Warren, Planning Commission Secretary DATE: May 7, 2001 SUBJECT: Review of Planning Commission Application No. 2001-009 Submitted by BKV Group on Behalf of Christenson Corporation A public hearing on Thursday, May 17, 2001, has been scheduled for the Planning Commission to consider Application No. 2001-009, which is a request by BKV Group on behalf of Christenson Corporation for a Planned Unit Development (PUD) Rezoning and Site and Building Plan approval for the development of a 45,000 sq. ft., four building mixed use th commercial/retail development at the northeast quadrant of 69 Avenue North and Brooklyn Boulevard. As a member of the Northwest Neighborhood Advisory Group, you are invited to attend and participate, if you wish, in this public hearing. The site mentioned above has been the subject of efforts over the last six to seven years to encourage the redevelopment and rejuvenation of this area. The City has acquired all of the th property bounded on the south by 69 Avenue; on the west by Brooklyn Boulevard; on the north th by 70 Avenue; and on the east by a line lying 150’ east of the June Avenue right of way thth between 70 and 69 Avenues. The City’s Economic Development Authority (EDA) has reached preliminary agreement with Christenson Corporation for the above mentioned development in the area. A meeting with the th potential developer and neighboring property owners was held on March 28 at which time the proposal was reviewed. Generally, the reaction was favorable provided lighting and screening issues were properly addressed. The property in question is currently zoned C-2 (Commerce) and R-1 (One Family Residence). The applicant is seeking a Planned Unit Development Rezoning with a C-2 (Commerce) underlying zoning. They are seeking the PUD designation to provide modifications to typical requirements that will allow them to better utilize the site. They propose to bring one of the buildings within 15’ of the Brooklyn Boulevard right of way; provide a 10’ rather than 15’ greenstrip along Brooklyn Boulevard which would be off set by a 3’ decorative wall; and allow Northwest Neighborhood Advisory Group Page 1 employee parking to the east of the easterly building in a normally required buffer area to be offset by an 8’ high decorative screen fence. Normally rezoning applications considered by the Planning Commission are referred to the respective Neighborhood Advisory Group. Your group has met on a few occasions to review such proposals. Recently, State Statutes have been amended to require cities to respond to zoning requests within 60 days from the date a properly submitted application has been filed with the City. If no action is taken by the City Council within that time frame, the application is considered to be approved. Our ordinances require publication and a legal notice sent to surrounding property owners for rezoning applications, which require submission of a rezoning application at least four weeks in advance of the Planning Commission’s public hearing. Almost half of the State required 60-day time frame has been used up before the Planning Commission’s public hearing is even held. This requirement makes it almost impossible for the City to hold the Neighborhood Advisory Group meetings we normally have and meet this time requirement. The Planning Commission has instituted a new procedure because it still wishes to receive Neighborhood Advisory Group input with respect to rezoning applications. We now invite Neighborhood Advisory Group members to the public hearing and encourage their participation and comment. A staff report for this application will be completed no later than Tuesday, May 15, 2001, and it will be delivered to you for review. This memo is sent to copy you with the notice of public hearing, which is attached, and to let you know that further information will be provided.
