is sponsoring a m
entitled "in White America" to be shown at Our Saviour's ..J
Lutheran Church, 2639 Thomas Avenue North, at 8:30 P.M.
on the following dates: February 23, March 1, 2, 7, 8,
and 9th.
C. that the Commission members preference for the
Commission's official one meeting a month is the
• second Tuesday of each month.
At this time Chairman Binger requested that Commissioner Stavig
give his committee report summarizing the Human Rights Week in
Brooklyn Center. Commissioner Stavig as Chairman of the Brooklyn
Center Human Rights Commission reported that over all, the Human
Rights Week effort in Brooklyn Center was successful.
The next item of business related to old business whereby Chair-
man Binger reported that Commissioner Adrian Dorenfeld was selected
to represent the Brooklyn Center Human Rights Commission on the
District Human Rights Advisory Committee formed by the Robbinsdale
School District Board of Education. Commissioner Dorenfeld stated
that he sent a letter of acceptance as of February 25, 1969.
At this time Chairman Binger announced that he received all but
two Commission members preferences for their choice of three out
of five permanent committees as established by the official By-Laws.
Chairman Binger suggested to Commission members that since there was
a majority preference for the Education Committee and the Public
Accomodations and Services Committee that there will be need for
some compromise to get equitable Commission member representation
on all five permanant committees.
The Human Rights Commission next considered the Committee Report
on Proposed Major Amendments to the Minnesota State Act Against
Discrimination as outlined by a special committee, with Commission
member Vern Backes Chairman, and Commissioners Mrs. Leon Rankin and
Neil Smeaton. At this time Chairman Binger announced that the
procedures for discussion on the proposed major amendments to the
Minnesota State Act Against Discrimination would be to ask Commissic
members for their preference as to those amendments which should
receive priority discussion and then to have Commissioner Smeaton
read each amendment before discussion would take place. Chairman

Binger then called for Commission preference. At this time it was
established by Chairman Binger that proposed amendments number one
(1), eight (8), thirteen (13), and fourteen (14) should receive
thorough discussion by the Commission following their endorsement i-
favor or not in favor.
Motion by James Knight and seconded by Mark Sazama to amend
363.03, Unfair Discrimination Practices, to include in Section (2)
the wording "religion, national origin, or sex"; in order to have
Section 2 read as similar as Section (1) and Section (3) of 363.03.
At this time Chairman Binger asked for a motion to endorse the
recommended change to M.S.A. 363.03, Section (2).
Motion by James Knight and seconded by Jesse Sandoval to endorse
the suggested changes to Section (2) of M.S.A. 363.03 All in
favor were: Floyd Anderson, Mrs. Majel Berg, Leon Binger, Adrian
Dorenfeld, Arthur Gustafson, James Knight, Rev. Roy Lindquist, Mrs.
Leon Rankin, Jesse Sandoval, Mark Sazama, Neil Smeaton, Marvin
Stavig and John Winkelman. Voting against were: none. Motion
carried unanimously.
The amendment next considered by the Human Rights Commission was
amendment Number 8, "Posting Notices of Unfair Discrimination
Practices on real property".
Commissioner Smeaton read proposed amendment number eight.
Commissioner Dorenfeld questioned proposed amendment number 8 as
saying it gives too much administrative authority to the Commissianc!:
regarding the Commissioner's authority to nullify a transfer of
lease of real property subject to a charge of discrimination.
• Motion by Adrian Dorenfeld and seconded by Jesse Sandoval that
the Human Rights Commission urge the State Human Rights Department
to rewrite the proposed amendment number 8 regarding "Posting
notices of Unfair Discriminatory practices on real property" so that
innocent people be protected and that contracts not be nullified at
the Commissioner's administrative discretion. Voting in favor were:
Floyd Anderson, Mrs. Majel Berg, Leon Binger, Adrian Dorenfeld,
Arthur Gustafson, James Knight, Rev. Roy Lindquist, Mrs. Leon
Rankin, Jesse Sandoval, Mark Sazama, Neil Smeaton, Marvin Stavig and
John Winkelman. Voting against were: none. Motion Carried
unanimously.
The Commission recessed at 9:15 P.M. and resumed at 9:31 P.M.
At this time the Human Rights Commission agreed that whether
amendment number 14 regarding "Certification of Compliance for Publi.
Contracts," be discussed first instead of proposed amendment
number 13. Chairman Binger then asked Commissioner Smeaton to read
proposed amendment number 14.
After the reading of,proposed amendment number 14 a discussion
ensued among Commission members.
40 Motion by Marvin Stavig and seconded by Jesse Sandoval to not
endorse proposed amendment number 14 as written.
At this time Chairman Binger called for
approving or disapproving Marvin Stavig's
5 Commission members. All opposed were 6

Motion by Arthur Gustafson and seconded by James Knight to
endorse proposed amendment number 14 as written. At this time
Chairman Binger called for a vote. All in faver were 6 Commission
members. All opposed were 5 Commission members. Motion is approved
for endorsing proposed amendment number 14.
Chairman Binger requested Commissioner Smeaton to read proposed
amendment number 13. Motion by Floyd Anderson and seconded by
Mark Sazama to endorse proposed amendment num'ber.13 regarding
suspension or revocation of public contract. At this time Chairman
Binger called for a vote. All in favor were: Floyd Anderson, Mrs.
Majel Berg, Adrian Dorenfeld, Arthur Gustafson, James Knight, Rev.
Roy Lindquist, Mrs. Leon Rankin, Mark, Sazama, Neil Smeaton, Marvin
Stavig and John Winkelman., All opposed were: none. Motion
carried unanimously.
At this time Chairman Binger asked for one motion to approve the
remaining proposed amendments. Motion by James Knight and seconded
by Neil Smeaton to endorse proposed amendment numbers 2, 3, 4, 5, 6,
7, 9, 10, 11, 12, and 15. Chairman Binger called for questions.
None. Motion by Adrian Dorenfeld and seconded by James 3-right to
limit debate. Motion passed.
Motion by Commissioner Winkelman and seconded by Commissioner
Rankin to adjourn the meeting. The Human Rights Commission meeting
adjourned at 10:30 P.M.
At this time Chairman Binger then called a special meeting for
10:33 P.M., February 25, 1969, for the purpose of requesting the 3
member Legislative Advisory Committee on Proposed Major Amendments
to the Minnesota State Act Against Discrimination, chaired by Vern
Backes, Chairman and Commissioners Rankin and Smeaton to draw up
a resume from the minutes of the February 25, 1969 meeting.
Motion by Commissioner Reverend Lindquist and seconded by
Commissioner Knight to adjourn the special meeting. The Human Rigby
Commission special meeting adjourned at 10:35 P.M. Roll Call at
the end of meeting: Floyd Anderson, Mrs. Majel Berg, Leon Binger,
Adrian Dorenfeld, Arthur Gustafson, James Knight, Rev. Roy LindquiC,
Mrs. Leon Rankin, Mark Sazama, Neil Smeaton, Marvin Stavig, and
John Winkelman.
